President Congreve called the meeting to order at
8:05 P.M~ with the following members present:

to approve the minutes of the previous meeting of July 6th Minutes

moved to amend proposed ordinance establishing license fee
and regulations for miniature golf: courses, which has had ~,~cense fees

Trustee Ekren gave the f~rst reading of ordinance
Spec. Assess. setting up special assessment for paving of Kenilworth Avenue
Kenilworth and other improvements, To be placed on next week's agenda.
Trustee Bergen, seconded by Trustee Colfer, moved
that the Plan Commission'should hold public hearing to discuss
Village Plan possible amendment to Section 1~, Article 2, Village Plan,
which would add a penalty clause for non-compliance.

Trustee Bergen ~ead the following letter from Jacob
Kellen:
President and Board of Trustees

Mount Prospect Village Hall
Mount Prospect, Illinois
Gentlemen: Re: Zoning Case No. 65-6
We have been advised that the Zoning Board of Appeals
of the Village of Mount Prospect has recommended that a varia-
tion of the terms and conditions of the Mount Prospect Zoning
Ordinance be granted to permit the use of our property at the
northeast corner of Golf Road and William Street, hereinafter Case 65-6
described, for a wholesale and retail greenhouse business and. Golf 6 William
a garden supply business. We are presently conducting such
businessess on our said property as legal nonconforming uses,
and we have sought a variation so that our uses will be per-
mitred uses and so that we can construct a new building to use
in connection with the conduct of our businesses.
We understand and have agreed that if an ordinance
granting the variation that we have requested is adopted by
the President and Board of Trustees of the Village of Mount
Prospect, that the granting and. adoption of that variation is
not to be construed as a decision by the Board that a reclassi-
fication of our~property to the B-3 Business and Retail Service
District would be appropriate, desirable, or in the best interest
of the public.
By this letter, and to induce the President and Board
of Trustees of the Village of Mount Prospect to adopt an ordi-
nance granting us the variation that we have requested in the
above case, we hereby agree that we will not, at any Time in the
future, use the granting of such variation in support of a peti-
tion, or a lawsuit, to secure a B-3 classification of our property
described above.
We further agree that we will abide and be bound by
such conditions as the Board of Trustees may, by ordinance,
t ach to the granting of the variation requested in the above mat-
~he property for which application for a variation has
been made is more particularly described as:

Thaw part of the West 325.71 feet (meastu-ed at right angles to
the West line thereof~) of Lot. 7 in Owners Subdivision of Sec. 13,
Twp. 41 North, Range 11, East 3rd P.M~ lying South of a line
drawn at right angles to the West line of Lot 7 from a point on
said West line which is 1004.70 feet South of the Northwest cor-
ner of said Lot 7 (except the West ~00 ft. thereof); all in Cook

E 3rd P.M., described as follows: Commencing at the intersection
of the Eas~t line of the West 325.71 feet, measured at right
angles to the West line thereof, of said Lot 7, with the Southerly
line of said Lot 7; thence north on the East line of the West

Trustee Bergen gave the first reading of an ordinance varying
the use regulations of Kellen's property to allow continuation
Kellen propertyof his garden supply business. The Board asked the Village
Attorney to meet with Mr. Kellen's attorney, Dudley Sullivan,
to agree to amending the second paragraph of the letter by de-
leting "B-3 Business and Retail Service District" and insert-
ing "any business district".
Trustee Bergen, seconded by Trustee Teichert, moved
that the Board of T~ustees disapprove the plans and specifica-
tions for the installation of sanitary sewers and water mains
in Units 6 and 8 of Elk Ridge Villa and that the Board of
sewers & mains Trustees direct the Acting Superintendent of Buildling to for-
Elk Ridge Villa-~e ward a letter to the developer, explaining that the following
changes are required in-said plans and specifications in order
to provide the necessary fire flow:
1. 500.000 gal. storage tank and pumps to be
installed at approximately Golf and Busse.
2. Install 10" water main from Redwood to Busse.
3. a. Connect 8" water main in Timberlake
Apartments to corner of Tamarack and
Pheasant,
or
Install 8" water main on Pheasant to
Tamarack.
b. Install 6" water main from Pheasant to
Willow Lane (continuation of Lavergne).
c.Install 6" water main from Catalpa to
Busse.

Motion carried.
Curfew T~us~ee Teichert asked the press as a public service
to publish the Village ordinance regarding curfew.
The Board discussed nuisances; overgrown lot at
nuisances 200 S. Emerson; purple martin bird houses kept by resident,
the birds annoy the neighbors, No action was taken.
July 13, 1965
Letter was received by the Board signed by
Mrs. Mary Gardner, President of the Library Board, requesting
that the President and Board of Trustees take such action as
the law may~equire to secure a maximum tax rate for the Library Library tax
Fund at .12% of the full, fair cash value of all taxable prop- rate
erty in the Village of Mount P~ospect. Copy of proposed library
/budget accompanied this letter.
Prospective purchasers of homes in Elk Ridge Villa
complained because the Village was holding up building permits
and they wanted their houses completed by due date. President Elk Ridge .Vill
Congreve replied that this was a matter of litigation, not to bldg. permit
be discussed at open meeting.
