Request of South Church for refund of Plsm Commission deposit fee of $125. In-requst reCond

the parking lot, as far as advertising and transcript.

~Fire Li~it Trustee Teichert read a proposed fire limit ordinance for first reading.
Ordinance He gave a report from the Building Committee on suggested reVisions to
~ this ordinance which were reviewed by the Board at this time. Trustee
Teichert requested the Clerk place the fire limit ordinance on the
December 5th agenda for second and final reading.

Trustee Kilroy read the report of the Fire & Police CGi~ttee regarding
Nelson sign a proposed sign on Village property at Route 83 and Golf Road. A meeting
at Golf & 83 has been arranged with Nelson Realty and the Trustees on November 25, 1967
at 9:00 A.M. regarding the size and exact location of the contemplated
si~as. It was requested that this matter be placed on the December 5th

Trustee Lewis, seconded by ~rustee Cotfer, moved for passage and approval
of Ordinance #2036.
Trustee Grittani expressed idsapproval of passage of the above ordinance
because in his opinion the Board can only allow variations where definite
hardship of definite need is sho~n and in this pai~ticular case neither is
present. He questioned the availability of washroom facilities in the
proposed drop-off and pick-up laundry installation and was advised the
station master holds the keys because of vandalism. Tcustee Rogers
stated the petitioner, Alvin Spielman, started work on making this location
suitable for his purpose before obtaining a building permit. At th$35 time
it was referred to the Board of Appeals, which body did not recc~mend
granting a special use because in their opinion this use would cause
traffic congestion. Trustee Teichert concurred and stated this would
constitute spot zoning and there is no pressing need for business in the
railroad right-of-way.

Novsk & (Case 66-22P) recommended rezoning from R-1 to P-1 contingent upon the

At the Judiciary Committee meeting of November 10, 1967 the Comnittee Case 66,22P
expressed a stror~ desire to have the alley from Albert to Mount Prospect Novak &
Road i~roved andv surfaced in accordance with the ordinances pertaining Parker
to improved alleys."
"They also expressed that this could be accomplished by the mutual coop-
eration of all the property owners abutting Northwest Highway between
Albert and Mount Prospect Road so as not to cause a financial burden on
the abutting residences to the subject alley."
"At that time I stated that I wotuld be willing to undertake the financial
obligation of improving the alley its entire width for that portion abutting
my property, providing it is within the estimated cost of $850.00 for my
share."
"This letter is to confirm to you my intentions to participate in this
improvement; however, I would hope that I would not be asked to participate
in this progrsm until such time as I received a favorable determination
on my request for rezoning lot 65 from its present R-1 classification to
the P-1 zoning classification which I seek."

Trustee Lewis moved to concur with the Plan Commission and grant the rezoning
from R-1 to P-1 contingent upon the stipulations in the above letter.
Trustee Rogers seconded the motion. Unanimous.

The Judiciary Committee reported on Case 67-18A - Request of Dr. Dwain Marquette
Marquette, for variation at ll04 N. Elmhurst, Wedgewood Terrace, to have variation in
dental office in EX zoning. Judiciary Comnittee recta,ends concurrence t~X for Dr.
with the Board of Appeals recmunendation for denial. Trustee Lewis, seconded office
by Trustee Roge4s,.moved to deny the petition in concurrence with the Board
of Appeals and Judiciary Committee.

SHELL OIL CO. Petition to rezone 709 N. Main St. from EX to B-3. Plan Shell Oil
Commission and Judiciary Co~rmLttee recommend rezoning. Trustee Lewis, 67-17P
seconded by Trustee Colfer, moved to concur with the Plan ConEission and rezone 79~ N.

Trustee Lewis gave first reading of an ordinance rezoning 709' N. Main from
EX to B-3 and requested the Clerk to place it on the agenda for second
reading op December 5th.
PUBLIC HEALTH AND SA~'I'% Health
Trustee Grittarnt read the report of the Public Health and Safety Committee Inspections
meeting November 15th. This was a joint session with the Board of Health.
One of the items discussed was the health inspections presently being made
by the Sanitarian and the Health Inspector. Although, in their opinion,
some areas are receiving proper coverage and the necessary follow-up to
obtain effective results, other areas are not because of limited time of
the inspectors. To alleviate this situation, Mr. Densil Brown, the Village
Bacteriologist, offered a proposal whereby he cotald provide the village
with complete coverage and keep the cost within the allotted funds. This
would not. only ir~prove the service but it would also relieve Lt. Hedlund
to pursue his police duties an additional l0 hours a week. Since Mr. Brown's
fee would be held within the funds allotted he was asked to negotiate with
the Village Manager~%~ This can be handled administratively and does not
require any action on the part of the Board.
AIR POLLUTION Air Pollutio~
The subject of Air Pollution was discussed at great length and it was agreed
that corrective measures should be taken in at least these areas that are
Air within the corporate control of the Village of Mount Prospect.

