INVOCATION The invocation was given by Trustee Richardson. ROLL CALL Present upon roll call~ Anderson Gustus Link Richardson Scholten Teichert Arrived at 9:55 p.m. Hendricks APPROVAL OF MINUTES OF REGULAR~MEETING MARCH 5,1974 The following corrections were made: Under Building Committ'ee, Case No~. ZBA-24-Z-73 and ZBA-25-SU-73 L & D Builders petition to rezone from~RX to R4 and special use for a PUD at 623 Golf Rd. Motion to read: "Trustee Anderson, seconded by Trustee Richardson, moved to dismiss the petition pursuant to the request in the letter dated February 26th." Motion re Case ZBA-8-Z-74 and ZBA-9-V-74 Mount Prespect State Bank to be corrected to-delete "a 9 x 20", and under Finance Committee reoort correct typo in motion re vehicle license fees changing word "for'~ to "to" Trustee Anderson, seconded by Trsutee Scholten, moved to approve the minutes of the regular meeting of March 5, 1974 as corrected. APPROVAL OF BILLS General $191,180.78 Parking System Revenue 955.17 Motor Fuel Tax 8,506.57 ~aterworks & Sewerage Depr., Impr.; & Ext 34,910.00 Operation & Maintenance 32,861.67 $268,414.19 Trustee Scholten, seconded by Trustee Anderson, moved to approve the above bills for payment. Trustee Scholten, seconded by Trustee R~hardson, moved to approve the financial report for the month of February, 1974 subject to audit. COMMUNICATIONS AND PETITIONS The Sunshine Blue Birds presented members of the Village Board with cupcakes in honor of the Campfire Girls 64th anniversary of their organization. The developers of Laurel Estates located on south Busse Road requested plan changes to erect the 12-story buildings 83' s 112'~ in length rather than the original 82', and 49' in width rather than 48', and a slight re- location of the buildings in order to conform with required setbacks. The Village Manager stated he had conferred'with the staff re- garding these field changes and recommended approval. Trustee ~Gust'~, seconded by Trustee Scholten, moved to ratify the action of the Village Manager in aooroving the field changes. Upon roll call: Ayes: Gustus Link Richardson Scholten Pass: Anderson Motion carried. MAYOR'S REPORT Mayor Teichert present.ed a Certificate ~f Merit to Lawrence W. Ostling, former Chairman of the Fire and Police Commission. Trustee Link, seconded by Trustee Scholten, moved to extend wishes for success to the Hersey basketball team in the upcoming State tournament. MANAGER'S REPORT The Village Manager presented MFT resolutions covering the 1974 program as recommended b.y the Village Engineer. The Trustees discussed the proposed improvements and the matter was charged to the Public Works Committee to de- termine too priorities. Trustee Richardson, seconded by Trustee Scholten, moved for passage of Resolution No. 5-74: A RESOLUTION AUTHORIZING A PERMIT APPLICATION TO THE ILLINOIS STATE HIGHWAY AUTHORITY FOR CONSTRUCTinG A 12 INCHSSANITARY FORCE MAIN ACROSS THE TOLL HIGHWAY RIGHT OF WAY Upon roll call: Ayes: Anderson Gustus Link Richardson Scholten Motion carried. March 19, 1974 The Village Manager announced that the Kiwanas Club of Mount Prospect donated $800.00 for the paramedic program of the Village. The Village Manager reported on negot'i'~tions with the Chicago and North Western Railway Co~ whereby with removal of the s~ur track for Wille Lumber Co. there could be a minimum of 100 parkqn~g spaces added and the officials of the railroad have agreed to erect a four foot high cyclone fence for the pro~ection of ped- estrians. The improvements is estimate~ to ~be'$15,000.O0 which Vas- been'~budge~e'~'~ 'The ~rail~road will 'pay the enti're cost of'this'improvement,]bet not'in a'lumo sum. MAYOR'S REPORT Mayor Teichert read a letter of resignation from Wil- liam Demmert as a member of the Drainage and Clean Streams Commission and appointed ~ame's Soyka,~l?