INVOCATION INVOCATION Trustee Juracek gave the Invocation. MINUTES APPROVAL OF MINUTES Trustee Hoefert, seconded by Trustee Zadel, moved to approve the minutes of the regular meeting held November 17, 2009. Mayor Wilks stated the last name of artist that donated the painting of the U.S.S Franklin to the Village was Leo not Leonard as reflected in the minutes. Mayor Wilks called for the vote for approval of the minutes as corrected. Upon roll call: Ayes: Nays: Hoefert, Juracek, Korn, Matuszak, Polit None Motion carried. APPROVE BILLS APPROVE BILLS Mayor Wilks stated the next item on the agenda, "APPROVE BILLS" was noted by an asterisk, and unless there was a request to remove an item(s), all items further listed in that manner would be considered with one (1) vote, as business item "IX. CONSENT AGENDA." MAYOR'S REPORT MAYOR'S REPORT Mayor Wilks presented the Resolution for the 2009 Holiday Season. 2009 HOLIDAY SEASON Trustee Matuszak, seconded by Trustee Korn, moved to approve Resolution No. 42-09: RES 42-09 A RESOLUTION FOR THE HOLIDAY SEASON Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Po lit Nays: None Motion carried. Mayor Wilks presented the following proclamations: TEDDY BEAR WALK "Teddy Bear Walk Week," November 29 - December 6,2009. WEEK Mount Prospect Library Board Trustee Ms. Sylvia Haas accepted the proclamation. Ms Haas shared highlights of the popular holiday event now in its 29th year, and extended an open invitation to the community to participate in the December 5th Teddy Bear Walk. Sergeant Mike Eterno accepted the proclamation and thanked the Village Board for their support in addressing this important and often tragic safety concern. On behalf of the Police Department Sergeant Eterno wished the community a happy and safe holiday and reminder of, "Don't Drink and Drive." "Mount Prospect Sunrise Rotary Day," December 2, 2009 Mr. Richard Bragaw, Sunrise Rotary, accepted the proclamation and thanked the Village Board for recognizing this important holiday fundraising event. In addition to the breakfast and entertainment, Mr. Bragaw stated Mount Prospect Historical Society member, Ms. Rachel Toeppen will be awarded the annual John McNamara, "Service over Self" award at the event. APPOINTMENTS None. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD The following residents presented their concerns regarding the stop sign at Columbine and Tano. [The stop sign was installed at this location as part of the Village's comprehensive residential traffic program.] Ms Cindy Niersbach 1331 Columbine Drive Mr. Jack Cavalenes 1334 Columbine Drive Mr. John LaTona 1329 Columbine Drive Ms. Niersbach stated that in addition to the safety concerns she presented to the Village Board four (4) months ago the stop sign has also contributed to an increase in traffic noise and the collection of debris thrown by motorists stopping in front of her home. Mr. Cavalenes and Mr. LaTona stated the stop sign has created a number of safety concerns. Do not believe the stop signs are having the effect the Village Board wanted to achieve with the residential traffic program; significant number of motorists either fail to stop or roll through stop sign. Trustee Hoefert stated a six (6) month post-study by the consultant and engineering staff will be conducted in approximately two (2) months. The logic and impact of placement of the stop sign at this particular location will be part of the residential zone post-study. CONSENT AGENDA Trustee Hoefert, seconded by Trustee Polit, moved to approve the following business items: 1. Bills dated November 12 - November 25, 2009 2. A RESOLUTION FOR THE DESIGNATION OF PERSONS TO RECEIVE TRAINING ON COMPLIANCE WITH OPEN MEETINGS ACT AND THE DESIGNATION OF FREEDOM OF INFORMATION OFFICERS. 3. A RESOLUTION AUTHORIZING THE PAYMENT TO THE MOUNT PROSPECT PUBLIC LIBRARY UNDER THE TERMS OF A GROUND LEASE AGREEMENT 4. Request Village Board approval to accept bid for the purchase of anti-icing (beet- juice product), pre-wetting fluid for salt contract in an amount not to exceed $24,025. Minutes of the Regular Meeting of the Mayor and Board of Trustees of the Village of Mount Prospect Page 2 of 7 December 1, 2009 NEW BUSINESS NEW BUSINESS Mayor Wilks opened the public hearing to approve a proposed property tax levy for the fiscal year January 1 - December 31, 2009 at 7:35 pm. Notice of the public hearing was published in The Daily Herald on November 23, 2009. PUBLIC HEARING 2009 PROPERTY TAX LEVY Finance Director David Erb provided a summary of the proposed 2009 tax levy which included staff's