MINUTES
EXECUTIVE SESSION
MARCH 2, 1993
The Executive Session was called to order at 9:27 p.m., in the second floor Conference
Room of the Senior Citizens Center, 50 South Emerson Street, for the purpose of
discussing Personnel and Litigation. Present at the Executive Session were: Mayor
Gerald Farley; Trustees Mark Busse, George Clowes, Timothy Corcoran, Leo Floros and
Paul Hoefert and Irvana Wilks. Also present was Village Manager Michael J anonis.
Personnel
The Village Manager reviewed with the Mayor and Board of Trustees the status of
Police Union negotiations. The Village Manager indicated that the Union has backed
away from the previously reached tentative agreement. It appears that the Union and
the attorney negotiating on their behalf are not communicating. This is causing some
problems. Mr. Janonis also indicated that a preliminary hearing in front of the arbitrator
has been scheduled for March 12. It is hoped that this next step will help to motivate
the Union to come to a final settlement without resorting to arbitration.
Other general personnel issues were discussed.
Litigation
Mr. Janonis also reviewed with Board members the status of the Artfield litigation
covering the River West apartment complex on River Road. Mr. Janonis indicated that
final inspection of the project resulted in high marks for workmanship and the project
has moved along smoothly. However, the final site design varies slightly from the
negotiated volume of compensatory storage. The Court had determined that the Village
could not force the developer to install compensatory storage, however, they agreed to
provide approximately 22,000 cubic feet. Final site grading resulted in a deficiency of
2,000 cubic feet. After consulting with the Village Engineer and attorney Buzz Hill, it
was determined that this deficiency was immaterial in terms of flood protection and that
it was questionable whether the Village would be able to enforce the voluntary
agreement with the Court. After further discussion, the Board concurred with the
Manager's recommendation that the deficiency be waived and that steps be taken to
reach final settlement in the case.

The Manager also gave a status report of negotiations regarding efforts to bring Addison
..L Court property owners into the Village. Mr. Janonis indicated that he had recently met
\JDT with two of the property owners and they had reached tentative agreement regarding the
~S\ p~ resolution of flooding issues and the possible dismissal of a Court case related to the
flooding. The Village Board directed the Manager to continue discussions and to report
back any progress.
The Executive Session was adjourned after a Motion by Trustee Busse and Seconded
by Trustee Wilks at 9:56 p.m.