~7 Carib Lane, to fill the term to expire May 1, 1976, and requested Board concurrence. Trustee Anderson, seconded by Trustee Gustus, moved to concur with the Mayor's appointment of James Soyka. Upon roll call: Ayes: Anderson Gustus Link Richardson Scholten Motion carried. Mayor Teichert read a letter of resignation from John Martino as a member of the ~Oning Board of Appeals and named Robert Sherman, 203 N. Stevenson to ~ill the vacancy for a term to exoire May 1, 1980, and requested~Board concurrence. Trustee Scholten, seconded by Trustee Gustus, moved to concur in the Mayor's appointment 6~ Robert Sherman. Upon roll call: Ayes: Anderson Gustus Link RiChardson Scnolten Motion carried. ~UILDING COMM'I?T£E ZBA-12-V-74 Societyof the. Deaf, 1300 W. Northwest Hwy. Petition for variation to build on east lot line of property r'ather t'han'~wi'th'~a'lO' setback due to adjacent property being zoned R~l and a variation to reduce the setback requi'rement on Isabella St. (unconstructed) from 20 feet to 7 feet. The Zoning Board recommended both vari'ations be granted. Trustee Link, seconded by Trustee Gustus moved to accept the recommendation of the Zoning Board of Appeals and grant the two variations. Uoon roll call: Ayes: Anderson Gustus Link Richardson Scholten Motion carried. March 19, 1974 The Village Attorney was reouested to prepare the proper ordinance. ZBA-26-Z-73 and ZBA-27-$U-73 - Rob Roy Country Club petition for annexation with R-~ zoning with a Special Use for a PUD, Referred to the Building Committee. Trustee Link was presented with two pet'itions'by land owners adjacent to the proposed complex and the~petitions~were turned over to the Clerk for placement in'the'Zoning Board file. Trustee Link stated he would qike the Board to go on record to retain..two appraisers to perform an appn~is~sof'the property involved with the ultimate purpose in mind that the Vil- lage will prepare a referendum to submit to the residents of tne Village to retain the property as open space. Trsutee Link, secon,ded by Trsutee R-ichar~son, moved to authorize the Village Manager to retain r the services of the two lowest bidders, Muriello/ Meyer and Associ-ates Bnd J.G. Hoope Real Property Consultants, to make appraisals of the Rob Roy property. Upon roll call: Ayes: Anderson Gustos Link Richardson Scholten Motion carried. (At this point in the meeting - 9:55 P.M. Trustee Hendricks arrived.) ZBA-lO-V-74 Joseph Pal~din~- property located at the northwest corner of George and Evergreen Street~. The petition is for a variation of 17 fee~-allowing a residence to be built wit,bin 13 feet of Evergreen. The lot is 48 feet in width. It was the recommendation of the Zoning Board of Appeals to grant th~ v~r~ation, pro- vided that any attached or unattached garage or out buildings comply with the Z~ning Ordinance of Mount Prospect, Article 11 i~ the R-1 Dis- trict, Sec. 14.1102, Sub-paragraph (d). Trustee Link, seconded by Trustee Scholten, moved to concur with the recommendation of the Zoning Board of Appeals to grant the variation of 17 feet requested. Trustee Link presented an ordinance amending Map 8-S of the Zoning Ordinance (Case 8-Z-74) rezoning certain property from R-1 to B-2.1 for the Mount Prospect State Bank, and an ordinance granting variations for property so located that it fronts on the south side of Busse Avenue and on Emerson and Maple Streets (Case 9-V-74) also relating to the bank, and requested the two ordinances be placed on the agenda of the next meeting for final passage. Trustee Link reported that Case ZBA~28-Z-73 LaSalle Bank, Trust 40311 - Freedman - Willow & River R-1 to B-3 was withdrawn at the request of the petitioner and the Clerk was directed to remove the item from the charge sheet. March 19, 1974 FIRE AND POLICE COMMITTEE Trustee Anderson reported on the Metron Systems Corpor- ation as revi~ewed by the Commi'ttee'~nd'req~e~ted'that ~ written proposal 'be prepared~ Copie~'~were presented and the Fire and Police Committee will istudy"~h~ pro- po~l and report their findings on April t-E~h. The Fire and Police Committee~met with Mr. George March, consultant retained for the preparations of the lmorove- ment o'f th~ Lincoln and Rte. 83 traffic signals. Mr. March presented a s~q~ence of steps ~o be taken in order to properly design and secure FAU f~hancing, which, if approved, ~ould q~alif~ the Viqlage for 70% financing from federal sources~ It is anticipated!that the pre- liminary pha.