SUBJECT: AMEND CHAPTER 23, "OFFENSES AND MISCELLANEOUS REGULA TI
ARTICLE XV, "SOLICITATION ON STREETS AND HIGHWAYS" OF THE
VILLAGE CODE OF MOUNT PROSPECT
Under the current Village Code, eligible charitable and not-for-profit organizations are allowed to
conduct solicitation activities at highway and street intersections where solicitation is permitted
up to four (4) times during a twelve (12) month period. [Street intersections: where all traffic is
required to come to a full stop.]
In general, most eligible organizations request permission to conduct street solicitation once a
year in conjunction with a nationwide, state or multi-community fund-raising campaign.
However, there are also eligible organizations that apply for solicitation permits up to the
allowable four (4) times per twelve (12) month period.
While the safety and saturation of street solicitation has generated public concern in the
northwest suburbs, the Village of Mount Prospect recognizes many of the charitable and not-for-
profit organizations rely on the street solicitation of financial donations to further their
humanitarian projects. Therefore, to address the public concerns associated with street
solicitation activities staff recommend:
1) Amend Section 23.1502: "Permits" of the Village Code by limiting the number of street
solicitation permits to any organization to one (1) per calendar year.
2) Continued enforcement of all requirements to obtain a street solicitation permit and
safety regulations when conducting solicitation activities. Accordingly, only those
organizations that comply with both the application requirements and safety regulations
will be issued a street solicitation permit.
Please forward this memorandum and draft ordinance for the Village Board's consideration and
approval at the February 16, 2010 Village Board meeting. Staff will be in attendance to respond
to questions.

AN ORDINANCE AMENDING CHAPTER 23, ENTITLED
"OFFENSES AND MISCELLANEOUS REGULATIONS,"
OF THE VILLAGE CODE OF MOUNT PROSPECT
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING
IN THE EXERCISE OF THEIR HOME RULE POWERS:
SECTION ONE: Section 23.1503 entitled "Permit Required" of Chapter 23 entitled "Offenses and
Miscellaneous Regulations, II as amended, is hereby further amended by deleting Section 23.1503
in its entirety and inserting the new Section 23.1503 to be and read as follows:
23.1503:
PERMIT REQUIRED:
An organization eligible to conduct solicitation activities shall apply for a street
intersection permit for such solicitation from the village clerk. The village clerk
shall review the application for compliance with the eligibility requirements set
forth in section 23.1502. No permit shall be issued unless all requirements are
met. Not more than one permit shall be issued to any organization within any
calendar year.
SECTION TWO: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form in the manner provided by law.

Aged Escrow Accounts
Pursuant to certain Village Code provisions, builders and developers are often
required to establish escrows or deposit cash bonds in order to assure that certain work
is completed. From time to time, and despite attempts to notify them, the depositors fail
to claim these funds.
After seven years, the Village is permitted to declare these funds as abandoned.
I have attached a resolution that accomplishes this and directs the Finance Director to
transfer these into the General Fund.
The Village Manager has asked that I also prepare an ordinance that, in the
future, will permit these transfers to take place automatically after seven years. I will
have that available for the next meeting.

RESOLUTION
Preamble
The State of Illinois has established at 765 ILCS 1025/8.1 that any property held by a
unit of local government for more than seven years, that has remained unclaimed shall be
deemed abandoned. The Village of Mount Prospect has held certain escrows, cash bonds,
guarantees and other forms of assurance of performance for longer than seven years. The
Village of Mount Prospect President and Board of Trustees find that it is in the best interests of
the residents of the Village of Mount Prospect that these deposits be transferred to the Village's
general fund.
NOW, THEREFORE, THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, ACTING PURSUANT TO ITS
HOME RULE POWERS, RESOLVES AS FOLLOWS:
SECTION 1: All escrows, cash bonds, guarantees and other forms of assurance that
have been held by the Village for longer than seven years are declared to be abandoned and
shall become the property of the Village of Mount Prospect. The Finance Director is directed to
transfer such monies into the General Fund to be used in accordance with General Fund
policies.
SECTION 2:
This Resolution shall be in full force and effect from and after its
passage and approval in the manner provided by law.