recommendation of a net Village tax levy of $15,194,638; a 4.99% increase over the 2008 tax levy. (Mr. Erb stated the tax level was originally estimated at 5% but had been revised to reflect the actual debt service totals resulting from the sale of the Series 2009B and 2009C bonds conducted earlier in the day; additional details regarding the sale of the bonds will be presented under Item F. Ordinance Providing for the Issuance of General Obligation Bonds.) The Mount Prospect Library Board approved their tax levy request of $9,060,075, a 3.82% increase over the 2008 levy. Mr. Erb stated there are three (3) ordinances related to the 2009 Tax levy. (1) The levy and collection of taxes for the corporate and municipal purposes of the Village of Mount Prospect including the Library for the fiscal year beginning January 1, 2009 and ending December 31, 2009. The Village's 2009 tax rate is expected to increase to $0.776 from the 2008 rate of $0.732; the Library's 2009 estimated tax rate is estimated at $0.458 compared to the 2008 rate of $0.441. To illustrate the tax rate, Mr. Erb stated a resident with a home with an EAV of $101,000 (market value of approximately $350,000) in 2009 will pay $730 in taxes to the Village of Mount Prospect and $435 to the Library; a $36 increase in the Village levy and a $16 increase in the Library levy from the levy extended in 2008. (2) Village's Special Service Area NO.5 which helps fund the delivery of Lake Michigan water to the Village's water system. Staff recommend the 2009 tax levy remain the same as the 2008 levy ($1,545,773) estimated tax rate is $0.956. (3) Abate part of the taxes levied for corporate and municipal purposes for corporate municipal purposes of the Village of Mount Prospect for fiscal year 2009. Mr. Erb stated the abatement ordinance reduces a portion of the Series 2009C service tax levy established by its ordinance for the purpose of funding a portion of the costs of constructing a replacement fire station, emergency operations center and public works expansion. Based on the bonds sale conducted earlier today, the abated amount of $44,501.15 leaves a balance of $82,645.04 as the amount levied for such bond and interest payments for fiscal year 2009. Mayor Wilks opened the Public Hearing for questions/discussion; there being none the hearing was adjourned at 7:54 p.m. The following ordinances were presented for first readings: AN ORDINANCE AUTHORIZING THE LEVY AND COLLECTION OF TAXES FOR THE CORPORATE AND MUNICIPAL PURPOSES OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS FOR THE FISCAL YEAR BEGINNING JANUARY 1,2009 AND ENDING DECEMBER 31,2009. AN ORDINANCE AUTHORIZING THE LEVY AND COLLECTION OF TAXES FOR THE MUNICIPAL PURPOSES OF SPECIAL SERVICE AREA NUMBER FIVE OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS FOR THE FISCAL YEAR BEGINNING JANUARY 1,2009 AND ENDING DECEMBER 31,2009. Minutes of the Regular Meeting of the Mayor and Board of Trustees of the Village of Mount Prospect Page 3 of 7 December 1, 2009 ANNUAL BUDGET FOR FISCAL YEAR 2010 ISSUANCE OF GENERAL OBLIGATION BONDS AN ORDINANCE TO ABATE A PART OF THE TAXES LEVIED FOR CORPORATE AND MUNICIPAL PURPOSES OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS FOR THE FISCAL YEAR BEGINNING JANUARY 1,2009 AND ENDING DECEMBER 31,2009. Mayor Wilks presented for a first (1st) reading an ordinance to adopt the Village's 2010 annual budget. A Public Hearing for the 2010 Budget will be held at the December 15, 2009 Village Board meeting. 1st reading of AN ORDINANCE ADOPTING AN ANNUAL BUDGET FOR THE VILLAGE OF MOUNT PROSPECT, ILLINOIS FOR FISCAL YEAR COMMENCING JANUARY 1,2010 AND ENDING DECEMBER 31, 2010 IN LIEU OF PASSAGE OF AN APPROPRIATION ORDINANCE. Mr. Erb presented details of the Village's proposed budget for fiscal year 2010; proposed budget including the Library totals $95,113,751 - a 12.3% decrease from the 2009 budget. Projected revenues for the Village in 2010 are $98,854131; a 9.2% decrease. He stated the proposed budget included an Operating Budget of $59,478,738; a 0.6% increase and $85,398,062 in total expenditures; a 13.8% decrease. In addition to the tax levy the only other recommended increase in fees or taxes is for Village water rates. VillaQe Board Comments · 2010 Proposed Budget - result of extensive discussion at several Committee of the Whole meetings; Finance Commission and staff input. · A lot of work done in preparation of the proposed budget; over the course of 2010 staff to continue to re-engineer delivery of services/programs for efficiency and effectiveness. Mayor