Chlorine bids Trustee Phillips, seconded by Trustee Bruhl, moved
to open bids for chlorine, purchased by the Village in
operation with the Park District, thus allowing savings because
of buying in large quantity. This motion carried by acclama-
tion.

Police - Trustee Eusse reported that the Police Dept. was in
need of three crossing guards, 'and asked that if anyone were
interested in the job to contact him.
Stop signs Trustee Bergen inquired if the signs on streets
that had ~-way stop signs could be marked to state "~-WAY STOP"
instead of just "STOP". The Village Manage~, Mr. Appleby, will
check into this.
Highway Division President Schlaver read the following letter from
Seymour Simon Seymour Simon, President, Board of Cook County Cc~missioners:
January 11, 1965
Dear President Schlave~:
I am very pleased to inform.you that the widening of
Central Road from Northwest Highway to Rand Road, within your
Village, has been included in the Cook County Department of
Highways Improvement Program. The design work necessary for
the award of this worthwhile p~ojec= will commence immediately,
and it is anticipated :ha:construction will take place duming
the 1965 construction season.
Eoth Commissioner Fulle, who has been deeply inter-
es:ed in the programming of this project, andI, feel that the
hazardous situation that exists on Cen-~ral Road today must be
alleviated as soon as possible.

Trustee Ekren took up the Zo~ning Case of Doyno Motors, Zoning Case
who asked for Special Use in an I-1 zone. on the north side of 64-22
Central Road~ between Hines Lumber Yard and Northwest Highway. Doyno
This appeal was ~urned down by the Zoning Board by a vote of
5-2, and their report shown in the minutes of June 2, 1964.

In connection with the above captioned mat~er and the
petition of the 530 Northwest Building Corporation (owner) and
Doyno Motors, Inc. (lessee), the aforesaid petitioners do hereby
stipulate that in consideration of the Village of MT. Prospecz
granting any of the relief requested in said petition, the
undersigned as owner and lessee-of The propem~y on Central Road
described in said petition, do hereby agree as follows:
1. There shall be no retail sale of automobiles
(new or used) on said Central Road premises;
2. The area between 2he road right of way line and
the building line shall be professionally landscaped from the
east To west lot lines with appropriate hedging of approximately
8 feet =o ~ feet in height;
8. There shall be no cars which have been wrecked
or parts of cars left sto~ed outside The building;
4. The outside lighting on the property will be in

Lots 3 and ~ have been sold to the Impemial Stamp and
Engraving Company, who will start a building shortly. Lot 1
'has been sold to MidWay Construction & Engineering Company and

In accordance with our ~eoent conversation, this is
to confimm the fact that this fir~ will undertake to represent
the Village of Mount Prospect in an appeal of the above-cap-
tioned
It is our understanding that~ should the Village wish
to retain the services of this firm~ an appeal would be prose-
cuted from the final ords~ of the Illinois Commerce Commission
in case numbers 50181 and 50152 in conjunction with an appeal
to be undertaken by the Village of Schaumburg. The Company
has appealed from the order of the Illinois Commerce Commission
to the Circuit Court of Will County and under the Statutes
governing these matters, we would file a notice of appeal
Will County as well. We would bill the Village of Mount l~o~psct
in accordance with our ~egula~ billin& fess on an hourly basis,
the same being $35 an hour. In no event would the shame of the
Village of Mount P~ospect's costs in this matter exceed $2,500
for the appeal in the Circuit Coumt.
Should it become ~ecessa~y or desirable to prosecute
an appeal f~om the decision of the Circuit Cou~t to the Supreme
Court, further arrangements with ~espect ~o fees would then he
discussed.

