of which was for engineering costs, which had inadvertently
been omitted from appropriation.

Heard November 20, 1964
The petition requests rezoning f~om R-3 to B-3 of Lots
l, 2, 3, ~, 5 and 6 located at thesouthwest corner of
Central Road and Wapella Street, Mount Prospect.
The President of the West Central Civic Association, together
with an attorney representing the Association, the owners of
property immediately to the south and east of the subject
property, and other owners, of property in the vicinity were
p~esent and registered objections to the rezoning requested
by the petitioner.
Based on the following findings, the Board voted 6-0 To deny
the recommendation of such requested rezoning:
1) Public welfare does not demand the rezoning.
2) Spot zoning~
3) Depreciation of the residential value of
surrounding land zoned R-1.

MEMO re Dominion Development Co., Case 64-37:
Lots 1, 2, 3, 4, 5 and 6 which fPont on Central ape separated
by an alley f~om lots to the south zoned R-1 which fPont on
Wapella. Immediately to the east is other pPopePty fPonting
on Central also zoned R-3 and south of which the land is zoned
R-t. All land to the west and southwest of the subject
pPopePty is zoned R-1.
The petitioner testified that the land to the south of the
subject propePty was vacant~ but the owners of homes immediatley
to the south pPesented themselves to testify to the contrar~f
and to object to any Pezoning of the propePty.
The President and the Attorney of the West Central Civic Asso-
ciation p~esented the objections of the Association and home-
owners in the immediate area of the subject property to the
proposed Pezoning. The. Association's objections wer~ that the
value of land zoned R-1 would be adversely affected, that the
already dangerous traffic hazard which exists where CentPal,
Prospect and the Pailroad intePsect would be aggravated by the
opePation of the proposed gasoline service station~ that theme
were mor~ than adequate gasoline service station facilities in
the vicinlty; that the~e was no public need om demand fop such
~ezoning~ and that such ~ezonlng would be spot zoning.
While the petitioner did not agree with the objections, he of-
feted no facts derived fPom a traffic ~udy, no plan for traffic
control, no substantial explanation why the p~operty could not
be used as zoned.
The Board was unanimous in its decision that the pPoposed
rezoning cannd~ be justified by any need or demand of public
welfaPe~ that business use of the pPoposed land would be most
incompatible with the use and zoning of land to the east, west
and south; that the value of such surrounding pPoperty would
be adversely affected, and that an alPeady poop traffic situa-
tion would be dangerously aggravated.

Trustee EkPen, seconded by Trustee Busse, moved that Zoning Code
the Zoning Boamd of Appeals be Pequested to hold heaping at
the eaPliest possible date amending Sec. B-3, Zoning DistPict,
and defining temm of DPive-In Restaurant and Food Establishment.
This will be known as Case 65-2, to be heard January 29, 1965.

Motion carried.
Members of the Wedgewood Terrace Homeowners Association were
present, and their president spoke, telling the Board that
-- the association was glad to be a part of the Village, and
that the only disappointment was that certain lots along the
east b~undary had been omitted fPom the plat due to the
objection of the owners.
It was pointed out that these pPopemties were now surrounded
by the Village and in a position to be annexed.
Trustee BPuhl, seconded by Trustee Bergen, moved that the
Village Attorney be directed to draw up papers of annexation ~
pertaining to all property which was originally included in
the petition fop annexation but which was allowed to be
omitted by order of Judge Ad~sko, namely, Lots a, 5, 7 and 8 -
in Block 1, and Lots 1, 2, 3 and 4 in Block 8, Wedgewood
Terrace.

and specifications, receive bids and award the

2. The STATE will pay all consi"~uction and engineer- in~ costs, and

the street is used as a State Highway, the STATE

the corporate limits of the VILLAGE, the pavement

Elmhurst Road and Mount Prospect Road.
NOW THEREFORE BE IT RESOLVED, that if said improvemen~
is cons~ucted as heretofore stated, the VILLAGE will partici-
pate on the following basis.
1. The VILLAGE shall adopt before the award of ~he con%-rac=
and pu~ in~o effect, on or before October 1, 1966, an ordinance
prohibitin~ parking within =he Village Limits of the improvemen:,
a copy of which is attached hemeto as Exhibit "A", and
2. The VILLAGE shall adopt and put into effect, before the
award of ~he contract~ an ordinance prohibiting parkin~ within
the limits of ~he proposed improvement in areas where ba~ier

Parallel pa~king will be allowed in curbed areas along Northwest
Highway between Wille Street and Maple Street and on Main Street
(Elmhurst Road) within the limits of the proposed improvement,

Illinois:
Section 1. That Section 22.209 of the Municipal Code
of the Village of Mount P~ospect be and is hereby renumbered so
tha~ hereafter it shall be designated as Section 22,210.
Section 2. That there is hereby added to the Municipal
Code of ~he Village of Mount P~ospec~, a new Section 22.209 to
read as follows:
"NO person~ fir~ or corporation shall cause sanitary
sewage or industrial waste to he discharged into any

Plats of Subdivision for Elk Ridge Villa Uni~
7 and 8 have been approved by the Village Board of Trustees.
The Met~'opolitan Sanitary D~strict of GreaTer
Chicago has issued permits for ~he Sanitary ~ewerage system
in these units.
I hereby request permission to construct the public
improvements consisting of curb and gutter, pavement, side-
walk, and storm sewers as shown on plans prepared by E. N.
Fletcher. Engineer, dated August 31, 196~ and identified as
No. 6320, a~ our expense and at no expense To ~he Village
of Mount Prospect in Elk Ridge Villa Units 6, 7 and 8. When
these improvements are completed and accepted by ~he Village
of Mount Prospect, they shall become the property of said
Village withou~ cost ,or expense ~Q said.Village and I will
give the Village a Bill of Sale for them.
I hereby request that the recording of the Plat be
held until a later date.

special assessment case was taken up in court that day and con-
