INVOCATION Trustee Minton gave the invocation. ROLL CALL Present upon roll call: Teichert Floros Hendricks Minton Rhea Richardson Wattenberg APPROVAL OF MINUTES OF REGULAR MEETING OF MAY 4, 1976 Amen~ sentence to read: "Motion f~iled because the motion required a two-third vote." Pg. 3 re Beefeater Restaurant, change word "sign" to read "restaurant". Trustee Richardson, seconded by Trustee Rhea, moved to approve the minutes of the regular meeting of M~ 4, 1976 as amended. Trustee Floros, seconded by Trustee Richardson, moved to approve the financiB} report for A~il, 1976, subject to audit. COMMUNICATIONS AND PETITIONS CITIZENS TO BE HEARD Discussion evolved a~ound the Tamarack-Palm site and a proposed compromise in the Consent Decree. Plans were presented for the approximately five acres zoned R-A which conformed with the Village codes. Mr. Joe Dvorak, 1114 S. Tamarack, stated the plan was not ac- ceptable to local residents and requested rejection of the plan as proposed. He stated the property was hazardous at this time because of dumping of refuse. Mr. Robert Bebastiani, 1829 Thornwood, also opposed the plan. Mr. Sam Paulas, 1830 Ironwood, requested rejection. Trustee Richardson, seconded By Trustee Hendr~ks, moved the matter of litigation, commonly known as ~iMucci Home Builders vs. the Village of Mount Prospect, for property at Tamarack and Palm,~be amended to compromise the Consent Decree to terminate litigation in accordance with plans identified as 74-86, drawn by Fletcher En- gineering Company for the subject property. Mr. Salvatore DiMucci, Sr. and Mr. Salvatore DiMucci, Jr. were present, and considerable discussion followed. Trustee Rhea called the question but there was no second. T~ustee Minton, seconded by Trustee Floros, moved to table the motion on the floor until the June 1, 1976 regular meeting to further review the subject. NEWLY APPOINTED FIRE LIEUTENANTS Fire and Police Commissioner Tom Leo ~resented ba~ges and swore '- in Edward Cavello and Art Felski as Fire Lieutenants in the presence of Chief Pairitz, and were commended by Commissioner Leo, the Mayor and Board of Trustees for their achievement. Kenroy, Inc. represented py Mr. Bill Dillon, appeared before the Board to request a modification to the PUD kDown as Huntington regarding Parcel 10. The ~evelopers propose a development of 214 dwelling units in a 6 story structure. Further, they request a variation concerning minimum square footage of apartments. In addition, they request signs ln- dicatin9 the name of the development aBd smaller directional signs indicating handicap parking and access, which would also require variations. The matter was referred to the Zoning Board of Appeals for a special meeting to be held June 10th, with referral Back to the Board of T~ustees for the June 15 regular meeting. The Board was casually polled and indicated agreement to the proposed variations. Mr. Joe Dvorak discussed the random dumping on the Di Mucci property at Tamarack and Palm and the metter was referred to the Village Manager. MANAGER'S REPORT The Village Manager reported an agreement with M/E & Alstot, March, and Guillou for ~omplete engineering services for "S" c~rve improvement Construction Engineering, entered into on January 11, 1974 should be modified to comply with Federal standards at no additional cost to the Village. The Village Manager concurred in the recommendation of the , Village Engineer. Trustee Floros, seconded by Trustee Richardson, moved the modified agreement be approved and the Mayor and Clerk sign and attest the document. MAYOR'S REPORT Mayor Teichert proclaimed Buddy Poppies Days May 17 and 18, 1976, in honor of the Veterans of Foreign Wars. Trustee Richardson, seconded by Trustee Wattenber9, moved to a~thorize the Village Attorney to enga§~ the services of Hartigan and Ward as o~tside counsel for representing the Village ~n the Klein Consent De:ree matter for property on Central R~d, Upon roll call: Ayes: Floros Hendricks Min~on Rhea Richardson Wattenberg Motion carried. An ordinance amending Article II of Chapter 19 of the Municipal Code relating to garbage charges for newly- annexed properties was presented, which would repeal Ordinance #2618. Trustee Wattenberg, sec6nded by Trustee Hendricks, moved for passage of Ordinance 42630: AN ORDINANCE AMENDING ARTICLE II OF CHAPTER 19 OF THE MUNICIPAL CODE Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. COMMITTEE CHAIRMENTREPORTS BUILDING COMMIttEE Trustee Minton, seconded by Trustee Hendricks, moved to concur with the recommendation of the Zoning Board of Appeals and Boilding Committee and approve the petition in Case 10-V-76 E. Williams, 