Hower homeowners, requesting the Board of Trustees to direct the Village authorities petition to appeal the decision of the Circuit Court of Cook County which nullified the for rs- decision of the Board to deny the petition for rezoning of the property lo- zoning cated at 308 West Golf Road, Mount Prospect, Illinois. Ordianace #2138 Upon roll call: Ayes: Melter Grittani Kitroy Lewis Soderman Tetchert Motion Trustee Lewis read a report of Case 68-37P - property at northwest corner of Case Rand Rd. and Rte. 83. The Plan Commission reconmended rezontng from RX to B-4.68-37P Board of Trustees previously approved the rezoning request for that parcel of land on which the MacDonald and Wallen's operations presently exist and reserved their recommendation on the Sinclair gas station parcel until a linen of resubdivision was submitted. The linen has been presented to the Village indicating the proper setback lines and was presented to the Plan Con~niasion for recommendation as to B-4 zoning. The Judiciary Committee concurred to grant B-~ classification and recommended authorization fo r the President and Clerk to sign the linen upon approval by the Plan Commission. Trustee Lewis, seconded by Trustee Kilroy, moved to concur with the Judiciary Committee in their reconm~ndation regarding Case 68-37P. Trustee Lewis read an ordinance amending Map 23N of the Zoning Ordinance to Ordinance reclassify the property at the northwest corner of Rand Rd. and Rte. 83 from Amending RX ~o B-4. The Clerk was requested to place it on the next agenda for final Map 23N reading, of zoning ordinance Case 68-47P - Bartmann plat of resubdivision - 5 lots on parcel of land Case inloroved by miniature golf course extended from Rand Rd. to Foundry Road 68-47P i--- immediately west of intersection of Rand & Rte. 83. Plan Commission denied Rand & the request. Later~ Mr. Bartmann presented a plat of survey indicating R~e. 83 3 lots~ 2 abutting Foundry and i on the miniature golf course abutting Rand den~ -- Rd. The Plan Conmtission approved same, The Judiciary Committee recommended that the President and Clerk be authorized to sign the linen after the signature of the Plan Commission Chairman and Secretary have been affixed. Case 68-52P - Request of property owner to rezone Haberkamp property lying Case on the north side of Dempster St. west of Rte. 83 between the Standard Oil 68-52P station and Dempster Jr. High School from existing RX zoning classificatic~ to R-4. The Plan Commission, by a vote of 6-0, recommended the rezoning to R-~ re- based on the submitted planned unit development presented. The Judiciary zoning Committee concurred. Trustee Lewis, seconded by Trustee Retter, moved to R-4 concur with the Plan Commission and Judiciary Co,,~.:ttee recorm~endation. Unanimous. Trustee Lewis read for first reading an ordinance amending Map 23N of the Zoning Ordinance to rezone the above property to R-~. The Clerk was requested to place it on the nex~ agenda for final reading. Case 68-~5P - Kenroy request for R-~ zoning for property lying on the south Case side of Dempster St. west of Rte 83, immediately west of the Phillips gas 68-~5P station, and extended west 517, containing 8.9 acres. Denied Loc~ on Case 68-20P - Petition of Hollywood Builders for property located on west side W. side of Busse Rd. iramediately south of Tally Ho. Plan Commission reviewed this matter, of but because of lack of complete presentation by the petitioner several months ago, Busse they moved to deny the petition. The Judiciary Committee concurred. Case 68-48P - Petition by Village to amend uses allowed inB-3 and B-~ districts because retail sales and services establishments were placed in both classifications Plan Commission recJonm~nded amending the ordinance to permit them in B-3 zoning. Trustee Lewis, seconded by Trustee Reiter, moved to concur with the Plan Commission and Judiciary Committee in amending the ordinance. Unanimous. Trustee Lewis read for first reading an ordinance to amend the uses allowed in B-B and B-4 as related above. The Clerk was requested to place it on the next agenda for final reading. Proposed annexation of property north and south of Golf Rd. immediately east of Meier Rd. was considered by the Judiciary Committee, The properties is surrounded on B sides by the Villageoof Mount Prospect and on the 4th by Arlington Heights. It consists of less than 60 acres and is subject for an involuntary annexation. It is the feeling of the administration that the President and Board of Trustees should consider the feasibility of an in~ voluntary annexation. The Judiciary Committee recommended the annexation be accomplished and requested Board concurrence for notice to the Fire District be sent. Trustee Lewis, seconded by Trustee Reiter~ moved for Board concurrence. Upon roll call: Ayes: Reiter Grittani Kilroy Lewis Soderman Teichert Motion