Trustee Scholten, seconded by Trustee Richardson, moved to approve the financial report for the month of May, 1973, subject to audit. RESENTATIONS OF CERTIFICATES OF MERIT Mayor Teichert presented Certificates of Merit to George Jacobsmeyer, former Chairman of the Board of Appeals, Dr. Michael Ruane and Paul Garvin, Chairman, both members of the Board of qealth. COMMUNICATIONS AND PETITIONS Mr. Michael Minton discussed a memorandum read by Mayor Teichert dated June 5th regarding a citizens group formed to monitor all meetings of the Village Board, as well as all meetings of appointedBoards and Com- missions. Mr. Minton stated he wished to clarify the purpose and in- tent of the formation of the expanding group, which was primarily con- cerned with civic improvement and not for any political purpose. Trustee Link brought into discussion the preamble to the petition re- garding the Colony Project which had been signed by approximately 900 citizens, and contained a clause which stated the public hearings were not open to free discussion since opponents of the Colony Project were embarrassed, intimidated, harangued, and harassed by the Mayor and certain members of the Village Board. Trustee Link requested names and dates of the times the Trustees purportedly performed in such a manner in order that those members could be chastised. Trustee Link requested the Village Clerk to place the following letters as a matter of record in the Village Board minutes. May 24, 1973 Mr. Michael Minton 1207 W. Lonnquist Blvd. Mount Prospect, Illinois 60056 Dear Mr. Minton: This letter is in confirmation of our personal conversation on April 17, 1973, at the polling place for Precinct ~o. 16 during the recent Village elections. In attendance and also a part of our conversa:i.o~ was Mr. John Biestek. During our conversation you stated that I would be deeoly shocked if I knew of the moneys which various contractors have paid over to Mayor Robert Teichert for his personal use. You further stated that you knew the identity of the contractors, the amount each had paid over to him, and that you were, in fact, able to trace the money to where it had been placed. Upon your informing me of the foregoing, I re- quested that you turn over your information and documentation to the appropriate authorities for action as deemed appropriate by them. You also 'promised to furnish to me for my information after the elections a copy of all of the information and documentation to support yo~ur statements to me concerning receipt of moneys by Mayor Teichert for his personal use from various contractors. It is now more than a month subsequent to the Village elections and I would appreciate being advised, at your earliest convenience~ as to any action taken by you as a result of our conversation. If no action has been taken by you, and if you do have the information re- ferred to in our conversation, I feel it is your duty to make such information available to the proper authorities and I urge you to do so promptly. Link 2022 Woodview Drive Mount Prospect, Ill. 60056 Dear Mr. Link: I should like to acknowledge receipt of your letter dated May 24, 1973, egarding our conversation of April 17, 1973. I am somewhat puzzled, however, over the purported statement which you have attributed to me. You will recall that you approached me in a polling place and indicated that you would be happy to cooperate fully in any investigation of Mayor Robert Teichert. At that time you promised to turn over any information in your possession of secret meetings with land developers and con- tractors which Mayor Teichert had conducted and which you had knowledge of. You will further recall that I made no representation that monies had been paid over to Mayor Teichert~for his personal use, nor about the identity of any contractors or any other information regarding "pay offs" to Mayor Robert Teichert. I will confirm that you were deeply concerned about any misconduct on the part of the mayor, and pledged your full cooperation. I am somewhat dismayed that your "full cooperation" has not been forthcoming. It has now peen more than a month since the Village elections, and I would appreciate any information with regard to the aforesaid. I feel it is your duty and mine to make such information available to the proper authorities, and I urge you to do so at once. Very truly yours, MICHAEL N. Lonnquist Blvd. ~ount Prospect, Ill. 60056 Dr. Mr. Minton: I acknowledge receipt of your letter of June 12, 1973, which responded to my letter to you of May 24, 1973. I am somewhat puzzled over your inability to remember the statements you made to me on April 17, 1973. You will recall that our paths crossed while we were both visiting the polling place for Precinct 16. You will recall that, as a matter of courtesy, I extended to you the gKeetings of the day. You will