INVOCATION Trustee Anderson gave the inv.ocation. ROLL CALL Present upon roll call: Anderson Furst Hendricks Link ,Richardson Teichert Absent: Scholten This special meeting~of the Mayar.and the Board of Trustees of the Village of Mount Prospect was called by Mayor Teichert on Friday, September 7, 1973, pur- suant to Chap. 2, "The Board of Trustees" Section 2.103 "Meetings." of the Municipal Code of Mount Prospect. A Public hearing on the pre-annexation agreement for property commonly known as San Souci was continued to October 16, 1973. ANNEXATION OF PROPERTY LOCATED ON THE ~souTHwEST CORNER OF ELMHURST AND ALGONQUIN ROADS. Trustee Furst, seconded by Trustee ]Link, mQved to waive the rules requiring two readings of an ordinance. Upon roll call: Ayes: Anderson Furst Hendricks Link Richardson Motion carried, Trustee Richardson, seconded by Trustee Furst, moved for passage of Ordinance #2450: .AN ORDINANCE ANNEXING PROPERTY LOCATED AT THE SOUTH WEST CORNER QF THE INTERSECTION QF ALGONQUIN AND ELMNURST ROADS Upon roll call~i Ayes: Anderson Furst Hendricks Link Richardson Motion carried. Trustee Hendricks, seconded by Trustee Link, moved for approval of the Mayor to sign and the Clerk to attest the plat of annexation of the property located at the southwest corner of the intersection of Algonquin and Elmhurst Roads.. Upon roll call: Ayes: Anderson Furst Hendricks Link Richardson Motion carried. Trustee Link, seconded by Trustee Richardson, moved to waive the rules requiring two readings of an ordinance. Trustee [ink, seconded by Trustee Richardson~ moved for approval of the Mayor to sign and the Clerk to attest the plat of annexation of the 2.83 acres south of Algonquin Road 208.70 to 408,70 feet East of the East line of Nordic Road. Trustee Furst, seconded by Trustee Richardson, moved for passage of Ordinance #2452: AN ORDINANCE AMENDING MAP 47zS OF THE MOUNT PROSPECT ZONING ORDINANCE Upon 3oll call: Ayes: An'derson Furst Hendricks Link Richardson Motion carried. (This ordinance applies to the rezoning of the property annexed by adoption of Ordinance #2450 (southwest corner of Elmhurst and Algonquin Roads) from R-X to B-l) Trustee Richardson, seconded by ~Trustee Link, moved to waive the rules to consider a matter not on the agenda relating to liquor licenses. Trustee Richardson, seconded b~ Trustee Fu~st, moved to waive the rules requiring two readings of an ordinance increasing Class "B" liquor licenses from 10 to 11 and creati.ng one: C~.ass "E" (l~ive music) license with the intent to issue to Captain's Steak Joyn.t and Blarney Stone Inn, both existing in the newly-annexed area above. The ordinance was presented and certain revisions were made in the definitions, changing the annual fee for Class "L" to $2,000. and rewording Section 13.115 re - closing hours Trustee Richardson, seconded by Trustee Link, moved for passage of Ordinance #2453 as discussed: 9/11/73 AN ORDINANCE AMENDING CHAPTER 13 OF THE MOUNT PROSPECT MUNICIPAL CODE Upon roll. call: Ayes:' Furst Hen~rick~ Link Richardson Teichert Nays: Anderson Motion carried. Trustee Anderson prefaced his vote stating this would set a precedent throughout the community by posting additional money for a 4:00 A. M. closing and therefor he would vote in the negative. Trustee Richardson, seconded by Trustee Furst, moved to approve Resolution 27-73: A RESOLUTION REPEALING RESOLUTION NO. 24-68 (The Village Clerk shall use his discretion in publishing various legal notices in those newspapers circulated within the Village.) Upon roll call: Ayes: Anderson Furst Hendricks Link Richardson Motion carried. Trustee Furst, seconded by Trustee Link, moved to waive the rules to consider a matter not on the agenda relative to slurry seal bids. Trustee Richardson, seconded by Trustee Link, moved to waive competitive bids and to permit the administration to accept a unit price of 40¢ per square yard from Central Illinois Slurry Seal for that portio~ of-the improvement of streets 1.isted in the attachments to a memorandum from the Village Engineer (Wille, Pine, Russell and Elmhurst Ave. from Highland Ave. to Kensington Rd., and on Lincoln Street from School to Route 83 and, on Lancaster from We-Go to Milburn. FLOOD C'ONTROL PROGRAM The