FOR EMERGENCY WATER
WHEREAS, the Citizens' Utilities Company of Illinois
is a coDpoDation ceDtified by the State of Illinois to pDovide
wateD and sewe~ seDvice .to ceDtain aDeas within the Village of
Mount Prospect as well as othe~ameas in th9 unincoDpoDated
aDea of Cook County~
WHEREAS, the Citizens' U~ilities Company of Illinois
desires to have an emeDgenoy souDce of wa~D so as to provide

continuous service in its area of certification to p~event
the interruption of wa%er service during emergency periods.;
and -
WHEREAS~ the Village of Mount P~ospect~ a Munici-
pal Co~poration, is concerned about the welfare of the
residents of the Village of Mount Prospect served by the
Citizens' Utilities Company of Illinoi~ as well as its obli-
gations to provide fine protection in areas served by the
Company; and
WHEREAS, it is deemed mutually convenient and
necessary to both parties that a wate~ main interconnecting
the ~wo water systems be constructed;
NOW, THEREFORE, IT IS AGREED by and between the
Village of Mount P~ospa¢%, a Municipal Corporation, herein-
after designated as "The Village" and the Citizens' Utilities
Company of Illinois, hereinafter designated as "The Company":
1. The Village shall cause to be constructed a
wa~er main connecting the two water systems.
2. The cos~ of the water mainconnection shall
be shared equally between the Village and
the Company.
3.The Village and the Company shall each own
50% of %he wa~er main connection.
4. The Village a~d the Company agree =o provide
each othe~ with water for emergency purposes

An emer~nc~ ~ur~se hereunder is one which arises
when the pressure ~nthe mains belonging %o either of the
parties is less than 30 pounds per sq. inch due to either:
(a) Failure of the well to produce wa~em
due ~o a mechanical failure~ a power
intex~uption or a well cave in.
(b) A fi~e or explosion on the premises
of any user of either watem system.
All repair work shall be completed within a reason-
able length of time.
5. The wa%er rate %o be cha~ged either party
during the period in which emergency wa:er
is provided by the othem shall be $0 cents
per thousand gallons.
~. This agreement shall in no way obligate --
either pam%y to pmovide water if unable
to do so. The aSility to providewater
shall be dependent upon the ability of the
party to maintain ~0 lbs. of pressure per
sq. inch in any of its mains.

required water main extension, in part, across an easement over
private property extending from a point on the north side of
Rand Road, south east of the intersection of Rand and Foundry
Road, northerly to a point on the south side of Foundry Road,
East of the said intersection.
As pe~ ow previous conversation ~the Village of Mount ~ospect
now wishes us to coast-z~ct this water main extension, in part,
from the intersection of said easement and the north side of
Rand Road, northwesterly to the intersection of Rand Road and
Foundry Road; thence eastly along the south side of Foundry
Road to the inersaction of said easement and Foundry Road, .in

In addition, we would like to ask for a time extension until
Spring of 1965 to do the seeding, .sodding, concre=e work and
paving, as we presume you would not wish such work done as
soon as we are finished with the under~x'ound work.
One more point we ~ould like to make is that this portion
of the work will be slow and tedious due to the large amount
of hand digging that we will enooun=er in this ex=fa .work.

The "Federal~Aid Highway Act of 1962, provides
that no federal funds will be available for highway projects
in urbanized areas suck as the Chicago Area unless the pro-
[' posal is based on a comprehensive, continuing planning pro-
cess carried on cooperatively between the State and the
communities involved~
The Ch~ago Area Transportation Study (CATS) has
prepared a rogional Transportation plan based on a compre-
hensive st-~dy. Together, CATS and. the Northeastern Illinois
Plannin~ Commission (NIPC) a~e carrying ou= the continuing
phase of planning a= the regional level.