recall that I made inquiry of you as to the factual basis for the campaign ad which appeared in the Chicago Tribune and Mt. Prospect Herald relating to areas claimed to be under consideration for low-income housing. You will recall that you did not know the factual basis for such claims. I did not therefore approach you for the purpose of indicating to you that I would be happy to cooperate fully in investi- gation of Mayor Robert Teichert. It would have been impossible for me to have promised to turn over any information in my possession of secret meetings with land developers and contractors because I did not have then, nor do I now, have any knowledge of any such meetings. I have always been of the firm conviction that Mayor Teichert has served this Village ex- ceptionally well and I consider him to be a person of integrity. I was not then, nor am I now, deeply concerned about any misconduct on his part because, as I've just stated, he is a person of integrity. As I have always considered him to be a person of integrity and since your own letter denies any representation by you about any improper conduct on his part, then, how could there possibly be any cause for deep concern on my part? Let it be clearly understood that I would be deeply concerned--and I would hope you would be also--in the unlikely event of misconduct by any elected fficial or member of the administration. This Village has had and shall always have my full cooperation. Very truly yours, PATRICK JOHN LINK Following the public reading of the above correspondence, Mr. Minton re- quested an opportunity for rebuttal, with his words also made a matter of record in the minutes. "My response to Mr. Link's letter I think is self-explanatory. The Mayor has directed some comment about the distinction between the truth and a lie. Mr. Link's letter to me contained statements which I never made to him, either directly or by insinuation or innuendo. I then drafted my letter in response to that for the purpose of clarifying my position, both as a citizen and as an attorney, reassuring him that if, as he pre- fers to state, that in the unlikely possibility that some information to that effect may be revealed, qe could be assured that I would not harbor that information but I would relate it to the proper authorities, as I am sure he would too. The purpose of my letter was to disaffirm the contents of his letter, and I will say that my letter was sent to Mr. Link personally. Now the fact that qr. Link has chosen to make it public leads me again to query this man's motives, his use of his seat on the Village Board and generally his conduct both as a citizen and as an elected Board member. His correspondence was directed to me personally, I then answered it to him personally. The letter was sent to me return receipt requested. I felt obligated to respond to it although I disagreed in full with the contents of this letter and would like to as.sure you gentlemen that my purpose as clarified and as very clear in my response was to disavow ever making those comments directed to, or about you, Mr. Teichert, and also to again reiterate my duty, which I fully recognize as a citizen, if I were to uncover, or if that information were to be accessible or were to be revealed to me, to tender that informa- tion to the proper authorities. I view Mr. Link's revelation of these letters at this Board meeting as a publicity attempt to discredit me and to discredit the group of citizens and residents of Mount Prospect that have chosen to speak out on the issues which are now present in our Village. I will have to say that my response to Mr. Link's reply to my letter will be stated here--I have not prepared a formal response. I feel that in view of his comments that this is more than sufficient to answer, again, the accusations and innuendo that appear in this public statement. I would also like to say that if Mr. Link ~erhaps is short of memory, the statement which I read to 'the Board clarifying the purposes of the Undevelopment Commission answers most of the points, or I should say, most of the baseless insuations which he brought forth in hi~ response tQ my letter. I'll be more than happy to provide him and the members of this Board with copies of it." MANAGER'S REPORT The Village Manager reported the Police Department has delivered a report on parking in the peripheral areas in the business district and the speed limits on See-Gwun Ave. and Lonnquist which has been keyed to a map, and Trustee Anderson, as Chairman of Fire and Police Committee, in liaison with the Safety Commission, has been requested to accept the report and review it for recommendation to the Board. MAYOR'S REPORT Mayor Teichert brought up the subject of the Colony Project petition which had previously been presented, containing 900 names, and discussion of the subject