INVOCATION The invocation was given by Trustee Wattenberg ROLL CALL Present upon roll call: Krause Floros Hendricks Minton ~Murauskis Richardson Wattenberg Mayor Krause requested a deviation from the agenda in order to present the awards to local school children having won prizes in the annual Fire Prevention Week contest. The Mayor was assisted in the presentations by Public Education Officer Lonnie Jackson. APPROVAL OF MINUTES OF REGULAR MEETING, OCTOBER 4, 1977 Trustee Minton, seconded by Trustee Murauskis, moved to approve the minutes of the regular meeting held October 4, 1977. APPROVAL OF BILLS Trustee Floros, seconded by Trustee Richardson, moved --- for approval of the following bills: General $280,342.~8 - Parking System Revenue 1,052.90 Motor Fuel Tax 41,770.46 Waterworks & Sewerage Bond & Interest 34,150.00 Operation & Maintenance 57~364.82 $414.681.06 Upon roll call: Ayes: Floros Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Trustee Floros, seconded by Trustee Richardson, moved to accept the financial report of September 30, 1977, subject to audit. Upon roll call: Ayes: Floros Hendricks Minton Murauskis Richardson Wattenberg Motion carried. COMMUNICATION AND PETITIONS - CITIZENS TO BE HEARD Robert F. Moore, attorney for Henry Falstad, spoke to the Board in order to present a concept plan relative to the possible construction of three 20 story buildings in the downtown district. The proposed development would be constructed over the Northwestern railroad tracks between Pine Street and Maple Street, and would house a new commuter train station and approximately 2,000,000 square feet of office space. Pg. 1 10-18-77 Mayor Krause and Trustee Wattenberg stated that they could not give a recommendation on such a project until the petitioner had gone before the various Commissions. Trustee Floros suggested the petitioner appear before the Joint Ad-Hoc Committee, which is comprised of three different Commissions, in order to obtain further direction. George Flaherty, 319 S. George Street, spoke in opposition to high-rise buildings in the Village. Hal Predovich, Chairman of the Business District Develop- ment and Redevelopment Commission, also spoke in favor of the petitioner proceeding to the various Commissions to present their proposal. Art Braban, ll North Pine, questioned the Board relative to whether the Village holds title to the present Senior Citizen Center, formerly the Public Library, since it had been stated by the Library Board that a legal opinion was being sought by that Board as to whether they could sell that building to the Village of Mount Prospect. Mayor Krause responded that an oral agreement had been reached at the onset of the project to build a new library building and that both parties should meet that agreement. Lou Muno, 1506 Basswood, in opposition to the actions taken by the Pre. dent of the Library Board on' the possible sale of the former library building to the Village. MANAGER'S REPORT Mr. Eppley stated that the resurfacing program for 1977 had been completed. The Village Manager also stated that the "S" curve improvement was past the scheduled completion date, due to the heavy rain fall experienced, and that the asphalt was scheduled to be laid th~ week of 10/l?/??. MAYOR'S REPORT Mayor Krause requested discussion from the Board relative to the Elk Grove Rural Fire Protection and the possibility of withdrawing th~ service providence, by the Village under that contract. The subject of the costs involved not being equal to the amount of money being received from the District was discussed. Trustee Wattenberg, seconded by Trustee Murauskis, moved to authorize the Mayor to meet with the Trustees of the Elk Grove Rural Fire Protection District relative to discussing the withdra~lby the Village of Mount Prospect of fire protection seryices to that District as of December 31, 1978; as well as the implementation by the District of certain ~ax levy increases for ambulance services. Mayor Krause proclaimed the week of October 23 - 29, 1977, as 'Law Enforcement Week' and a~so proclaimed October ~l, as 'Trick or Treat Day'. The Mayor announced there would be a meeting November 5, with the Board members and members of the Business Development and Redevelopment Commission with Village merchants and owners of businesses at 9:30 A.M. in the Trustee's