Trustee Kilroy, seconded by Trustee Reiter, moved for approval of the Financial Report for the month of May, 1969 subject to audit. Upon roll call: Ayes: Ahem Furst Kilroy Le~is Reiter Soderman Motion carried, CITIZHNS TO BE HEARD Temporary Dr. H. L. Vanoueek, 407 W. Prospect, appeared before the Board to request occupancy a temporary occupaucy permit for his building at 601 W. Central. permit Accompanying Dr. Vanoucek were two of his tenants, Dr. ~%~riarme B. Budzeika, Dr. H.L. a pediatrician, and Dr. Ronald Duckers, PHD who described their specific Vanoucek needs for their offices and the urgency to occupy the premises. The building is approximately 80% leased, and those offices are complete. However, because of the unique requirements for the various professions~ those offices not leased remain in an unfinished conditien. Trustee Furst, seconded by Trustee Lewis, moved to grant a temporary occupancy cer- tificate for the next six months, during which time the Village wo~ld have the right to make periodic inspections. Upon motion, considerable discussion followed, and Trustee ~urst, seconded by Trustee Lewis, moved to amend the motion to add that to preclude the right to make periodic inspections, a $1,000 bond be posted, and after six months, if construction is not, in fact, completed, the per- mit will lapse and the petitioner will have to reapply for a permit. Roll call vote upon amendment to motion: Ayes: Ahem Furst Kilroy Lewis Soderman Nays: Reiter Motion carried. Upon roll call on metion as amended: Ayes: Ahem Furst Kilroy Lewis Soderman Nays: Reiter Motion carried. Trustee Reiter wished it noted that this nay vote was predicated on the safety factor. Trustee Reiter requested the Building Committee be charged with standard- ization of occupancy per.~.~ts. Approved. Case 67-55A BOARD OF APPEALS CASE 67-55A Mr. William Wille, 100 W. Northwest Highway, requested review of the petition for a radio tower on his property. A permit had been issued by the Federal Corm~nications Commissien. Inasmuch as this ~ a matter of litigation with the Village it was deemed advisable to meet in Executive Session. President Teichert called for a meeting of the Committee-of-the- Whole on June 24, 1969 at 7:30 P. M. t¢ consider a ~atter of litigation. COMM±'±'L'EE CHAIRMEN REPORTS A. BUILDINf'~ PROPOSED FENCE ORDINANCE proposed The Village Attorney and Building Director prepared a proposed revision rev. of of the fence ordinance to incorporate the existing regulations for fences fence ordin- around swim~tr~ pools into Article VII of the Bui~tding Code so that ance persons inquiring as to fences around swimming pools wouid be able to find the requirements within that Article. Upon discussion of the pro- posed ordinance presented by the administration the Committee made certain changes with respect to the heights of fences around swimming pools, it being understood that the 4'6" heig~nt was a minimum~ and that in view of the 6' maximum in residentail su~eas, the maximt~ should be inserted inthe existing ordir~mce regarding fences around swimming pools. Trustee Soderman, seconded by Trustee Relter, moved to c~nct~r with the recommendation of the Building Cora~ttee rekindling an amendment to the June 17, 1969 fence ordinance to incorporate requirements of fencing around swimming pools. CASE 69-15A - GOLDBLATT'E Petitioner requested variatian for ~0 foot aisles in the free- standing Goldblatt Home Center. The Ccmmdttee, by a vote of B-0 recommen- reconmended cencurrence with the Board of Appeals to permit a width of 20 feet for the three mafu aisles leading ~to the center Case 69-15 A of the sales ~ea and mezzanine which are to be kept clear at all · Goldblatt's times of any kind of merchandise, displays, or other mechanized or stationary objects. However, the developers will require fur- ther variations and the attorney was instructed not to draft an ordinance amending Ordinauce 2102 until such time as it is finally determined what other vartatians will be granted, if any, and the Board has acted upon same. Trustee Sederman, seconded by Trustee Reiter, moved to c~cur with the recomendation of the Building Committee snd approve the petition for the 20' three main aisles as stipulated. CASE 69-17A FOTOMAT DRIVE-IN PHOTO DEVELOPMENT STOEE IN PARKING LOTCase 69-17A This petition for variation was deferred for further discussion with the Village Attorney. ~I~ was requested this be held in the Building Cormmittee until July 9th. Approved, CASE 69-1BA N~.