matter contained in the preamble. In distribution of the petition among residents, it had not been bound and some citizens were not aware of the full content of the petition they had signed. They were under the impression they had signed a petition against high rises. · Letters had been mailed to those who signed the document explaining' what the wording was on the cover sheet, and asking whether they wished their names to remain on the petition or whether they should be removed. pproximately twenty-five persons requested that their names not be removed from the petition, and Mayor Teichert read replies received from the others who have expressed their opposition to multi-family and high rises, but stating they had no knowledge of the clause criti- cizing Village officials. Mr. George Flaherty, 319 S. George, spoke before the Board. He stated the point should not be lost. The emphasis should be on the objection to high rise apartments and the density of the developments. He further questioned the legality of mailing 900 letters. ~arsha Ulbricht, 905 W. Milburn, claimed persons who signed the petition did not respond for fear of retaliation or did not want to become involved. Mrs. Norma Marauskis, 1826 Pheasant Trail, stated she went with the petition on her own, and as she circulated it she displayed an article about the Colony, and underneath that was the preamble, followed by the pages for signature. Mrs. Marie Caylor, 1308 Pima La. felt the statements made before the Board were repetitious, and in view of the lateness of the evening, the other matters on the agenda should be considered. Mayor Teichert reported there were two vacancies on the Board of Health created by the resignation of Dr. Richard Lamey and Paul Garvin. He appointed Dr. Donald Dreesen DVM, 513 N~ Russell, to fill the unexpired term of Dr. Lamey, to May 1, 1974, and requested Board concurrence. Trustee Anderson, seco6ded'by Trustee Furst, moved to concur in the appointment of Dr. Dreesen for a term to May l, 1974. Upon roll call: Ayes: Anderson Furst Hendricks Link Richardson Scholten Motion carried. Mayor Teichert appointed David W. Bruce, 1114 Juniper, to fill the un- expired term of Paul Garvin to May t, 1975, and requested Board con- currence. Trustee Scholten, seconded by Trustee Furst, moved to concur in the appointment of Mr. Bruce for a term to May 1, 1975. Upon roll call: Ayes: Anderson Furst qendricks Link Richardson Scholten Motion carried. Mayor Teichert reported the Board of Health requested the addition of two members, expanding from five to seven on the Board. This was charged to the Public Health and Safety Committee for recommendation. COMMITTEE CHAIRMEN REPORTS BUILDING COMMITTEE Trustee Link, seconded by Trustee Anderson, moved to waive the rules re- quiring two readings of an ordinance relating to Cases 72-8P and 72-5A, for property located at the Northwest corner of the intersection of Foundry and River Roads, known as the Doetsch property. Trustee Hendricks moved the matter be remanded to the Zoning Board of Appeals for recommendation. The motion failed for lack of a second. Upon roll call on motion for waiver: Ayes: Anderson Furst Link Richardson Scholten Pass: Hendricks Motion carried. he attorney for the petitioner, Robert DiLeonardi, was present and agreed the site plan would be changed to show 201 parking spaces. Trustee Link, seconded by Trustee Richardson, moved for passage of Ordinance 2432: AN ORDINANCE AMENDING MAP 32-N OF THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT Trustee Link stated he had participated as an attorney in opposition to the zoning of the property in the County, and therefor could not be a party and cannot partake in the official vote before the Board. Trustee Link, seconded by Trustee Richardson, moved for passage of Ordinance No. 2433: AN ORDINANCE AMENDING MAP 32-N OF THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Anderson Furst Richardson Scholten Teichert Pass: Hendricks Link Motion carried. Trustee Link, seconded by Trustee Anderson, moved for passage of Ordinance No. 2434: AN ORDINANCE GRANTING A SPECIAL USE PERMIT IN THE NATURE OF A PLANNED UNIT DEVELOPMENT FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF THE INTER- SECTION OF FOUNDRY AND RIVER ROADS Upon roll call: Ayes: Anderson Furst Richardson Scholten Teichert ~ass: Hendricks Link Motion carried. Trustee Link, seconded by Trustee Anderson, moved to approve the Restrictive Covenants, authorizing the President to sign and the Clerk to attest. Trustee Link, seconded by Trustee Anderson, moved for passage of Ordinance #2435: AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT THE NORTH- WEST CORNER OF THE INTERSECTION OF FOUNDRY AND RIVER ROADS, MOUNT PROSPECT, ILLINOIS Upon roll call: Ayes: Anderson Furst Richardson Scholten Teichert Pass: Hendricks Link Motion