The Village Manager requested approval of the Colonial Heights Colonial HeiSts Subdivision public improvements for final acceptance, authorizing div. public impro, return of bonds in the amount of $278.283.30. The Village Engineer reconm~nds acceptance. Trustee Reiter, seconde~ by Trustee Norris, February 3,. 1970 moved for approval of the Colonial HeiDhts Subdivisic~ public improvements for final acceptance and return to the developer bonds in the amo~t of $278.283.30. Upon roll call: Ayes: Ahem Furst Kilroy Norris Reiter SodernZ~l Motion carried, The Village Manager Requested authorization to rehibilitate Well Well #~;~ No.$.~ in the Fairview Gardens Subdivision at an approximate cost of $40.000. The Villag~ Manager and Director of Public Works recommends J. P. Miller be retained to do the work as per their bid proposal in the amount of $26,058.00. This would include in- stallation of a ten-inch purmp and column at a setting of 800 feet. The necessary electrical work will cost approximately $4,500. It is antioipated the structure that will be erected and the pump con- trols will cost an additional $9,000~. Arrangements for the structure and controls will be made at a later date when the other work is completed. Trustee Reiter, seconded by Trustee Furst, moved for acceptance of the low bid of J. P. Trustee Ahem read a Judiciary Committee report of the meetl~g~ of January 8, 1970 regarding Lot "H" - DiMucci, Unit 7A of Elk Ridge DLMucci Lot "R?' Villa, the subject property is part of and governed by a Consent Decree. The Judiciary Con~nittee recommends denial of the plat until the petitioner sport the buildings and parking lots thereon in strict conformity with the Consent Decree. Trustee Ahem, seconded by Trustee Soderman, moved to refer back to the Plan Commission and have the developer spot the buildings as outlined above and request the Village Manager to advise Mr, BiMucci to pick up the linen to be corrected and returned to the Pisn Com~dsison. Upon roll call: Ayes: Ahem Furst Kilroy 'Norris Reiter Soderman Motion c~m~ried. The report of the Judiciary Committee regarding DiMucci Subdivision at Golf and Elmhurst was read. Trustee Ahem recommended that if DiMucci Golf an~ the Board agrees, he would request the President to arrange a meeting Elmhurst with the Plau Commission, developer and Board as a Con~mittee-of-~he- Whole to resolve this matter. Approved. The Co~m~,~ttee considered the vacation of We-Go for a park. After discussion with the Village M~nager it was determined there ~re sewer We-Go for parl mains under the street which would make such vacation impractical. February 3, 1970 Old Town Sanitary District memo dated December 3, 1969 was reviewed Old Town Sanitar~y the Co~m~ttee. The Coramittee recom~rended denial of the proposed District ir~0roverr~nt. The Village Manager reported ,that action had been taken in December when the Village received a cc~cation from the Metropolitan Sanit$~vY District and NIPC. At that time it was indicated as not desirable and a form had been for~ra~ed. Trustee Ahem, seconded by Trustee Norris, moved the Board concur in the recommendation of the Plan Commission and the Village Manager no- tify in writing to the Metropolitan Sanitary District of such dis- approval, -- Upon roll call: Ayes: Ahem Furst Kilroy Norris Reiter Soderman Motion carried. The Judiciary Committee reviewed the Roth Plat of dedication for Roth plat of au additional ? feet for the east side of Linnez~!n Road south of dedication Golf Road. The Judiciary Committee reCO~Tends the plat of dedica- tion be returned to the Plan Con~nlssion for recommendation. Further to request the Vi!~l~ Manager to obtain an additional dedication of 5.48 feet of right of way from Eaplan and Braun 4th Addition, in order that a full 66' ~ght-of-way be made available along Linneman Road. Trustee Ahem, seconded by Trustee Norris, moved the Village Manager attempt to obtain the dedication indicated necessary by the Village Fngineer from Kaplan & Braun 4th Additimn. The Judiciary Com~m~ttee recon~nended that the Vilalge Engineer submit his opinion regarding a request for~ armexation of 1400 W. Lincoln by Mr. Patterson and the Village Manager proceed to obtain a petition for annexation. The Judiciary Committee considered the petition of American Oil Case 69-32P (Case 69-B2P) service station currently located at the southeast corner of Main and E~nsington, now zoned B-B and a non-confOrming use. Inasmuch as the company is updating its service statics, it is necessary to rezone to B-4 before any alterations can be made. The Plan Co~.