~UEN BROS. FROR'~ YARD VARIATION ?04 W. CENTMAL RD, Case 69-1BA Petitioners request variatio~ for 15' wide, 1-story addition to the west side of the existing one-story building.' The building is currently nonconforming with respect to front yard setbacks. The Committee recommended by a vote of B~0 that the~P~esident and Board of Trustees concur with the recormnendation of the Board of Appeals to grant the request and the administration was instructed to draft an ordinance for first reading. Trustee Soderman, seconded by Trustee Kilroy, moved to concur with the Board of Appeals and graut the variation for front-yard setback and reed an ordinance for a first reading. An ordinance granting a front yard variation for Milburn Brot~ars on Ordinance Cantral Road was read for first reading and the Clerk was requested to granting place it on the July 1st agenda for final reading, front yard variation to The administratian prepared au ordinance for first reading to in- Milburn Bros. corporate changes to the p~lumbtng code, which changes will eliminate therefor and make illegal the use of slip seal Joint pip~ con- nections for sanitary sewer lines. The administration advised the Committee that compositions utilized in slip seal Joint connections deteriorated rapidly and that.during storms, storm water infiltrates the sewer line. For this reason, slip seal joints have been declared illegal by the Metropolitan Sanitary District. By a vote of B-0, the Cormnittee recommends concurrence with the recommendation of the Village Attorney. Trustee Soderms~, seconded by Trustee Kilroy, moved the Board concur with the recormnendation of the Building Con~nittee and the Village Attorney regarding slip seal Joints. Sune 17, 1969 The ordinance regarding an amendment to the Plumbing Code prohibiting slip seal joints was read for first reading and the Clerk was requested to place it on the July 1st agenda for final reading. FIRE AND POLICE COM~'l'l%E REPORT Trustee Furst read the Safety Cormaission recormnendation regarding the BRIDGES OVER need for bridges over Weller Creek snd Trustee Reita~, seconded by Trustee Soderman, moved to concur with the Safety Co~?dssion and pro- WEI.~,ER ceed with plans and construction of George Street and See Gwun Avenue CREEK bridges. Many persons were in attendance and requested an opportunity to be heard at this time. A letter from Mrs. W. H. McCulloh, 705 See6wun Ave. was read, voicing objection and requesting postponement of final decision until all facets have been explored. M~. Freak Auwarter, 506 S. Emerson expressed the opinion that there is a need for new bridges over Weller Creek. Nicholas Jo Veternick expressed the need for construction of the bridges as soon as possible and opposed the sJ~hool district access to Sunset. Attorney Julius M~rcianik, representing citiznes residing in the area, voiced objections to the construction of the bridges because of increased traffic and safety hazards. Trustee Kilroy reported the recommendation of the Fire Chief because of inadequate access to certain areas south of the Creek. ?Mr. Richard Ranseen, 714 S. SeeGwun, opposed the proposed bridge construction. Mr. A1 Moser representing approximately 20 people from the Golfhurst Association voiced approval of the bridges because of a need from a safety standpoint. ~Mr. John Parsons, 508 S. George stated he was in- terested from a social, economic and safety position and requested study by an independent group. Mr. Gordon Nettle, residing on Emerson St. stated the initial acticn was the construction of the vehicular bridge on Emerson Street which has proven the need. Mr. Stan Peterson, 615 S. SeeGwun, suggested the possibility of placing the bridges in other locations. Trustee Reiter stated there is a ti~etable for bridges over Weller Creek at William, Candota, and School Streets as well. Mr. Pat Gubbe, residi~gf~ at Sunset and Emerson, was opposed to the extension of Sunset. Mrs. Kate Anderson, 204 W. S~et, was in favor of the bridges. After further discussion, Trustee Lewis, seconded by Trustee Reiter, moved to call the question. Upon roll call: Ayes: Ahem Furst Kilroy Lewis Reiter Soderman Motion carried. Upon motion to proceed with the plans and construction of the George Street and See Gwun Avenue bridges the roll call vote was as follows: Ayes: ~hern Furst Kilroy LeWis Reiter Sederman Motion carried. Bridges at William, Candota and School Streets were ~eferred to the Fire and Police Committee. Trustee Reiter, seconded by Trustee Soderman, moved to request the administration to seek engineering proposals for eonstruction of the bridges, containing plans for them, Upon roll call: Ayes: Ahem F~rst Kilroy Lewis Reiter Soderman Motion carried. HB 435 President Teichert and John Zi~neNmmnn, Acting Village Manager, were attending a meeting in Springfield regarding HB 435 which would reduce the amount of local government sharing in MFr. The meeting is to be held June t9th. Because of the lateness of the evening, it was decided to have the Co~nittee-of-the-Whole meeting at 7:00 P. M. on June 24th instead of 7:30 P. M. as previously stated, and to call a Special Board Meeting for 8:30 P. M. in order to complete the agenda of JunelT, 1969, U~anir~o~s ~ June 17, 1969 rustee Kilroy moved to waive the rules requiring two readings of an ordinance. Trustee Ahem seconded the motion. Ordinance #2164 Trustee Kilroy read~0~dinance 2164: AN ORDINANCE AMENDING SECTION 13.107 OF THE MUNICIPAL CODE OF THE V~.~.AGE OF MOUNT PROSPECT This ordinance reduces the number of Class "B" licenses for retail consuntotion on premises.' Trustee Kilroy, seccnded by Trustee Ahem, moved for passage and approval of Ordinance #2164. Upon roll call: Ayes: Ahem Furst Kilroy Lewis Reiter Soderman Motion carried.
