INVOCATION Mayor Wilks gave the Invocation. APPROVAL OF MINUTES Trustee Hoefert, seconded by Trustee Juracek, moved to approve the minutes of the regular Village Board meeting held February 2, 2010. Upon roll call: Ayes: Nays: Hoefert, Juracek, Korn, Matuszak, Polit, ladel None Motion carried. MONTHLY FINANCIAL REPORT AND APPROVE BILLS Mayor Wilks stated the next item on the agenda, "MONTHLY FINANCIAL REPORT AND APPROVE BILLS" was noted by an asterisk, and unless there was a request to remove an item(s), all items further listed in that manner would be considered with one (1) vote, as business item "IX. CONSENT AGENDA." MA VOR'S REPORT Mayor Wilks presented a resolution in support of the Village becoming a member of the Pension Fairness for Illinois Communities Coalition. Mayor Wilks stated the Pension Fairness for Illinois Communities is a coalition of local governments and other concerned entities committed to pension reform. As a member the Village of Mount Prospect will commit financial and staft resources to support the mission of the Pension Fairness for Illinois Communities Coalition. Fee for joining the coalition is $1,000. Trustee Hoefert, seconded by Trustee ladel, moved to approve Resolution No. 03-10: A RESOLUTION IN SUPPORT OF THE VILLAGE OF MOUNT PROSPECT BECOMING A MEMBER OF THE PENSION FAIRNESS FOR ILLINOIS COMMUNITIES COALITION Upon roll call: Ayes: Nays: Hoefert, Juracek, Korn, Matuszak, Po lit, ladel None Motion carried. Minutes of the Regular Meeting of the Mayor and Board of Trustees of the Village of Mount Prospect Page 1 of 3 February 16, 2010 CITIZENS TO BE HEARD CONSENT AGENDA MONTHLY REPORT & APPROVE BILLS RES 04-10 WIRELESS SOLUTIONS OLD BUSINESS NEW BUSINESS AMEND CHAPTER 23 (OFFENSES AND MISCELLANEOUS REGULATIONS) OF THE VILLAGE CODE COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD Richard Valentino 101 North Arlington Heights Road, Arlington Heights Mr. Valentino stated he had a list of public concerns related to the small triangle area where his client's restaurant, Ye Old Towne Inn is located. [List of concerns were distributed to the Mayor and Village Board.] Before Mr. Valentino moved forward with his list of concerns, Village Manager Michael Janonis stated it was important for the public to know that Mr. Valentino's client (Ye Old Towne Inn) is engaged with various lawsuits with the Village. The public concerns, as Mr. Valentino terms them, come from a public of one - his client. Village staff and counsel have met with Mr. Valentino, and provided responses to all of his client's concerns. As litigation is pending the Village Board has been advised by legal counsel not to engage Mr. Valentino at this meeting. Mr. Valentino presented the following concerns/questions: · Vacant property west of Ye Olde Town Inn - security and lighting · Pave property for additional parking - Homebrook Prospect property · Fa9ade - Submarine Express and Perfect Petal · Occupancy Permit - Blues Bar · Status of redevelopment plan - Homebrook Prospect CONSENT AGENDA Trustee Zadel, seconded by Trustee Po lit, moved to approve the following business items: 1. Monthly Financial Report January 2010 2. Bills dated January 28 - February 10, 2010 3. A RESOLUTION AUTHORIZING THE VILLAGE OF MOUNT PROSPECT TO DECLARE AGED ESCROW ACCOUNTS AS ABANDONED 4. Request Village Board approval to accept proposal for the purchase of point to point wireless solution in an amount not to exceed $42,200. Upon roll call: Ayes: Nays: Hoefert, Juracek, Korn, Matuszak, Pol it, Zadel None Motion carried. OLD BUSINESS None. NEW BUSINESS Mayor Wilks presented for a first (151) reading an ordinance to amend Chapter 23, "Offenses and Miscellaneous Regulations," Article XV, "Solicitation on Streets and Highways," of the Village Code. This ordinance amends Section 23.1502 "Permits" of the Village Code by limiting the number of street solicitation permits to any organ ization to one (1) per calendar year. Village Manager Janonis stated the current code allows eligible organizations to conduct street solicitation up to four (4) times per year. Due to safety and public concerns with this type of fund raising activity staff recommend limiting the number of permits issued to any organization to one (1) per calendar year. In response to a question from Trustee Juracek, Village Manager Janonis stated the permit will allow an organization to conduct the event over a two (2) day period. Trustee Hoefert, seconded by Trustee Korn, moved for approval of Ordinance No. 5788: ORD 5788 AN ORDINANCE AMENDING CHAPTER 23 (OFFENSES AND MISCELLANEOUS REGULATIONS), ARTICLE XV (SOLICITATION ON STREETS AND HIGHWAYS) OF THE VILLAGE CODE OF MOUNT PROSPECT Upon roll call: Ayes: Nays: Hoefert, Juracek, Korn, Matuszak, Polit, Zadel None Motion carried. MANAGER'S REPORT VILLAGE MANAGER'S REPORT Item A. - purchase of point to point wireless solution, approved under consent agenda. Status Report - no items presented. OTHER BUSINESS OTHER BUSINESS Trustee Matuszak requested a review and discussion of parental responsibilities when the Village incurs costs for cleanup of public right-of-way after an underage party. [A recent party that involved under age drinking while the parents were gone resulted in a significant amount of debris being left in the public right-of-way.] Village Manager Janonis stated the Third District Court has typically not supported the assessment of additional fees for clean-up/enforcement. However, the Village Attorney will do further research with the Third District Court as well as the potential for utilizing the Village's Administrative Adjudication program to recover costs. Trustee Korn reminded homeowners that in accordance with Village Code all Christmas and other related outdoor holiday decorations should be removed by February 25th Village Manager Janonis stated staff will take appropriate measures to notify homeowners in violation of the Village Code. CLOSED SESSION CLOSED SESSION Mayor Wilks asked for a motion to enter Closed Session for REVIEW OF MINUTES 5 ILCS 120/2.06 (c)(21) - Discussion of minutes of meetings lawfully closed under this Act, whether for purposes of approval by the body of the minutes or semi-annual review of the minutes as mandated by Section 2.06. Trustee Zadel, seconded by Trustee Polit, moved to meet in Closed Session to discuss REVIEW OF MINUTES 5 ILCS 120/2.06 (c)(21).
