T~ustee Colfer gave first regding of ordinance amend- ing Chap. III Sec. 7 of the Building Code, deleting therefrom: "Applicants shall not be charged a fee for examination of plans Plan exam fees if the same have been used by him for building on any lot located in the same o~ an adjacent subdiv'ision." This should be put on agenda lo, next meeting. Trustee Colfer ~equested the following matters pending before the Building Committee be dropped: Colonial Heights and DiMucci street olosings~ Colonial Heights Bth Addition, varla- Building Comm. tions, Lots 5, 6, 13 and 18~ DiMucci request for meeting re Lot 2~0. President Congreve gave approval to drop these items. Tmustee Colfer brought up subject of portable swimming pools in use in a~eas before annexation to Village, and asked Village Attorney if non-conforming pools could be amortized without jeopaz~lizing l~gality of pool ordinance. June 8, 1965 Trustee Ekren requested that matter of Colonial Heights and DiMucci Street closings be dropped from Street Street Committee Committee. President Congreve gave approval to drop this item. T~ustee Bergen stated that because of the insuf- ficient vote on Ordinances 1055 and 1056 au the last meeting Ord 1055 & 1056 motions fDr passage would have to be brought up again. T~ustee Bergen, seconded by T~ustee Colfer, moved for the passage of O~d. 1055: AMENDING CHAP. 13 OF THE MUNICIPAL CODE - SECTION 13.114.1 (Liquor license, miscellaneous restrictions) This deletes, ;'and~ except on premises located within a planned recreational, open space district, there shall be no dancing~ floor show or entertainment of any type." Trustee Bergen, seconded by Trustee Teichert, moved Ord 1058 for the passage of O~d. 1058: AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT This ~dinance relates to Zoning Case 65-3~ property at the Northeast corner of Dempster and Algonquin Road and classifies it from R-1 To B-$. June 8, 1965 Trustee Bergen, seconded by T~ustae Teichert, moved for the passage of Ord. 1059: 0rd 1059 Zone ~5-q AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT This ordinance relates to Case 65-4, property located south of Dempster, west of Busse Road, and north of Algonquin Road and classifies it from R-1 to B-3 and P-1. Trustee Bergen, seconded by Trustee Teichert, moved for the passage of Ord. 1060: Ord 1060 AMENDING THE MUNICIPAL CODE OF MOUNT PROSPECT Beer perm BY ADDING A SECTION 13.106-A THERETO non profi' This ordinance amends Sec. 13,106-Awhich allows granting of daily permit for sale of beer to non-profit organizations with- out fee. Trustee Bergen, seconded by Trustee Teichert, moved for the passage of Ord. 1061: 0rd 1061 AMENDING SECTION 2,208 OF THE MUNICIPAL CODE Stand Comm. This ordinance deletes the list of Standing Co~m~ittees numbered 1 through 6, and substitutes a new list: 1. Building 4. Judiciary 2. Finance 5~ Public Works 3~ Fire and F~ice 6. Public Health and Safety Upon roll call: Ayes: Bergen Collar Ekren Grittani Teichert Absent: Bruhl Motion carried. Trustee Bergen stated that three variation hearings be held June 18 at 130 N. Wells by Cook County Zoning, Dockets 917, 910 and 912 had been~received and he could see no reason County Zone for the Village tO object to Dockets 917 and 910, but that the Village should object to Docket 912, variation to reduce the setback requirements of fifteen feet to two feet for a sign at Firestone. The Village had previously objected to this request (Docket 876, Res. 8-65). June 8, 1965 T~ustee Bergen, seconded by Trustee Colfer, moved that the Object County Village object to Docket 912 and that the Village Attorney Zon. Trustee Bergen read the following report~from the Judiciary Co~mmittee on Case 6,5-9:, Case 65-9 Lembesis Zoning Case 65-9m heard May 21, 1965 Variation Petitioner: Louis Lembesis Petitioner's request is for a variation on minimum side yard ~equirement of 20 feet rom co~ner lot. Petitioner desires l0 foot side yard. This property is located at 500 S~ Wapella Ave.; Southwest corner of Wapella and Shabonee Trail (Lot lm Block 12~ P. 16-S, Zoning Map). Lot dimensions ame 52.73 feet (east), 140~15 feet (north)~ 40.16 feet (west) and 162 feet (south). Boamd of Appeals recommendation:Vote of 4-0 to grant varia- tion. The Committee recon~mends that ~equest for variation be granted. Trustee Bergen read the following report fmom the Judi- ciary Committee on Case 65-.0: June 8, 1965 oning Case 65-10, heard May 21, 1965 Petitioners: Henry Boehmer- 810 S. Albert Zone Case 65-10 William O'Brien - 808 S. Albert Boehmer 6 Petitioners' request is to reduce side yard ~equirement from 7 feet (10%) to 4 feet 8 inches to allow petitioners to construct garages~. This property is located on Lots 60 and 61 on West side of 80O~block on Albert Street (Page 30-S, Zoning Map). Board of Appeals recommendation: Vote of 5-0 to grant varia- tion, however'variation robe null and void if not usedwithin one year fr~m date of approval by Board of T~ustees. The Committee recommends that request for Variation be granted, said variation to be used within one year. (3-0) Trustee Bergen, seconded by T~ustee Teichert, moved to concur with the opinion of the Zoning Board to grant variation and di- rect attorney to draw up ordinance granting variation to reduce side yard requirement from 7 feet to four feet eight inches, said variation to be used within one year. Trustee Bergen requested the item "School District ~59 re Elk Ridge Villa Unit ~7" be removed f~om Matters Pending before Judiciary Committee,' in view of Board of Trustees re- Removalfrom Scinding approval of final plat of subdivision for Unit #7 of Judiciary Comn Elk Ridge Villa by ResOlution 15-65 on May 18, 1965. P~esident Congreve directed this item be removed ~rom committee assign- ment. T~ustee Bergen requested Sunset Heights West plat be removed from Matters Pending before Judiciary Committee. Pres- ident Congreve directed MaBa~er Appleby to strike this item until such time cont~act~ camPlies with Village o~dinances. TrusteeBergen ~ead letter from Attorney Robert L. Stanton regarding Zonin~ Boamd of Appeals Case 63-28, Linneman Road (Church Road) ~equesting review of this case, stating it was still current. The minutes of Jan. 26, 1965 show Boax~d Case 63-28 Concurred with Zon~inE Board Findings. President Congreve in- Linneman Rd. strutted the Clerk to notify M~. Stanton of this and enclose copy of minutes of Jan. 26, 1965 with letter. (My. Stanton was previously notified by Clemk on Jan. 29, 1965.) President Congreve mefemred to Judiciary Committee ordinance amending Art. 4, Chap~ V of Municipal Code increasing 9 members members to 9 on Plan Commission. Plan Comm. E. Wayne Haydel, a ~esid%nt ~esiding aT 903 S. Waverly~ came forward and asked fo~ consideration ~egarding complaint on lots S. Waverly ~ coruler of the in~ePsection of S. Wavemly and West Sunset. He stated this was called to the attention of the Village Manager. W. Sunset Public Works has put up sign "No DumpSng" and police have been pa%~olling the apda. However, the lots a~e still a menace to public health and safety because of standing water and debPis, Owners have been contacted but a~e not planning any action. Mm.