carried. Trustee Link, seconded by Trustee Anderson, moved to waive the rules requiring two readings of an ordinance regarding Case ZBA 1-V-73 - Petitioner Roger Spike for variation at 1807 Mura Lane. Upon roll call: Ayes: Anderson Furst Hendricks Link Richardson Scholten Motion carried. rustee Link, seconded by Trustee Anderson, moved for passage of Ordinance #2436: AN ORDINANCE GRANTING A FRONT YARD REQUIREMENT VARIATION FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF MURA LANE AND SENECA DRIVE, MOUNT PROSPECT, ILLINOIS Upon roll call: Ayes: Anderson Furst Hendricks Link Richardson Scholten Motion carried. FINANCE COMMITTEE Trustee Scholten, seconded by Trustee Richardson, moved for passage of Ordinance No. 2437: AN ORDINANCE CREATING ONE ADDITIONAL CLASS B LIQUOR LICENSE Upon roll call: Ayes: Anderson Furst Hendricks Link Richardson Scholten Motion carried. The Finance Committee reviewed the Invitation to Bidders, Instructions to Bidders, and three Bid Proposals ahd the Service Contract on scavenger service. The three proposals are: 1) for the present service; 2) for plastic bags with a 6-month transition period; and 3) plastic bags to be delivered by the contractor to the fro~t door every 6 months. The Com- mittee requests Board concurrence to authorize the administration to ad- vertise for bids. Trustee Scholten, seconded by Trustee Furst, moved the Board concur with the recommendation of the Finance Committee to authorize ~he administration to advertise for bids for scavenger service with the three alternatives. FIRE AND POLICE COMMITTEE Trustee Anderson, seconded by Trustee Scholten, moved for passage of Ordinance #2438 as revised: AN ORDINANCE REGULATING THE USE OF FIREWORKS AND OTHER EXPLOSIVES Mr. Louis Velasco, 202 ~. Louis, stated the ordinance was too restrictive. Upon roll call: Ayes: Anderson Furst Hendricks Link Richar~:~n Scholten ~ Motion carried. The Committee reviewed the recommendations of the administration, Crawford, Bunte and Roden, Inc. and the Safety Commission and recommended a list of collecto~ streets to be given priority rating in maintenance, drainage improvements, snow removal and street lighting. Trustee Anderson, seconded by Trustee Furst, moved the Board concur with the recommendation of the Fire and Police Committee in the designation of collector streets and request the Village Attorney to prepare an ordinance covering the designation for the next regular Board meeting. Upon roll call: Ayes: Anderson Furst Hendricks Link Richardson Scholten Motion carried. JUDICIARY COMMITTEE Trustee Richardson gave a status report on HB 1933, HB 911, SB 220 and SB 1132. RECESS At 11:30 P. M. the meeting adjourned to executive session for consideration of the Century Tile matter. The members reconvened at 11:45 P. M. Present upon roll call: Anderson Furst Hendricks Link Richardson Scholten Teichert 00 OTHER BUSINESS Mayor Teichert reported the flood control program would be continued at a later date because information required on utility tax was not available, and it would give Mr. Hemmeter, the newly-appointed Village Engineer, an opportunity to review the matter. Discussions on property tax, real estate tax, legislation pending on the tax freeze all are involved in the complex study of flood control. There will be a joint meeting June 26th on flood control and with the Metropolitan Sanitary District on July 9th. Further consideration will be deferred until after that date. Trustee Anderson requested the Village Engineer to evaluate what ~he Engineering Department could do in the flood control program. Trustee Furst, seconded by Trustee Anderson, moved to undertake the project of preparing a booklet that was originally presented by the Drainage and ~Clean Streams Commission to be distributed to residents of Mount Prospect for a cost of approximately $4,500.00. Mayor Teichert called a special meeting of the Board of Trustees to be held July 24t~ for the purpose of considering the flood control program. Trustee Furst, seconded by Trustee Scholten, moved to authorize the Clerk to publish the Recommendation, Estimate, Ordinance and Certification for Wedgewood Terrace Special Assessment ~72. Upon roll call: Ayes: Anderson Furst Hendricks Link Richardson Scholten Motion carried. Trustee Furst, seconded by Trustee Richardson, moved for' waiver of the rules to consider a contribution to DAMP. Upon roll call: 'Ayes: Anderson Furst Hendricks Link Richardson Scholten Motion carried. Trustee Furst, seconded by Trustee Scholten, moved to contribute $1,000 to the DAMP Commission. Trustee Anderson stated he does not support the program of obtaining water from Lake Michigan and therefore will vote against the motion. Upon roll call: Ayes: Furst Hendricks Link Richardson Scholten Nays: Anderson Motion carried. COMMITTEE ANNOUNCEMENTS PUBLIC WORKS - June 20, 1973 at 8:00 P.
