INVOCATION Trustee Richardson gave the invocation. ROLL CALL Present upon roll call: Krause Minton Murauskis Richardson Absent: Floros Hendricks Wattenberg APPROVAL OF MINUTES OF REGULAR MEETING, SEPTEMBER 6, 1977 Trustee Richardson, seconded by Trustee Murauskis, moved for ~approval of the minutes of the regular meeting held September 6, 1977. Upon roll call: Ayes: Minton Murauskis Richardson Krause Motion carried. APPROVAL OF BILLS AND FINANCIAL REPORT TrUstee Richardson, seconded by Trustee Minton, moved to approve the following bills: General $246~341.10 Parking System Revenue 1,839.59 ~-~ Motor Fuel Tax 7,187.87 Corporate Purposes Constr.1973 14,431.44 Waterworks & Sewerage Dept., Impr., & Ext. 9~096.03 Operation & Maintenance 54,561.13 $333,457.16 Upon roll call: Ayes: Minton Murauskis Richardson Krause Motion carried. Trustee Richardson, seconded by Trustee Minton, moved to approve the financial report, August 31, 1977, subject to audit. Upon roll call: Ayes: Minton Murauskis Richard'son Krause Motion carried. COMMUNICATION AND PETITIONS CITIZENS TO BE HEARD Mr. H. Friedrichs of the Mount Prospect Lions Club requested waiver of the fees involved with the October~est to be conducted by~_Dhat organization, with the exception of out- of-pocket expenses incurred by the Village Trustee Richardson, seconded by Trustee Minton, moved to waive the fees involved with the Octoberfest, with the exception of out-of-pocket expenses incurred by the Village. Upon roll call: Apes: Minton Murauskis Richardson Krause Motion carried. Pg. 1 9-20-77 MANAGER'S REPORT Village Manager Eppley presented a resolution expressing appreciation to David L. Creamer for his years of service to the Village of Mount Prospect in the Public Works Department. Mr. Creamer had tendered his resignation effective October 7, 1977, when he and his family will take up residence in California. Trustee Minton, seconded by Trustee Richardson, moved for passage of Resolution No. 35-?? A RESOLUTION OF APPRECIATION FOR THE SERVICES EXTENDED BY DAVID L. CREAMER Upon roll call: Ayes: Minton Murauskis Richardson Krause Motion carried. Mr. Eppley requested approval by the Village Board for the plans submitted for the modernization of the traffic signals at the intersection of Routes 12, 83, and Kensington Road. Trustee Minton, seconded by Trustee Richardson, moved to approve the plans, as submitted, for the traffic signal modernization at the intersection of Routes 12, 83 and Kensington Road. Upon roll call: Ayes: Minton Murauskis Richardson Krause Motion carried. Mr. Eppley announced that official tabulation had been received from the Bureau of the Census stating that the population in the Village of Mount Prospect as of July 5, 1977, was 51,974. Mr. Eppley noted that permission had been granted by the State of Illinois to install some smaller population numerals, i..e. 52,000, to be installed on the existing population signs within the Village The Stengren Corner Subdivision plat was presented to the Board for approval, having been approved by the Plannin~ Commission and recommendation from the Director of Building and Zoning. Trustee Richardson, seconded by Trustee Minton, moved to authorize the Mayor and Clerk to sign the Stengren Corner plat of subdivision. Upon roll call: Ayes: Minton Murauskis Richardson Krause Motion carried. Village Manager Eppley requested Board concurrence with his recommendation to allow those service stations in the Village wishing to convert to self-serve areas to do so while the necessary re-zoning procedures are being accomplished, with certain requirements including the $50 fee. The Board voiced no objections ~to the recommendation. MAYOR'S REPORT Mayor Krause presented a Certificate of Merit to Trustee Norma Murauskis for her service as Chairman of the Blood Program for the Village of Mount Prospect. Trustee Minton was presented a card from the Village Board and Administration upon the birth of Mr. & Mrs. Minton's first baby. Pg. 2 9-20-77 Mayor Krause proclaimed the waek of October 9 through 15, 1977 as Fire Prevention Week. Upon second reading, Mayor~'Kr~6se ~esented an ordinance providing for procedures for advisory referenda for passage. Trustee Richardson, seconded by Trustee Minton, moved for waiver of the rule requiring two readings of an ordinance. Upon roll call: Ayes: Minton Murauskis Richardson Krause Motion carried. Trustee Hendricks arrived at 8:29 P.M. Trustee Murauskis, seconded by Trustee Minton, moved for passage of Ordinance No. 2746 AN ORDINANCE RECODIFYING CHAPTER 8 OF THE MUNICIPAL CODE Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Krause Motion carried. COMMITTEE REPORTS BUILDING COMMITTEE Trustee Hendricks reported that ZBA Case No. 26-SU-77, 501 West Golf Road, had been withdrawn by the petitioners. It was reported that the Building Committee had h~eard ZBA Case No. 36-V-77, 500~West Northwest Highway, wherein the petitioner requested a variation from the off-street parking-requirements. Trustee Hendricks, seconded by Trustee Richardson, moved for Board concurrence with the recommendation of the Zoning Board of Appeals and Building Committee to grant the requested variation. Upon roll call: Ayes: Hendricks Minton Murauskis Riehardson Motion carried. Trustee Hendricks, seconded by Trustee Minton, moved to waive the rule requiring two readings of an ordinance (ZBA 36-SU-77) Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Motion carried. Trustee Hendricks, seconded by Trustee Minton, moved for pass~ge of Ordinance No. 2747 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 500 WEST NORTHWEST HIGHWAY Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Krause