CALL TO ORDER
President Teichert called the meeting to order at 8:10 P. M.Call to order

Trustee Ahem road a letter addressed tn the Board rogarding
sldency of an elect~ official. He has resided at 103 N. Yates Trustee Ahem
Lane since December 3, 1964, but the area was not annexed to the is a de facto
Village until July, 1968. According to State Statutes, this official
could be interpreted as not havein~ estabilished residency in the
Village for one year before election (April 15, 1969.) The Village
Attorney prepared sn opinion "Whether a person ineligible to hold
m~aicipal office at the time of his election - but who is sub-
sequently seated - can validly and leg-ally re~ain in that office"
and concluded the office of Tr,~_stee is not vacant; the Trustee in
office is a de facto official; and his acts as such are valid and
binding and will continue to be so until such time as his office
becomes vacant.

$1,500 advancers. Jack Costello of the Youth Con~zission appeared before the

moved the Villa~e make available to the Youth Compression $1,500
for the dance to be held December 27, 1969 and that they be allowed
to expend any amount of $1,500 at their Jurisdiction, subject to
any rules and re~l~lations, and subject to reimbursement to the
Village. ~o

Roger Fink - request for variation - Pro~l~ect Ave. (Case 69-3A) Roger Fink
Mr. John Waters, appeared before the Board. He is a b~ilder, Case 69-3A
and owns the vacant lot. Mr. Roger Fink petitioned the Board
of Appeals for a variation to per~it the construction of a
2-story 2-flat building on a 25 foot lot. The Board of Appeals
recormnended denial. Trustee Furst, seconded by Trustee Soderrmmn,
moved to concur with the Board of Appeals and deny the variation
requested in Case 69-3A, 215 W. Prospect Avenue.

Trustee Kilroy read for first realdng an ordinance repealing
Chapt. 7A of the M~nicipal Code of MoUnt Prospect re Finance Dept.
and requested the Clerk to place it on the agenckof the next
regular meeting.
Trustee Kilroy read for first reading an ordinance creating
Articles XIII and XIV of Chapter Five of the Municipal Code,
creating an Industrial Development and Economic C~r~dasion and
an Insurauce Cu~.~,~Lssion. The Clerk was requested to. palce it
on the ag~enda of the next regu~lar meeting.
Trustee Kilroy read for first reading an ordinance amending
S~cs. 13.101, 13.102, 13.10B, 13.106, 13.107, and 13.114 of the
Municipal Cede (re alcholic beverages) and requested the Clerk
to place it on the agenda for the next regular meeting,

Trustee Furst, seconded by Trustee Reiter, moved that the Board
of Trustees concur with the reconmendatibn of the Public Health
and Safety CoL,m~ttee to put in the extension of Sunset road from
Louis to William at an a~proximate cost of $18,000 - $20.000.

FIRE AND POLICE COMMISSION
It was reDorted the Commission does not have the same dates for
membership and shQuld coincide with other commissions and boards.
Consideration will be given to effective dates of appointments.

Recapture Ordinance - Kaplan & Braun - at the request of Mr. Richard
Braun this matter was deferred to the first meeting in November.