RESOLUTION ~-65
The Villageof Mt. P~ospect acknowledges receipt of Res. 4-65
a proposed Agreement to cooperate with the DEPARTMENT OF
PUBLIC WORKS AND BUILDINGS of the STATE OF ILLINOIS in a con-
tinuous comprehensive transpovtation planning process, and is
in full accord with the purpose of the Agreement and wishes
to enter into said Agreement with the DEPARTMENT.
NOW, THEREFORE, BE IT RESOLVED that it directs its
Village President ~o sign said Agreement in behalf of the
VILLAGE and,
BF. IT FURTHER RESOLVED that the Village Clerk is
hereby .~ivected to t~ansmit a reproducible copy of this reso-
lution along with the executed Agreement to the DEPARTMENT OF
PUBLIC WORKS MD BUILDINGS through the office of the Director
of the Ch~ago=Transpor~ation S~udy.
AGREEMENT
THIS AGREEMENT made this 18 day of January, 1965, by
and between the VILLAGE OF MT. PROSPECT, hereinafter called
VILLAGE and the DEPARTMENT OF PUBLIC WORKS AND BUILDINGS OF THE
STATE OF ILLINOIS, hereinafter called DEPARTMENT.
WITNESSETH:
WHEREAS portions of Cook, Du Page and Will Counties,
Illinois have been designated by the Bureau of the Census in
1960 as part of the Chicag~ Northwestern Indiana Urbanized
Avea~ and
WHEREAS the Federal-Aid Highway Act of 1962 p~ovides
that:
"After July 1, 1965, the Secretary shall not approve
under Section 105 of this title any program for projects in
any urban area of more than fifty thousand population unless
he finds that such projects ave based on a continuing compre-
hensive ~anspovtation planning process caz%~ied on cooparatively
by States and local co~nunities in confor~ance with the object-
ives stated in this Section", and
WHEREAS the Secvetamy of the United States Department
of Commez~:e vefer~ed to above, through the Btneeau of Public
Roads has interpreted "cooperatively" to mean the establishment
of a. formal procedure - - supported by a written memorandum of
understanding -- between the State of Illinois through its De-
pavement of Public Works and Buildings and the governing bodies
of the local communities within the "Urbanized Area", and
WHEREAS the Northeastern Illinois Me%~opolitan Area
Planning Commission is an official regional planning agency
created by the State Legislature which by special agreement will
prepare a series of land use plans for the Chicago area, givinE
consideration to ar~ core'elating all pertinent existing plans,
projects, proposals and policies of units of government; and
WHEREAS the Chicago A~ea Tvanspov=ation STudy was
created by the City of Chicago, County of Cook, and State of
Illinois to make studies and pvepame transportation plans for

in a continuing compsshensive
planning psocess satisfying the PequiPements
of the FedePal-Aid Highway ~ct of 1962. The

and coosdinating the plans of the VILLAGE,

Daniel Ward, State's Attorney of Cook County, re suit for

Attorney Hofert reported that case of 65 L 709 Court Case
(suit for $50,000 by'John'P Martin, alleged fall on Emen~son 65 L 709
S~eet) has been referred to the insurance company.
Manager Appleby pointed out to the Board that lot Old Orchard
sho~m as "Not Included" on map of annexation of Old Orchard annexation ~
Country Club, facing Schoenbeok Road, was surrounded by in-
corporated te~itory and could be annexed involuntarily.
This is a homesite. This matter was referred to the Village
Attorney.
Manager Appl~by info~med the Board that the plans traffic
and spe¢iflcations for %"~affic light at Gregory and Main signals
weme ready, and that Engineer Ben Hammerer would like the
%Tustees and Chief Whittenberg to review them within the
next few days.
P~esidant Sohlaver referred to the Plan Commission Green Acres Sub
a Plat of Survey showing extensions of Robin Lane, Sunset
Drive, Green Ac~as Lane and Glemn Lane in Green Acres Subdi-
vision~ this was submitted by Schavilje & Knuth.
lh~esident Schlaver reported to the Board that the Taxes
Village's share of sales tax for the month of November came
to $35,135.28.
Attorney Hofert ~ead the following memo to the Building

MEMO Pd~ TALLY HO:
The Exchange National Bank has conveyed its interest in the
Tally Mo Apa~l~ments to one Sharyl Anderson, who is an employee
and nominee of Marshall Savings 6 Loan Association and who may
be found on the premises thereon. Marshall Savings 6 Loan
Association holds the beneficial interest in the land trust
as further security for the payment of their mortgage.
The new attorney for said association, one Gale Marcus, phone
CE-8-7855, indicated to me that he had talked to Bill McG~af,
P~esident of Mamshall Savings & Loan Associa~on~ who infoz~ed
him that within one week from date thereof they were contem-
plating the sale of the premises to a party who would proceed
to improve the property. I informed him that although we
would not immediately start suit we wished to ser~e our notice
immediately so that we could proceed.
I was also advised by Mm. Allen Bloch that there was pending
a mechanic's lien and mortgage foreclosure on Precast Building
Section, Inc. vs --- (83 C 18059). Possible intervention should
be considered since all parties involved are parties to the suit
with the exception of She~yl Anderson.
Mr. Gale Mancus could not advise us as to who had the right to
the certificate of beneficial interest.
