PETITIONS AND COM~JNICASTONS MP drainage & Pollution Dr. John Shaeffer and Mr. 51mil Oberg, Sanitary 5hgineer, .appeared before the Board to discuss Mount Prospect's drainage and pollution problems. They reported they had explored the physical environment in their survey to identify which elements would be incorporated in their plan. It is a problem of flood plain management. Studies were made of what has been done in the past and of platted subdivisions and also the retention basiu at Busse and Golf. It ~ould be redeveloped to a multi-purpose January ~1, 1969 structure because it is strategically located and an improved appearance would enhance the area. A channel from Central Road to Lincoln is proposed with a series of weirs into a series of ponds would also be of esthetic as well as engineering value for the overflow at Central. There could be a conjunctive use of surfac~ and ground water because there is a sand gravel base whereby shallow wells could be constructed to pump water for use as reservoirs. Going downstream from the Country Club along the channels a series of lagoons was proposed and it appears there is an opportunity for major water resource in the Village. The report which was submitted by Dr. Shaeffer was referred to the Drainage and Clean Streams Commission for review. Fin. Cor~l. Fin Corn FINANCE COMMI~I'I%E REPORT Report Report The Committee studied comprehensive figures submitted by surrounding villages regarding liquor license fees and recommended the follov~ing: 1) By a vote of 3-0 not to increase the fees for late hours; ~) No additional fee for live entertainment; ~) To increase the fee for Class "M" from $1,500 to $2,000 for room service in motels. Trustee t~iquor license Liquor Kilroy, seconded by Trustee Reiter, moved the Board concur with the fee Class "M" License fee recommendations of the Finance Corm~ttee. Trustee Grittani stated Class "M" he felt the Board shOUld increase all fees and control in the number issued. Trustee Lewis sug~.~ested higher initial fees for new applicants. The Village Attorney was requested to submit a proposed ordinance for chsnge of fees for Class "M" liquor licenses. Ord. 1st reading Ord. 1st readin~~-~ Clerk's Sal. The Finance Committee studied the recon~aendation of the Village Clerk Clerk's to reduce the salary for that offie~ from $1,200 to $600 annually, salary for a term of office con%mencing in 1969. The Committee by a vote of 3-0 recomended changing the salary to $600 and requested Board concurrence. Upon roll call: Ayes: Reiter Grittani Kilroy Lewis Soderman Teichert Motion tarried. Trustee Kilroy read an ordinance for first reading establishing the salary of Villa~ Clerk at $600 and requested the Clerk to place it on the next agenda for final reading. ~nual Audit Annual Audit The Finance Cor~nittee by a vote of 3-0 verified the annual audit as prepared by Touche, Ross, Bailey and Smart for the year ending April 30, 1968 and reconmended approval as submitted. Waiver subdivision DiMucci The Finance Committee considered a request of waiver of subdivision DiMucci refused regulations by Mr. D~Si for Let H and by a vote of 3-0 did not wish to refused give any waiver of the present subdivision regulations. Upon roll call: Ayes: Reiter Grittani Kilroy Lewis Soderman Teichert ~$tion carried January 21, 1969 IRE AND POLICE COMMIT±~E bridge - Trustee Reiter gave a status report on the Fire and Police Cormuittee's We~ler Creel study and meetings with citizens regarding proposed locations for a bridge for vehicles over Weller Creek. This matter is to be reviewed with the Engineering Department and the Safety Conrnission to arrive at something proposed in the Comprehensive Plan for natural flow of traffic. JUDICIARY Trustee Lewis read for second reading Ordinance No. 2133: 2nd readi~ Ord/2 ~133 AN O~DINANCE AMENDING OBDINANCE NO. 2102 Ord 2102 This ordinance grants certain additional variations for Goldblatt's Goldblatts Home Center at Prospect Plaza. However, the Plan Conmtission requested an opportunity to review it at their next study meeting February 5, 1969. ~rustee Lewis, seconded by Trustee Kilroy, moved to defer PUD Ordinance to not later than the second nmeting in February. Plan Com~nission Ramdhurst recommended to deny the petition and the Judiciary Cormuittee by a vote of 2-0 concurred. Trustee Kilroy, seconded by Trustee Reiter, moved for Board concurrence with the Plan Conrmission and Judiciary Conm~ttee to deny the petition. Upon roll call: Ayes: Reiter Grittani Kilroy Lewis Soderman Teichert Motion carried. Case 67-16P Case 67-16P - Amend 5-2 zoning text to provide .for 30 ft. setbacks. The Plan Commission recommended denial of the petition because the setback regulations are being considered via an ordinance revision which would include all districts. The vote was 6-0 to deny. The Judiciary Committee by a vote of 2-0 concurred. Trustee Kilroy, seconded by Trustee Soderman, moved to concur with the Plan Commission and the Judiciary Conmittee to