carried. Case 68-~1P - Request to rezone the southeast corner of Algonquin and Busse from B-3 to B-~. Petitioner requested the report from the Judiciary Committee be deferred. Case 68-56A- Request by Kellens Countryside Florist at 618 Golf mRd. for variation. This matter was deferred pending a report from the administration regarding dedication of William Street. A petition was~eceived from River Trails School District 26 for arnexation of Feehanville School property and River Trails School on Kensington and Wolf. Trustee Lewis~ seconded by Trustee Reiter moved to concur with the Judiciary Committee to proceed with annexation and forward notices to the Fire District. Unanimous. The Clerk was requested to place this matter on the next agenda. Case 68-67A - Roppolo and Prendergast variation. Request by builder to allow a foundation height in excess of the allowable grade foundation. The Board of Appeals voted to deny the variation. The Judiciary Committee visited the site and Trustee Reiter suggested the builder could face brick the founda- tion low enough so that grade could be struck at the appropriate 18 inches. Mr. Anthony Roppolo, 1505 Blackthorn Dr, Glenview appeared before the Board. The Village Attorney read the procedures for obtaining a building permit and stated the petitioner ~st ask for another variation of four inches. Trustee Lewis, seconded by Trustee Kilroy~ moved the Board remand Case 68-67A back to the Board of Appeals with wslver of fees, to request a side yard variation to comply with the sugges$ion Trustee Reiter made. The unit did go on the streets for the last Private two Sundays in cormpliance with the administration's request. Mr. Harman >Police of the Illinois Suburban Police indicated he would prefer to have this matter referred to Con~nittee in order to be able to state his position, Referred to Fire and Police Committee. The Village Attorney read an ordinance an~nding Ordinance No. 832 regardingOrd. #832 a variation of the front yard set~ack requirement of property used by Illinois amended Range Company on Central Rd. (Case 69-2A). The Clerk was requested to place this on the next agenda for final reading. Case 69-2A -next agenda for reading. Trustee Grittani, seconded by Trustee Teichert,~noved the Village Manager be directed to contact Mr. Perry~ owner of Fairview Gardens Utility System, to make an official offering for purchase of the utility system as agreed upon by the Board Members in Executive Session. Trustee Teichert, seconded by Trustee Grittani, moved to concur with the President's recon~nendation. Unanimous. Trustee Teichert read for first reading an ordinance exercising the option to purchase the waterworks a~x~ water distribution system of the Utility Sewer and Water Corporation and requested the Clerk to place it on the next agenda for final reading. Trustee Kilroy read an ordinance exercising the option to purchase the sanitary Sewage sewage disposal system of the Utility Sewer and Water Coproration for a first Disposs reading and requested the Clerk to place it on the next agenda for final reading. The Village Manager reported that the Village Engineer and Director of Public rec. acc. Works made a final inspection of the sewer and wa~er improvements on Sunset of sewer Heights West (SchavilJle and Knuth) and have determined they have been corn- improve- pleted satisfactorily. A memoraudum addressed to the President an~ Board of Trustees from the Purchase of Village Mauager reported on a bid opening for the purchase of fire hose Bose under the replacement progrmm. The Current budget authoriZes expenditures $2465.00 not to exceed $2500 and a bid received from Michael J. Dalton & Co. bid $2465 for 550 ft. bi-lateral I 1/2" ~ 1.55 ft. and 750ft. bi-lateral hose 2 1/2" ~ ~15 ft. Trustee Teichert, seconded by Trustee Sodermau, moved to authorize the purchase of fire hose from Michael J. Dalton & Co. in the amount of $2465. A Memeorandum to the President and Board of Trustees from the Village Manager stated Tri-State Clearing, Inc. had been authorized to trim parkway trees within the Village. Howe~er, the Manager was notified they were unable to perform under the contract because of lack of manpower. The Public Works Director and the Manager contacted the second low ~Lidder, A. J. Davis & Co. who agreed to enter into a contract for this work at a price higher than originally bid, due to the increased cost of labor, but still lower than the thi,~d bidder, Davey Tree. The administration requested Board authoriza- tion to use A. J. Davis Co. for the trimming of parkway trees based on the unit prices submitted: A. J. Davis Co. for the trimming of parkway trees as outlined above~ and further, to direct the Village Mauage~ to proceed under the terms of the performance bond to recover costs because of failure of tri-State Clearing, Inc. to complete the work.