Wilks stated the ordinance would stand for a (2nd) second reading at the December 15, 2009 Village Board meeting. Mayor Wilks presented for a first (1st) reading an ordinance providing for the issuance of general obligation bonds for the purpose of refunding certain outstanding bonds of the Village of Mount Prospect and paying for certain capital projects, namely the construction of a fire station, expansion of the public works facility and relocation of the emergency operations center. [Mayor Wilks stated the ordinance under consideration had been revised to reflect the rates from today's bonds sale.] Mr. Erb presented background information stating the ordinance authorizing the issuance of $6,240,000 of general obligation bonds for the purpose of refunding the Series 2001 Bonds and to fund a portion of the costs of the Phase 1 Project. He stated the interest rates, principal and interest repayment schedules and tax level schedule reflected in the ordinance were based on the outcome of the sale of the Series 2009B and 2009C bonds. He stated the sale of the bonds were very successful, and as a result the Village was able to reduce the 2009 property tax level by $282,000 and the 2010 property tax level by $46,000. The proposed 2009 tax levy will be reduced to 4.99% from 5%. Mr. Robert Lewis, PMA Securities, the Village's financial consultant, provided an overview and summary of the bond transactions. · Series 2009B Bonds - proceeds to refund Series 2001 bonds 10% savings to the Village (much higher than industry norms) Village's AA+ rating assigned by Standard & Poor significant to favorable interest and sale of bonds to investors. Mr. Lewis addressed the importance of the Village's AA+ rating and the significant savings to the Village as a direct result of the high rating. Series 2009C Bonds - proceeds to reimburse Village for Capital Improvements Projects (Phase 1 project) Issued as Build America Bonds (American Recovery and Reinvestment Act of 2009); Village can use the 35% interest subsidy from the Federal Government for debt service payment. Value of savings by issuing bonds as taxable Build America Bonds over tax exempt bonds is $123,000. Final debt service for the new money borrowed is $1,231,431 less than anticipated Mayor Wilks stated she was exceptionally pleased with the Village's AA+ rating; a credit to the Village's financial management. In response to Trustee Juracek's request for clarification regarding the use of reserves, Mr. Erb indicated the Village was not using reserves from the operations side. Mr. Lewis provided the following information in response to questions regarding the Village's financial management and rating. · The Village exceeds in many areas especially by making adjustments throughout the year to ensure the budget is balanced at years end; a practice not followed by all municipalities. · AA+ rating - financial benefit (savings) to the community Trustee Hoefert, seconded by Trustee Po lit, moved to waive the rule requiring two (2) readings of an ordinance: Upon roll call: Ayes: Nays: Hoefert, Juracek, Korn, Matuszak, Polit, None Motion carried. Trustee Korn, seconded by Trustee Juracek, moved for approval of Ordinance No 5772: ORD 5772 AN ORDINANCE PROVIDING FOR THE ISSUANCE OF GENERAL OBLIGATION BONDS FOR THE PURPOSE OF REFUNDING CERTAIN OUTSTANDING BONDS OF THE VILLAGE OF MOUNT PROSPECT AND PAYING FOR CERTAIN CAPITAL PROJECTS, NAMELY THE CONSTRUCTION OF A FIRE STATION, EXPANSION OF THE PUBLIC WORKS FACILITY AND RELOCATION OF THE EMERGENCY OPERATIONS CENTER. Upon roll call: Ayes: Nays: Hoefert, Juracek, Korn, Matuszak, Pol it, None Motion carried. PUBLIC HEARING BUSINESS IMPROVEMENT DISTRICT Mayor Wilks opened the public hearing for the establishment of a Business District (BD) at Randhurst Mall at 8:22 p.m. Notice of the public hearing was published in The Daily Herald on November 21, 2009. RANDHURST MALL Community Development Director Bill Cooney stated tonight is the first (1) of two (2) public hearings to establish a Business Improvement District for Randhurst. Mr. Cooney presented an overview of the Randhurst Village project which is expected to open in April 2011; 1) $150 million project - currently costs estimated to be closer to $2 million; 2) $25 million public participation, all funds generated by project (no financial risk to Village); 3) current sales tax base ($365 million) is protected; 4) estimated $1 million of new sales tax annually to Village and 5) $25 million revenue bonds supported by five sources. Minutes of the Regular Meeting of the Mayor and Board of