deny. Case 67-29P Case 67-29P - Petition to rezone the northeast comer of Northwest Highway and Edward Street from B-3 to P-1. Property owner later presented to the Plan Commission a request for 5-2, which was granted. Therefore the Plan Commission voted 6-0 to deny the request to rezone to P-1. Judiciary Cormmittee by a vote of 2-0 conco_r~ed. Trustee Kilroy, seconded by Trustee Reiter~ moved to concur with the recommendation of the Plan Commission and Judiciary Committee. (Bartmann's rminiature golf course) B-3 to B-4 for proposed furniture store. Plan Commission by a vote of 6~ recommended denial of the petition because of a pending ordinance making the request of B-4 zoning for retail sales of furniture unnecessary as it will be a proper use within the B-3 zoning classifica- tion. The Judiciary Committee by a vote of 2-0 concurred. Trustee Kilrey, seconded by Trustee Reiter, moved to concur with the Plan Com- mission and Judiciary Coramittee and deny the petition. Trustee Kilroy read for first reading an ordinance amending Sec. 6 of the zoning ordinance with reference to RX District and requested the Clerk to place it on the next agenda for final reading. ~Case 68-50P Case 68~50P - Rezoning from B-1 to R-1 Westgate Road north of Central. Plan Corm~ission denied the petition because the property owner was not notified of the public hearing. The Judiciary Committee by a vote of 2-0 concurred. Trustee Reiter, seconded by Trustee Kilroy, moved to concur with the recon~nendation of the Plan Commission and Judiciary Committee. 'Case 68-63A Case 68-63A - St. Marks Lutheran Church - petition for use variation for St.Marks construction of a youth building on lots 7 and 8, a side yard of 8 1/2 ft. Church and a rear yard of approximately 20 ft. of property zoned R-1 at 200 S. Wille. In order to meet the density requir,~ments, the petitioner w~l resubdivide lots into a single parcel. The Board of Appeals recommended approval of the variation and the Judiciary Committee concurred. Trustee Reiter, seconded by Trustee Kilroy, moved the Board concur with the recommendation of the Board of Appeals and Judiciary Corsnittee for the variations requested. Case Trustee Reiter read for first reading an ordinance granting certain !68-63A variations in Case 68-63A - St. Marks Lutheran Church - and requested the Clerk to place it on the next agenda for final reading. Case 68-49P Case 68-49P - Village of Mount Prospect petition to amend Sec, 2 of an ordinance regulating public improvements by ~rivate contract to delete the discretionary power presently existing in the section g~iven the Village Mauager wherein he could accept cash escrows or less than t~e full amount necessary for all the public improvements, but in excess of 20% of said improvements on subdivisions of more than 100 lots. It was felt that this provision was not in the best interests of the Vi~la~ and the Plan Corr~ission, by a vote of 7-0, recommended the proposed ordinance as submitted by the Village administration be approved. The Judiciary Cormmittee concurred. Trustee Reiter, seconded by Trustee Kilroy, moved to concur with the Plan Commission and the Judiciary Comnittee. January 21, 1969 Trustee Reiter read an ordinance for a first reading emending Sec. 2 of an ordinance regulating public improvements by private contract, and the Clerk was requested to place it on the next agenda for final reading. Case 68-43P Case 68-43P Petition to rezone the southwest conaer of Central and Rte. 83 from 5-3 to 5-4, for construction of gasoline service station. The Plan Commission by a ~ote of 7-~ recoramended the zoning c~amge be Gasp~ine approved with the understanding the present building would be razed ~v&ce station construction of a modern facility would be commenced. The Judiciary Committee by a vote of 2-0 concurred. Trustee Reiter, seconded by Trustee Kilroy, moved for approval of the B~4 zoning in concurrence with the recommendation of' the Plan Co~mission and Judiciary Commi6tee. Trustee Reiter read an ordinance for a first reading rezoning the southwest corner of Central and Rte. 83 from 5-3 to 5-4 for construction of a gaso- line service station and requested the Clerk to place it on the next agenda for final reading. Case 68-13P - Petition to rezone from 5-3 to 5-4 property at 1582 So~e 68-13P Busse Road for the purpose of permitting a laundry and cleaning establish- ment to be constructed on the premises. The Plan Con~ission determined that the petitioner was requesting rezoning of part of a lot. It was recommended that a new hearing be held for resubdivision of the property into two lots. Therefore, the Plan Commission and the Judiciary Comittee recommended denial of Case 68-13P and Trustee Kilroy, seconded by Trustee Reiter, moved for concurrence of the Board. Case Case 68-56A - Petition of Kellens Countryside Florist, 618 Golf Road - requesting variation for addition to existing building for workroom and storage space for greenhouse and garden center merchandise. Health & ~,TH AND SAFETY CC~'i'f~E Com~ttee The Cormmittee studied rodent control in and about Weller Creek and rodent reported that at the present time there is apparent adequate control and control requested that this i$~m be ramoved from Matters in Committee. Approved. propane gas The Cormmittee reviewed the possibility of introducing an ordinance governing the use of propane gas portable hearing units which are used in food delivery trucks. Upon investigation there appears to be no need for additional legislation to govern the use of these units a~d the Conm~ttee recommended removal of this item from Matters in Con~uittee. Approved. The Con~aittee considered an amendment to the anti-burning ordinance to allow open b~rning necessary and incidental to construction for a Ord anti- period from November 15 through March 15, and recormnended approval. ~ burning' Trustee Teichert, seconded by Trustee Lewis, moved for concurrence ~ with the Public Health and Safety Committee regarding an amendment to 1st reading Sec. 19.704. Trustee Grittani, seconded by Trustee Kilroy, moved to waive the rules to bring up a recent traffic problem. Unanimous. .~traff~c Trustee Grittani stated there were no private police directing traffic Police at St. Raymond's Church on Sunday, January 19th and he had been advised this was because of a direction from the Village administration. An explanation was requested from the Village Manager. Mr. Moore advised that the u~ivate traffic policemen are not under the jurisdiction of the Fire and Police Commission and in the event of any misdirection or accident the Village could be a party to a suit. The Village Manager requested a certificate of insurance indemnifying the Village and also notified the private police agency that it is inadvisable for the men to bear arms while directing traffic. This was based on the reco~ mendations of the Insurance Commission. Mr. Moore also stated this was not a sudden action. The police agency had been advised approximately ll months ago. Trustee Grittani suggested the Village Manager contact Mr. Magelman of the Illinois Suburban Police, formerly known as Fox River Valley Police, to have him meet with the Fire and Police Con~aittee on February 10th, and the Nanager was to contact the users of the agency, or take any other remedial course of action necessary, and ~-~ r~p6rt back to the Board at~ the next meeting. Trustee Grittani hoped the police agency wou~d contact the Manager before the next Sunday, ~ January 26th. ROGERS WHEREAS, DONALD R. ROGERS has devoted his time, experience, knowledge, and dedication to the position of serving in the elected office of Village Trustee of the Village of Mount Prospect from May 2, 1967 to December 7, 1969; WHEREAS, DONALD R. ROGERS served unselfishly and diligently on the Board of Appeals and later as Trustee, on various committees composed of the elected Village Trustees; and WHEREAS, the Village of Mount Prospect has been greatly enhanced by the knowledge and concentrated efforts expended by DONALD R. ROGERS in the performance of his position as Village Trustee, especially with re- spect to accomplishments leading to: the settlement of a certain 7.5 million dollar law suit filed against the Village President and Board of Trustees, contracts with land developers to participate in valuable sewerage and drainage projects, the completion of several half streets about par~L property, as well as the enactment of a new Building Code; and WHEREAS, the residents of the Village of Mount Prospect are deeply indebted to DONALD R. ROGERS did resign on December 18, 1968 from his elected position as Village Trustee because of added business responsi- bilities and consequent diffidulties of scheduling time required as Trustee; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect desire to express to DONALD R. Letter of resignation was received from Steve Barth as a member of Resignation~ the Mount Prospect Youth Commission. Trustee Reiter reported an Steve Barth appointment would be made to replace Steve Barth and two additional Youth Co~m. members would be appointed to augment the school board. Memorandum received from the Village Manager requested additional funds for the purchase of salt. The administration asked for Funds authorization to expend upwards to $6000 in addition to the $9000 purchase of already bud~get?d to provide salt for future needs during the current salt winter season. He pointed out that his plat of re- subdivision (Case 69-2P) had been approved by the Plan Cormmission on Bric,man January 15, 1969 and is a matter before the courts and requested that the Board consider it at this meeting in order to expedite the proceedings. Case 69-~ The plat was examined, which subdivides the Tally Ho property in order to place the buildings with the proper density on each lot. Trmstee Teichert, seconded by Trustee Reiter, moved to approve the plat of resubdivision subject to approval by the Plan Commission and the sig~ing thereof.