322 Marcella Rd. to grant a variation to utilize a portion of the fron~ yard for park- ing of motor vehicles thereon. Emerson (Case 12-V-76) fow a 16' setback on the house and a 20' setback on the garage. Trustee M~nton, seconded by Trustee Hendricks, moved the Board concur in the recommendation of the Zoning Board of Appeals and BOilding Committee in Case 12-V-76 and grant the petitioned variations. The Zoning Board of Appeals and Building Committee recommended approval of the petition ~f J. Bobeng, 1768 Tano Lane, (Case 18-V-76) for a 30' setback variation. Trustee Minton, seconded by Trustee Hendricks, moved to concur with ~he recommendation of the Zoning Board of ~pp~and B. uilding Committee to grant the petitioned ~ariation in Case 18-V-76. The Zonin§ Board of Appeals recommended approval of a petition of Mt. Prospect State Bank for retail sales in B-2.1 District (Case 16-V-76) The Building Committee recommended the request be denied. Trustee Minton, seconded by Trustee Hendricks, moved to concur~with the recommendation of the Building Committee. ~ Upon roll call: Ayes: Floros H~ndricks Minton Rhea Richardson Wattenberg Motion carried. The Board of Appealslhad no recommendation in Case 4-SU-76. The Building Committee r~commended approval of th~ request of Little Mexico, inc. 720 River Road for a special use. Attorney Bernard F. Lee represented the petitioner. Mrs. Hazel Caravia, the adjoining property owner, spoke about the unkempt condition of the property and the possibility of fire hazard. Trustee Minton, seconded by Trustee Hendricks, moved to approve the request in Case 4-SU-76, concurring with the recommendation of the Building Committee. Trustee Minton, seconded by Trustee Hendricks,moved to table p. 4 5/18/76 the motion to June l, 1976 in order to have more time to review the matter. Prospect Bible Church, was considered by the Building Committee and a status repmmt was given. RECESS The meeting was recessed at 10:45 P.M. The Board reconvened at 11:00 P.M. Present upon roll call: Floros He~dricks Minton Rhea Richardson Wattenberg Teichert FIRE AND POLICE COMMITTEE Trustee Richardson, seconded by Trustee Minton, moved the Village Board approve the low qualified bid and authorize the Mount Prospect Library contract with J. Cotey ~n- teriors , Highland Pr~rk, Ill for $141,426.00 for furniture, to be funded by monies already allocated. Upon roll call: Ayes: Minton Rhea Richardson Teichert Nays: Floros Hendricks Wattenberg Motion carried. Trustee R~hardson, seconded by Trustee Minton, moved to approvedthe low qualified bid and authorize the Library Board to enter into a contract for purchase of Scan-Am communication system in the amount of $6,248.75, with no additional funds requested. Upon roll call: Ayes: Floros Minton Rhea Richardson Wattenberg Nays: Hendricks Motion carried. Trustee Richardson, seconded by Tmustee Minton, moved to return all bid checks to all bidders except the two low qualified bidders that were approved. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. JUDICIARY COMMITTEE The Committee will consider a conflict of inter~st ordinance at the next meeting. The Judiciary Committee considered a ~eport of the ad hoc committee re parking of recreational vehicles. OTHER BUSINESS Mr. Alter, representing Unity Ventures at the Northwest ~orner of Algonquir and Elmhurst Roads requested an ex- tension of the annexation agreement. Trustee Richardson seconded by Trustee Minton, moved to approve Resolution #21-76: A RESOLUTION DIRECTING THE EXECUTION OF ANqAMENDMENT TO A CERTAIN ANNEXATION AGREEMENT WHICH REGULATED THE ANNEX- ATION T~ THE VILLAGE OF MOUNT PROSPECT OF CERTAIN PROPERTIES GENERALL~ LOCATED NORTH OF ALGONQUIN ROAD AND WEST OF ELM- HURST ROAD The extensio~ would be for an additional five years~ or a total of ten years. Trustee Richardson, seconded by Trustee Hendricks, moved to return all bid checks except to the two low bidders. Case 24-SU-76 Special Use for Senior Citizen Housing (Dell Corp.) and the Westgate Gawden Subdivision Plat were considered. Trustee Hendricks, seconded by Trustee ~ichardson, moved to authorize the Mayor to sign and the Clerk to attest the Westgate Garden plat of subdivision subject to posting of public improvement bonds as required. Trustee Hendricks, seconded by Trustee Richardson, moved to approve the recommendation of the Zoning Board of Appeals to grant the special uses requested in Case 24-SU-76 for the Dell Corporation for senior citizens housing. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. The matter of Mount Prospect Housing Authority was referred tothe FinaNce Committee and will be eonsidered on May 27th.