For the past two years the Village has been collecting leaves on a weekly
basis and they should be cc~mended for the excellent work they have done.
This Fa-1 the burning of leaves was held to an absolute minimum and the
smoke problem has been reduced considerably.
It is a proven fact that the Village can do an efficient Job of collecting
Leaf leaves even though handicapped by not having the proper equipment. There-
Pick Up fore, the necessary funds should be provided in the 1968-69 budget to pur-
Equip. chase a leaf vacuum. This will expidite the operation considerably. The
availability of such equipment, coupled with the fact that we now have
unlimited garbage pickup eliminated the necessity for all types of outdoor
burning of garbage, rubbish, leaves, paper, etc. The Public Health and
Safety ConEittee recommends by a vote of 2-0 that the Village immediately
adopt an anti-burning ord~ce. Trustee Grittani, seconded by Trustee
Kilroy, moved the Board concur with the recmwnendations of the Public
Health and Safety Conmittee and the Village Manager be instructed to draw
up a draft anti-burning ordinance. Unanimous.
Trustee Colfer wished it noted that this does not imply approval Of the
provision in the 1968-1969 budget for the purchase of a leaf vacuum.
The Board expressed a need for a report from the Director of Public Works
on leaf pickup equipment.
SPECIAL ASSESSMENT #69
Trustee Lewis read for first reading an ordinance creating Special Assessment
SA #69 #69 for water mains servicing Elm Street between Golf and Lonnquist, Sunset
between Elm and School and the west side of School Street from Golf to
Lonnquist, The estimated amount of the assessment is $33,389.50. Trustee
Lewis requested the Clerk place this matter on the December 5th agenda for
second reading and that those residents who wo~_ld be affected by its passage
be notified of the proposed second reading.

i School 1/2 The ~Ingineering Department reports construction of the above hal~ streets
i streets has been cmWPleted. The Public Works Director and the Acting Village
!bill Engineer concur in acceptance of the project. To clarify the contract
price awarded of $11,576.00 and to justify the billing of $13,581.65, the
following items are listed:

Because of colder weather at time of construction the use of Pozzolanic base
course was not feasible. It was necessary to change design for betterment of
contract. Six to seven inches of Bitum AsDhalt Mixture was used at an additional
cost of $1,312.65. The Village Engineer recm~ends that Milburn Brothers
be paid $13,581.65 for labor and material used. The Village Manager concurs
in the recommendation. Trustee Colfer, seconded by Trustee Lewis, moved to
concur in the above recommendation to pay Milburn Brothers $13,581.65 for
labor and material used.

iLegal No~icesTrustee Teichert read a resolution r~garding publication of legal notices.
By Resolution 38-63 a previous Board established a policy that expenditures
of public ftmds for legal notices and publications should be spread
equally between the local qualified newspapers. On May 18, 1965 REsolution
38-63 was~ repealed, and a new policy was established to place all legal
notices in the Mt. Prospect Herald, because of greater circulation. The
Prospect Day became a qualified publication about June of 1967. On the
basis of a report from the Village Manager, Trustee Teichert stated it would
appear that the Day would give the widest coverage to Mount Prospect citizens
and is the most economical, and most conveniently located, can give the
promptest service and has an established place of business in Mount Prospect.
Trustee Teichert then read the following resolution: t~gal

WHEBEAS, It is desirshle that legal notices and publications for the Village
of Mount Prospect be disseminated to the largest number of our citizens; and
WHEREAS, The Prospect Day has the largest circulation among our citizens
of the qualified local newspapers; and
WHEREAS, it is desirable that legal notices and p~blications for the Village
of Mount Prospect be placed &t the least expense to our citizens; and
WHEREAS, the Prospect Day is the least expensive, comparitively, of the
qualified local newspapers; and
WHEREAS, convenience and promptness of service are desirable features in
the placing of letal notices and publications for the Village of Mount
Prospect ~nd;
WHEREAS, the Prospect Day has offices closest to our Village Hall of the
qualified local newspapers, and the Prospect Day is published most frequently
of the qualified local newspapers; and
WHEP~EAS, it is desirable when expending public funds of Mount Prospect to
give prefere~ence when possible to Mount Prospect businessmen; and
WHEREAS, hhe Prospect Day has offices in Mount Prospect;
NOW, THEREFORE, BE IT RESOLVED by the Village Board of Mount Prospect, Cook
County, Illinois:
Section 1. That all legal notices and publications for the Village of
Mount Prospect shall be placed in the Prospect Day.
Section 2. That all ordinances, resolutions, and orders in conflict with
this resolution are hereby repealed.

and after its passage and approval according to law.