Room of the Village Hall. Mayor Krause also r~minded the Board and public that on October 27, 1977, at 7:~0 P.M. in the cafeteria of River Trails Jr. High, 1000 Wolf Road, a Public Works Committee me~ting would be held for the purpose of discussing the possible acquisition of the Citizens Utilities water system. Pg. 2 10-18-77 BUILDING COMMITTEE Trustee Hendricks reported on ~the Building Committee held October 12th. The first report was on ZBA 38-V-77 and ZBA 39-V-77, which were requests for re-zoning. Trustee HendrICks, seconded by Trustee Wattenberg~ moved for Board concurrence with the Zoning Board and Appeals and the Building Committee to grant the requested re-zoning in ZBA 38-¥-77. Upon roll call: Ayes: Floros Hendrtcks Minton Murauskis Richardson Wattenberg Motion carried. Trustee Hendricks, seconded by Trustee Wattenberg, moved for Board concurrence with the Zoning Board and Appeals and the Building Committee to grant the requested re-zoning in ZBA 39-V-77. Trustee Hendricks, seconded by Trustee Richardson, moved to waive the rule requiring two readings of an ordinance in ZBA Cases 38-V-77 and 39-V-77. Upon roll call: Ayes: Floros .Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Trustee Hendricks, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 2?50 (ZBA 38-V-??) AN ORDINANCE AMENDING MAP 8-S OF THE ZONING ORDINANCE Upon roll call: Ayes: Floros Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Trustee Hendricks, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 2751 (ZBA 39-V-??) AN ORDINANCE AMENDING MAP 36-S OF THE ZONING ORDINANCE Upon roll call: Ayes: Floros Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Trustee Hendricks then reported on ZBA 40-Z-?? which was also a request for re-zoning. Trustee Hendricks, seconded by Trustee Richardson, moved for Board concurrence with the recommendation of the Zoning Board of Appeals and the Building Committee to grant the requested re-zoning in ZBA 40,Z-??. Trustee Hendricks, seconded by Trustee Wattenberg, moved for passage of Ordinance.No. 2~$2 (ZBA 40-Z-77) AN ORDINANCE AMENDING MAP 9-S OF THE ZONING ORDINANCE Upon roll call: Ayes: Floros Hendricks Minton Murauskis Richardson Wattenberg Motion carried. The next case was ZBA 43-Z-77, 44-SU-77, 45-V-77, a combined case submitted by GAF Associates for property located on Northwest Highway between Evanston and Rammer. Robert D. Teichert, attorney for the petitioner, gave a presentation to the Board on the proposed project. Considerable discussion took place between the Board and the planner, developer, and architect involved with the proposed project. Trustee Hendricks, seconded by Trustee Wattenberg, moved for Board concurrence with the recommendation of the Zoning Board and Appeals and the Building Committee to grant the zoning change requested under ZBA 43-Z-77. Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: Murauskis Krause Motion carried. Trustee Hendricks, seconded by Trustee Richardson, moved for Board concurrence with the recommendation of the Zoning Board of Appeals and the Building Committee to grant the requested special use under ZBA 44-SU-77. Trustee Hendricks, seconded by Trustee Wattenberg, moved for Board concurrence with the recommendation of the Zoning Board of Appeals and the Building Committee to grant the requested variation in ZBA 45-V-??. Village Attorney Zimmermann stated the necessary ordinances would be drafted following the petitioner submitting the necessary plats of vacation and plat of subdivision. Trustee Hendricks presented the report on ZBA.48-V-?7, which was a request for a variation in order to permit a drive-in restaurant at 1900 S. Elmhurst Road. Trustee Hendricks, seconded b~ Trustee Wattenberg, moved for Board concurrence with the recommendation of the Zoning Board of Appeals and ~he Bdilding Committee to grant the requested variation. Trustee Hendricks, seconded by Trustee Minton, moved to waive the rule requiring two readings of an ordinance in ZBA ~8-V-77. Mrs. Marie Caylor, member of the Planning Commission, expressed concern relative to traffic generated by this project noting that the Planning Commission had questioned that aspect of the project. Trustee Hendricks, seconded by Trustee Wattenberg, moved for D~ssage of Ordinance No. 2753 (ZBA 48-V-77) AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 190O