~ssion voted to approve the change l¥om B-B to B-~ and the Judiciary Committee requested the Village Attorney to draft the appropriate ordinance for rezoning. Trustee Ahern, seconded by Trustee Norris, moved to concur in the recommendation and rezone the American Oil property at the southeast corner of Main and~ Kens- ington from B-3 to B-~. Case 69-B6P Case 69-B6P - Section l, (b) Scope of regulations - sub-para. 6 was deferred to the next Judiciary Committee meeting in February. Case 69-~5P Case 69-B5P - Kaplan & Bra~u subdivision plat was also deferred. PUBLIC WORKS Westbrook School Parking lot - adjacent to the north drive of school Westbrook Schoolwas reviewed by the Public Works Co~.~ttee. The request from the Parking lot school was for the Village to pay c~e-half of the cos~'~ of const- ruction. The conmdttee will make its recormne~dation at the February B Village Board Meeting so that school District 57, if it wishes, may send a representative to the meeting. No representative was present at the time of the Public Works Committee report. Trustee Norris, seconded by Trustee Reiter, moved the Board co,,~ncur in the recommendation of the Public Works Committee that the Village of Mt, Prospect will not share in the cost of improving and paving a parking lot at Westbrook School. No policy has been established by the Village Board cn the subject of sharing tax monies with other taxing bodies and this request would, if granted, set a precedent° February ~1970 Upon roll call: Ayes: Ahe~n Furst Kilroy Norris Reiter Soderman Motic~ csrried. Street lights with ~uderground wiring at Fairview Gardens was underground wirin considered. It was decided by R. Henc~icks that a letter be for Fairview sent to the Village with reference to the installation of the Gardens? lights with underground wiring, and also asking that the Vii- lage adopt a policy requiring new subdivisions and new lighting systems for existing subdivisions to include lighting systems with underground cables and wires. A letter from the Civic Association was distributed to the President and Trustees~ It was determined that it would cost ap~z~oximately $15,000 to pay for the difference for underguound wiring and decorative poles. Considerable discussion ensued in which it was thought a time limit should be set to allow residents of Fairveiw Gardens to determine whether the additional funds could be raised or whether the Village would automatically install lights with above-ground wiring. The Matter was refer~ed to the Safety Coramission and the Public Health and Safety Committee for Joint consideration. Trustee Norris wished the follow,lng be added: Street lights with tmderground wiring at Fairview Gardens was considered by the Public Works (t~n~ittee. Several residents of Fairview G~rdens were in attendsnce at the conraittee meeting and some of them were opposed to any additional assessments or contributions at this time. Mr. Hendricks, representing the Fairview Gardens Civic Assoc. indicated l~ hcmeowners re- plying to a questiormaire indicated they would be willing to pay approximately $50.00 per home for ornamental poles and under- g~ound wiriing. About 75 were Opposed to it and balance of the 293 homeowners did not reply. Basically less than one-hal~ of the rssidents were ~avorable to the project. The Civic Assoc. felt a special assessment was the only alternative and our Village Attorney was of the opinion that this was not feasible. Mr. Hendricks indicated a letter would be sent ot the Village with reference to the installation of ornamental poles and under~ g~ound wiriug; also requesting the Village consider adopting a policy lighting systems with underground wir~g for newly anmexed subdivisions. OTHER BUSINESS A plat of subdivisc~ for Craig Subdivision outside the Village Craig Subdivisic limits but within a mile and one-half of Arlington Heights and Mount Prospect was submitted for execution. It bore the sig- natures of the Arlington Heights officials, and a tentative plat submitted to the. Plan Commission had been approved by them and by the Village Engineer. Trustee Ahem spoke about a previous motion made in Oc$ober, 1969 regarding additional salary to John Zinm~ramun, Village Attorney,Extra money for overtime and assistance for the Village Manager during the denied V.