Village Manager gave a status report stating there were678 replies from the questionnaire sent out to the residents of the Village, and of those 226 persons in- vited Village personnel to inspect their premises and give advice on flooding problems. Raymond G. Heideman, ll06 Barberry asked if it were not true that a utility tax was not-deductible from State or Federal income tax and was advised that it was. The Village Engineer obtained proposals from seven engineering firms and recommended the Board enter into an agreement with Ralph Gross~and Associates to prepare the plans and specifications for the Flood Control Improvements. This agreement is to cover only Phase "A" of the Clean Streams Commission report. 9/11/73 The engineering fees would be based on a percentage of the contract prices. The Drainage and Clean Streams Commission report recommends that some additional studies must be made before plans can be completed for some of the items in Phase "A". This part of ~he agree- mens will be paid for on an hourly rate with a set maximum. Mr. Hemmeter stated that Ralph Gross and Associates could prepare the plans and specifications to cover Phase "A" ~the Drainage and Clean Streams report. Trustee Anderson, seconded by Trustee Furst, moved to concur with the administration's recommendation to direct a contract to be incurred with the firm of Ralph Gross and Associates with Phase "A", and the lesser of the projects to be done by the Village Engineer. Upon roll call: Ayes: Anderson Furst Hendricks Link Richardson Motion carried. The meeting was then opened to general discussion. Mr. George March was present at the meeting. Mayor Teichert read a letter from Mr~ March resigning as a member of the Drainage and Clean Streams 'Commission ~ffective September 12, 1973. Mr. Edward Rhea, 1829 Palm Drive, advised the Board members t.o seek gui.dance from consulting firms or banks on the question Of fundin§. Mr. Rhea read a statement as President of the Mount Shi.re Home Owners Assn. voicing opposition to the use of a utility tax to aid the flood, program. Then, as a private citizen, he stated he was opposed to funding with current revenues, and considered it bad fiscal management, and urged the Board to vote in favor of long-term financing for the flood control program. Mr. Ray Heideman stated the utility tax is discriminatory, business may move out because of its effect on business, questioned the amount charged by the utiqity to collect the tax, and reiterated the fact there would be no federal om~t ~e tax ~eduction on the amount paid. Mr. Michael Minton, 1207 W. Lonnquist 'discussed the possibility of taxing rental units and brought forth a proposed ordinance, which would tax the lessor $25.00 per year per unit on'each and every apartment building either now existing or to be erected in the future. The licensing of multiple dwellings was referred to the Finance Committee. An informal Dolling of the Board showed a p~reference for funding by general obligation bonds. COMMITTEE ANNOUNCEMENTS JUDICIARY COMMITTEE - September 13~1973 Prospect Heights incorporation Twin Links (Bartman) PUBLIC HEALTH & SAFETY COMMITTEE September 26, 1973 BUILDI-NG COMMITTEE Cancelled PUBLIC WORKS COMMITTEE September 19th 9/11/73 ayor Teichert reported he had two liquor licence requests: Salvatore DiMucci, Jr. for the Mount Shire Complex, and he advised the petitioner to make a specific request for a specific license. This was referred to the Finance Committee. The other request, Class "A" liquor license in Countryside Court, petitioner KenBssey International. This operation is unique in that they serve cheese and sausages in a gourmet fashion. (Referred to the Finance Committee.) Mayor Teichert reported that when there was a merger of the existing Forest River and Mount Prospect Fire Pension Fund three persons who were volunteers for Forest River were included. It appears this does not comply with Art. 4 of the Ill. Pension Code and there is possibility of suit to determine the legality of the action taken. The firemen are of the opinion that it should not be at their cost, but at the cost of the State and Village. ADJOURNMENT Trustee Furst, seconded by Trustee Anderson, moved the meeting be adjourned.
