MINUTES
CLOSED SESSION
APRIL 18, 1995
The Closed Session was called to order at 9:52 p.m., in the conference room of the
Senior Citizens' Center, 50 South Emerson Street, for the purpose of discussing
Property Acquisition, Litigation and Personnel. Present at the Closed Session were:
Mayor Gerald Farley; Trustees George Clowes, Richard Hendricks, Paul Hoefert,
Michaele Skowron and Irvana Wilks. Absent from the Closed Session was Trustee
Timothy Corcoran. Also present were: Village Manager Michael Janonis, Assistant to
the Village Manager David Strahl and Community Development Director William Cooney.
Property Acquisition
Village Manager Michael Janonis shared with Board members the recently completed
Appraisal for Ye Olde Town Inn. The Appraisal included a valuation for the entire building
as well as for the most northerly section of the former bowling alley area. After brief
discussion, the Village Board expressed no interest in pursuing the purchase of the entire
property. Discussion focused on the feasibility of acquiring the bowling alley area so as
to facilitate the construction of a public alleyway. It was estimated that the acquisition of
the property would be through condemnation. It was anticipated that with payment of
value for the property, necessary repair to the remaining building, demolition costs and
attorneys' fees that the acquisition could cost up to $200,000.
General consensus among the Board was that purchase of the property without some
agreement with Northwest Electric to, in turn, purchase some of the property would be
imprudent. After further discussion, the Board indicated a willingness to explore the
possibility of acquiring the rear part of Ye Olde Town Inn and perhaps using
condemnation, if Northwest Electric would, in turn, purchase a portion of the acquired
property not necessary for a public alleyway. Board directed staff to make this inquiry of
Northwest Electric during Developer Agreement negotiations.
As a fall-back position, the Village Board discussed the feasibility of acquiring an option
in the Ye Olde Town Inn property; either the entire property or the rear portion which
could be exercised at some future date should the property go up for sale or if the current
tenant ceased operations or if the building were destroyed by fire or other casualty. The
Village Board was amenable to exploring this contingency.
Staff was to report back to the Board at a future date.
Litigation

The Village is currently involved in a Lawsuit brought by certain property owners on South
Busse Road which allege that flooding along Addison Court has caused damage to their
properties. The roadway was built some 25+ years ago when the entire area was under
the jurisdiction of the Township. The Lawsuit was instituted prior to the Village forcibly
annexing the South Busse Road properties in 1988. The original defendants were other
property owners along Addison Court. Upon annexation of the area by the Village, the
plaintiffs joined the Village in the flooding lawsuit reasoning that the Village was the deep
pocket. Efforts to have the Village dismissed from the Suit have proved unsuccessful.
Subsequently, the area was disconnected from the Village through a Disconnection Suit.
Currently, Addison Court is not within the Village of Mount Prospect yet we remain a party
to the Lawsuit. During settlement negotiations, the Village made an offer to contribute
monies toward the construction of a storm water sewer system that would alleviate future
flooding for the plaintiff properties. One of the conditions of the Village putting up said
money was that all of the property owners along Addison Court would annex into the
Village. Subsequently, negotiations ensued to bring the Addison Court property owners
into the Village.
The Village Manager indicated that the Village and property owners were very close to
coming to final agreement. The Village Board discussed briefly the desirability of settling
this Lawsuit and confirmed that annexation to the Village would be a condition of said
settlement. Staff was directed to continue with necessary negotiations and report back
to the Board as necessary.
Personnel
Village Manager gave the Village Board an update regarding the negotiations with the
Police Department Union. He indicated that a mediator would be involved in the next
round of negotiations. Mr. Janonis indicated that a settlement in the range of 3 to 3-1/2%
seemed likely. The Village Board expressed a strong desire that the settlement be as
close to 3% as possible. There was also considerable discussion regarding modifications
to the prescription drug card benefit and the need to increase the co-payment as a means
of controlling medical insurance costs. Mr. Janonis also indicated that should the Police
settlement be in excess of 3%, he would press the Board to match the settlement with
regard to pay increases for non-union employees. Mr. Janonis suggested that non-union
employees should not be put in a disadvantageous position because of their non-union
affiliation. The Board indicated a willingness to consider the request pending the outcome
of the Police negotiations.