Motion carried. It was reported that the petitioner in ZBA Cases 38-V-77 and 39-V-77 was not present at the Committee meeting and those cases will be heard at the October meeting of the Building Committee. Pg. 3 9-20-77 Trustee Hendricks reported that a letter had been received from the petitioner in ZBA Case No. 19-SU-77 requesting that case be withdrawn and consider the matter closed. Trustee Hendricks reported that ZBA Case No. 35-V-77 would have to readvertise due to insufficient legal notice after which the Zoning Board of Appeals will re-hear the case. The Building Committee, subject to the Zoning Board of Appeals re-hearing the case, did recommend granting the requested variation. FINANCE COMMITTEE It was noted that Don's Fish Market's request for a 4:00 A.M. liquor license would be reported out by the Committee at the October 18th Village Board meeting, pursuant to the request of the petitioner. PUBLIC HEALTH AND SAFETY COMMITTEE Trusteee Murauskis reported that the Committee reviewed the Elk Grove Rural Fire Protection District contract nbting that the lack of adequate water supply and the need to upgrade the fire prevention codes was of concern to the Committee members. She noted that Mayor Krause has scheduled a meeting with the property owners involved and the Public Health & Safety Committee would make a recommendation subject to that meeting. Trustee Murauskis, seconded by Trustee Richardson, moved for Board concurrence with the recommendation of the Public Health & Safety Committee to place certain no-parking restrictions on Nordic Road. Village Attorney Zimmermann stated that when that parcel was annexed to the Village, certain Restrictive Covenants were adopted, one of which prohibited parking on Nordic Road. Trustee Richardson withdrew his second and Trustee Murauskis withdrew her motion. Trustee Murauskis, seconded by Trustee Richardson, then moved to prohibit parking on Nordic Road for the entire Jurisdiction. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Motion carried. Trustee Murauskis, seconded by Trustee Minton, moved for Board concurrence with the recon~mendation of the Public Health & Safety Committee and serve notice on Browning- Ferris that the Village would not be picking up the renewal option on the scavenger service contract, so that the ~ contract will terminate July 31, 1978. Mr. Ralph Arthur, 14 W. Hiawatha and Ed Miller, 131 S. Kenilworth, spoke to the Board in oppesition to .~ terminating the contract.with Browning-Ferris noting that the service offerred by that company was excellent. Mayor Krause pointed out that upon termination of the contract,bids would be taken from ~nterested scavenger services at whfch time Browing-Ferris could enter a new bid. Mayor Krause called the motion for a vote. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Motion carried. Pg. 4 9-20-77 PUBLIC WORKS COMMITTEE .~. Trustee Richardson noted that the Public Works Committee did discuss the possible acquisition of the Citizens Utilities Company. Further discussion on this subject will take place at later dates. Trustee Richardson, seconded by Trustee Minton, moved for Board concurrence with the Public Works Committee's recommendation in favor of the Flood Plain Ordinance proposed by the.Drainage and Clean Streams Commission and endorsed by the Illinois Department of TranSportation. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Motion carried. Trustee Richardson, seconded by Trustee Hendricks, moved for a waiver of the rules to bring an item on the agenda that was not listed. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Motion carried. Trustee Richardson, seconded by Trustee Minton, then moved to waive the rule requiring two readings of an ordinance. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Motion carried. Mr. Bill Reinert, Chairman of the Drainage and Clean Streams Commission, urged the passage of this Ordinance. Trustee Richardson, seconded by Trustee Minton, moved for passage of Ordinance No. 2748 A FLOOD PLAIN ORDINANCE ADOPTING REGULATIONS FOR THE CONSTRUCTION, SUBSTANTIAL IMPROVEMENT, SUB- DIVISION OF LAND, PLACEMENT OF MOBILE HOMES OR OTHER DEVELOPMENT IN THE VILLAGE OF MOUNT PROSPECT. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Motion carried. OTHER BUSINESS Village Attorney Zimmermann requested the proposed ordinance amending the Traffic Code, presented for second reading, be amended to reflect the change discussed earlier relative to Nordic Road. Trustee Richardson, seconded by Trustee Minton, moved to amend the draft ordinance to include no parking on Nordic Road, east and west side, entire Jurisdiction. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Motion carried. Trustee Richardson, seconded by Trustee Minton, then moved for passage of Ordinance No. 2749 Pg. 5 9-20-77 AN ORDINANCE AMENDING THE.TRAFFIC CODE Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Motion carried. ITEMS TO BE REFERRED The subject of real estate transfer tax was referred to the Finance Committee Village Manager Eppley requested the acquisition of the southeast corner of Maple and Prospect Avenue be referred to the Public Works Committee. The appraisal has been acquired and further study was suggested as to whether the Village should proceed to acquire that property. COMMITTEE ANNOUNCEMENTS The Building Committee announced the next meeting would be held October 12th. The Public Health and Safety Committee stated that meeting would take place October 13th. The Public Works Committee would hold their next meeting October 20th. ADJOURNMENT Trustee Minton, seconded by Trustee Richardson, moved to adjourn the meeting.