S. ELMHURST ROAD~ Upon roll call: Ayes: Floros Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Trustee Floros noted that only one member of the Building Committee had attended the last two meetings of that - Committee,. noting that it was not a'true reflection of a Committee's recommendation'. Mayor Krause noted that Trustee Wattenberg had been on vacation but had attended all other meetings. Trustee Minton stated the Building Committee's meeting date was in conflict with his schedule and asked that he be re-assigned to another Committee . PUBLIC HEALTH AND S~FETY COMMITTEE Trustee Richardson, Chairman pro-rem for October 13th meeting, presented that Committee's report. It was reported that the request of Ba~ KelJik, relative to relief from the ordinance requiring cleaning any one yard or larger dumpster, would present more problems if granted. Mr. KelJik decided to work .out some solution. Trustee Richardson reported that the Public Health and Safety Committee recommended-various amendments to the Traffic Code. ~ Trustee Richardson, seconded by Trustee Hendricks, moved ~ for Board concurrence with the Public Health and Safety Committee's recommendation to install a stop sign eastbound on Ardyce Lane and Westgate Road. Trustee Richardson, seconded by Trustee Hendricks, moved for Board concurrence in the recommendation of the Public Health & Safety Committee to install a stop sign on Sullivan Court at Meier Road. Upon roll call: Ayes: Floros Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Trustee Richardson, seconded by Trustee Hendricks, moved for Board concurrence in the recommendation of the Public Health & Safety Committee to remove the single stop sign at Council Trail eastbound at Albert Street and install stop signs north and southbound on Albert Street at Council Trail. Upon roll call: Ayes: Floros Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Trustee Richardson, seconded by Trustee Hendricks, moved for Board concurrence in the recommendation of the public Health & Safety Committee and specify the west side of Emerson Street from Busse Avenue 70 feet north as a passenger loading zone for the Senior Citizen Center. Upon roll call: Ayes: Floros Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Village Manager Eppley requeste~ authe~iZatien~from the Village Board to proceed with the installation of the specified signs even though the ordinance will not have been amended at that time. The Mayor and Board gave the Manager such authorization. OTHER BUSINESS The tabled motion: "To authorize the Mayor to sign and Clerk to a~est, upon approval of the Planning Commission, Village Engineer, Village Collector, and the posting of any public improvement bonds that may be necessary, relative to the Mack Cadillac Plat of Subdivision" was brought to the floor. Attorney Robert F. Moore, 350 E. Dundee Road, Wheeling, Illinois, spoke on behalf of Mr. Maude, the petitioner in this matter. Mr. Moore gave a brief history of the case and noted that since the question of whether proper notice had been given to the residents within 250' of the subject property, the petitioner will go back before the Zoning Board of Appeals October 27, 1977, to determine whether proper notice was given. Trustee Murauskis withdrew the second to the tabled motion and Trustee Minton withdrew the motion. Following the determination of the Zoning Board of Appeals, the subject plat oould be presented at the Village Board meeting scheduled for November l, 1977. COMMITTEE ANNOUNCEMENTS Trustee Floros requested the Finance Committee meeting be re-scheduled to October 26, since the Public Works Committee would he conducting a special meeting the 2?th relative to the acquisition of Citizens Utilities. Pg.~6 10-18-77 rustee Wattenberg announced that the Judiciary Committee would review the recent law suit filed by Robert D. Teichert, et al, at the next meeting of that Committee. The Public Works Committee would hold their regular meeting October 20, 1977. The subject of umbrella insurance coverage was referred to the Finance Committee. The subject of the Maplecrest area water system was referred to the Public Works Committee. Mayor Krause requested the.members.of the village Board to make every attempt to attend the October 2?th meeting to discuss the possible acquisition of Citizens Utlities water system.
