CASE 70-11P -' Northwest corner of Wolf & Kensington.
Case ?0-ilP The Village Attorney submitted an opinion regarding Sections
14.1202 and 14.1~03 of the Municipal Code. Section 14.1203 had
been repealed by passage of Ordinance ll~2, but also, at the
time of passage of the current Building Code, all other ordinances
relating to building were repealed, thereby malalng Section 1~.1202
and 14.1203 ineffective.
Section 14.1202 "Permit restrictions" (a) and (b) prohibited
Section 14.1202 the erection of service stations within 300 feet of any church,
school, hospital, fraternal lodge, hall, theatre, or place
of public assembly; or within 300 feet of the location of any
railway passenger station, freig, ht depot and auy buildings in
which not less than 75% of the total floor space is used for
warehouse or storage purposes.
The Village Attorney was requested to draft an ordinance along
the lines of Section 15.1202 with (a) and (b) to be included,
but, after discussion with the Fire Chief and the recommendation
of the Fire Rating Bureau in order to establish the criteria
for management and distance. It was the consensus of the Board
that aCtion on the ordinance should preceed any attempt to
zoning property that falls in that classification at this
point.