~e~ ~ill take until May 1, 1974, and after ~at time another report will be made by the Fire and Police Committee. JUDICIARY REPORT Trustee Richardson reported on discussions wi, th the local service station owners regarding the recent gasoline crisis and the Village efforts to solve the traffic problems and safety hazards. It was agreed that although the emergency has been somewhat allevi- ated, plans had been formulated for any~'future exigency, i.e., odd and even license p~.ate plan for serwce days, and a flag system whereby motorists would know.wnether the station iS able to supple gas, if the supply is limited to emergency vehicles only, and when the ser- vice station'is out.of gas. This program could be implemented expediently under the direction of a three'~ma~ commit~e~' formed on a ~olunteer p~an. Trustee Richardson appraised the Board on Senate Bill 2747 ~nd House Bill 124~35 regarding minimum:~'ges for local go¥~mental emoloyees-and suggested that a telegram"be sent to Representative Crane urging support of HB 12435 for a minimum wage without over- time ~rovisi~. Action was deferred until further information could be obtained. PUBLIC WORKS Public Works Committee regular meeting scheduled for March 21, 1974 was concelled. OTHER BUSINESS Trustee Gustus, seconded by Trustee Schol.ten, moved ~ for passage of Resolution No. 6-74: A RESOLUTION DIRECTING THE EXECUTION OF~A BOUNDARY ~ AGREEMENT~REGULATINGAND ~DOPTING~ THE~COM~ON~MUN- ICIPAL BOUNDARIES SOUTH~ OF GO~F ROAD BETWEEN THE CITY OF DES PL~AINES AND ~HE VILLAGE .OF MOUNT PROSPECT. Upon roll call: Ayes: Anderson Gustus Hendricks Link Richardson Scholten Teichert Motion carried. Trustee Scholten, seconded by Trsu~tee Link moved to authorize th'e mayor and Clerk and the Village Attorney ~o sign the boundary agreement attached and referred to in Resolution. No. 6-74~ Upon roll call~: Ayes.: Anderson Gustus. Hendricks Link Richardson Scholten Teichert Motion carried. March 19, 1974 Trustee Link, seconded by Trustee Hendricks, moved to authorize the Mayor, Clerk and Village Attorney to sign ~he Agreed Final Order in connec- tion with the boundary agreement, further iden- tified as No. 74L 385. Trustee Hendricks, seconded by Trsutee Richardson, moved to authorize t~e Village to accept the Plans and Specifications of Callero and'Catino's Haven Gardens subject to the inclusion of the "Standard Specifications for Water and Sewer Main Construction Tn the State of Illinois" dated~ November ,1973. Trustee Richardson, seconded by Trustee Link, moved to authorize the Village to accept the plans and speci'fications for the Lincoln Square Sub- division fubject to the inclusion of the "Stan- dard Specifications for Water and S~wer Main Construction in the State of Illinois" dated November, 1973. Upon roll call: Ayes: Anderson Gustus Hendricks Link' Richardson Scholten Motion carried. Trustee Link, seconded by Trustee Hendricks, moved to waive the rules to discuss a matter not on the agenda; namely, a petition for variation for Calle~o~& Catino for erection of a house at 1311 E. Thayer. Upon roll call: Ayes: Andersor Gustus Hendricks Link Richardsor Scholten Motion carried. The Case No. was ZBA-7-V-74 heard February 21, 1974 for a variation to ~pmmit a residence built on a setback of 29' 4 3/8" on the east and 29' 8" on the north at 1311 E. Thayer Street, due to an error in building. The Zoning Board of Appeals granted the variation and Trustee Lin~, seconded by Trsutee Hendricks, moved to concur in the decision.