Trustees of the Village of Mount Prospect Page 5 of 7 December 1, 2009 Mr. Cooney stated the BD enables the Village to initiate a sales tax that is specific to Randhurst Village property. He provided a summary of the proposed public financial participation; Village to provide $25 million towards the project with funds generated by the redevelopment; a financial commitment that presents no financial risk to the Village. The funds to be pledged in non-recourse revenue bonds backed by five proposed revenue sources. · Quarter percent Business District Retailer's Occupation Tax (new tax Randhurst only) · Incremental Local Distributive share of the sales taxes over $236.5 million Hotel Tax (increase current rate Village-wide from 3% to 6%) · 25 cent Amusement Tax on the sale of movie tickets (new Village-wide tax) · Food and Beverage Tax Mr. Cooney stated that it was important to note that the proposed $25 million in revenues would only be paid if these resources generate this amount. Mr. Cooney stated Mr. Laube, Laube Consulting Group and Mr. Jim Conroy, Casto Lifestyle Properties were also in attendance to respond to questions. Village Manager Janonis stated the ordinances listed under the public hearing would be held for first (1st) readings at the December 15th Village Board meeting; the second (2nd) public hearing is scheduled for December 8th As there were questions regarding the proposed ordinances the Village Board discussed and requested clarification/revisions of certain sections of the ordinances from staff. · Ordinance Designating Business District Section One (I.) Recommend ordinance be revised to insert "throughout Village of Mount Prospect" to be consistent with J. · Ordinance Establishing BD Municipal Retailers' Occupation Tax Section 8.2402 B. Tangible Personal Property in Connection with the Sale of Service Request clarification of what is taxed (tangible property - value of service) Mr. Jim Conroy provided a construction update on the project. Construction is going very well; except for new theater all Main Street building pads are 100% complete. Anticipate getting permits and going for bids in January and break ground in spring 2010. Theater construction to begin in March or April of 2010. Mr. Cooney responded to questions and provided further clarification of the $25 million public participation for the project and application of the various taxes. He reiterated that under no circumstances was there a financial risk to the Village. In response to additional questions from the Village Board, staff provided the following; No change in taxes on food and drugs · Business District expires in 23 years Except for Costco BD taxes apply to other businesses on property · Effective date of taxes - upon passage except for Movie Theater Tax, May 1, 2011 per the Redevelopment Agreement. [Agreement with AMC not to impose tax until new theater is open.] · After $25 million generated for Randhurst Village project - taxes will go to Village's General Fund Trustee Juracek noted that the proposed Movie Theatre Tax ordinance does not reflect effective date of May 1, 2011; requested revision to reflect May 1, 2011 effective date. Mayor Wilks closed the public hearing at 859 p.m. The 2nd public hearing to establish the Business District at Randhurst Mall will be Tuesday, December 8, 2009. Community Events · Teddy Bear Walk - December 5th 10:a.m. to noon · Winter Walk - Prospect Avenue - December 5th 5:00 - 7:00 p.m. Trustee Hoefert stated the Mount Prospect Historical Society was holding its annual House Walk, Friday, December 4th; 3:30 - 9 p.m. OTHER BUSINESS OTHER BUSINESS None. CLOSED SESSION CLOSED SESSION Mayor Wilks asked for a motion to enter into Closed Session to discuss Personnel 5 ILCS 120/2 (c) (1); The appointment, employment, compensation, discipline, performance or dismissal of specific employees of the public body, including hearing testimony on a complaint lodged against an employee to determine its validity and Personnel 5 ILCS 120/2 (c) (2); Collective negotiating matters between the public body and its employees or their representatives, or deliberations concerning salary schedules for one or more classes or employees. Trustee Hoefert seconded by Trustee Korn, moved to meet in Closed Session to discuss Personnel 5 ILCS 120/2 (c) (1) and Personnel 5 ILCS 120/2 (c) (2). The Village Board entered Closed Session at 9:05 p.m. ADJOURN ADJOURN The Village reconvened in Open Session at 10:15 p. m, had a brief discussion about Committee of the Whole meeting topics and possible dates for those discussions.
