INVOCATION Trustee Richardson gave the invocation. ROLL CALL Present upon roll call: Krause Hendricks Minton Murauskis Richardson Wattenberg Absent: Floros APPROVAL OF MINUTES Correction on Page 7: Roll call on tabled motion should read: Ayes: Floros Murauskis Nays: Hendricks Minton Richardson Wattenberg. Trustee Wattenberg, seconded by Trustee Richardson, moved for approval of the minutes of the regular meeting held May 17, 1977, with the correction noted. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Motion carried. APPROVAL OF MINUTES OF SPECIAL MEETING, MAY 31, 1977. Trustee Richardson, seconded by Trustee Rendricks, moved for approval of the minutes of the special meeting held May 31, 1977. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Motion carried. RATIFICATION 'OF ACTION TAKEN AT SPECIAL MEETING, MAY 31, 1977 Trustee Richardson, seconded by Trustee Hendricks, moved to ratify the action taken at the special meeting held May 31, 1977. Pg. 1 6-7-77 COMMUNICATIONS AND PETITIONS - CITIZENS TO Mr. Cy Wagner, Commissioner of NIPC, addressed the Board as to the activities of that organization i~ an effort to secure continued finanoial support by the Village of Mount Prospect. Following the presentation and discussion relative to land use and housing, Mayor Krause expressed the intent of the Board of Trustees to continue to support NIPC financially. Richard Nogawski, 110 Bobby Lane, requested i~formation regarding Mr. Muldowney's report relative to the water study being conducted. Mr. Eppley noted that he would be discussing that subject under 'Manager's Report' later in the meeting. MANAGER'S REPORT Village Manager Eppley announced,that the water rate study undertaken by Mr. Muldowney would be delivered to the Board the next day (June 8th), for discussion at the regular meeting of the Board June 21, 1977. Irene Steffen, 218 S. William, addressed the Board in regard to the minimum water usage rate inasmuch as some senior citizens do not use the minimum 10,000 gallons but are charged for the minimum. Mr. Eppley requested authorization of the Board to have the Well #14 property appraised and 0ffered for sale with the proceeds to go into the water fund. Trustee Richardson, seconded by Trustee Wattenberg, moved to. authorize the Well #14 property to be appraised and sold with the proceeds to go into the water fund. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Mr. Eppley requested the Board to accept the low bid of M & A Cement Work, Inc., of $23,728.50 for sidewalk repair work, The bid was accepted. Mr. Richard Nogawski, 110 Bobby Lane, requested guidance from the Board as to whether the sidewalk in his area would be repaired by the Village if it was determined that the construction was faulty due to builder error. Mayor Krause suggested Mr. Nogawskf acquire a legal opinion from his attorney since that would be a legal matter not under the Village's Jurisdiction. Mr. Eppley noted that the "S" curve improvement would be commenced June 13, if the Resolution accepting the low bid from Milburn Bros. was passed. Trustee Wattenberg, seconded by Trustee Minton, moved for passage of Resolution No. 21-77 A RESOLUTION CONCURRING IN THE ACCEPTANCE OF THE APPARENT LOW BIDDER "S" CURVE IMPROVEMENT Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Motion carried. The Village Manager noted that the Village Engineer had prepared a map showing where parking would be provided for the residents affected by the proposed improvement. Richard Nogawski, 110 Bobby Lane, requested some informaticn relative to the history of the "S" curve. TrusTee Minton invited Mr. Nogawski to call his office for further discussion on that subject. Pg. 2 6-7-.77 Trustee Wattenberg, seconded by Trustee Minton, moved to approve the engineering plans at Route 83 and 0akron, Colony Shopping Center. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Village Manager Eppley announced that census takers are being recruited £or the upcoming census. Mr. Eppley also distributed maps indioatihg the streets that are to be resurfaced using MFT funds, and the latest report from Share + 3 Executive Committee. MAYOR'S REPORT Mayor Krause proclaimed June 10 13 as MOUNT PROSPECT BASEBALL ASSOCIATION THILLENS DAY WEEKEND. Mayor Krause requested concurrence With her appointment of Lois Brothers, 1102 W. Lincoln, to the Zoning ~oarm of Appeals, which term would expire May 1, 1981. Trustee Murauskis, seconded by Trustee Wattenberg, moved to concur with the Mayor's appointment of Lois Brothers to the Zoning Board of Appeals. Upon roll call: Ayes: Hendricks Minton Muraus~is Richardson Wattenberg Motion carried. Mayor Krause requested concurrence with her appointment of Tom O'Connor, 1515 E. Lowden Lane, to the Zoning Board of Appeals, which term would expire May 1, 1980. Trustee Richardson, seconded by Trustee Hendricks, moved to concur with the appointment of Tom O'Connor to th~ Zoning Board of Appeals. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Mayor Krause requested concurrence with her appointment of Charles Bennett, 403 N. Pine, to the Board of Health. Trustee Murauskis, seconded by Trustee Richardson, moved to concur With the appointment of Charles Bennett to the Board of Health. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Mayor Krause requested concurrence with her appointment of Ron Wajer, 1513 Mura Lane, to the Business District Development and Redevelopment Commission, which term would expire May l, 1981. Trustee Wattenberg, seconded by Trustee Richardson moved to concur with the appointment of Ron Wajer to the Business District Development and Redevelopment Commission. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Mayor Krause requested concurrence with her appointment of Paul Christoffersen, 1204 W. Busse Avenue, to the Insurance Commission, which term would expire May l, 1979. Trustee Murauskis, seconded by Trustee Richardson, mcved to concur with the appointment of Paul Christoffersen to the Insurance Commission. Upon roll call: Ayes: Hendrieks Minton Murauskis Richardson Wattenberg Motion carried. Mayor Krause presented an Ordinance Amending the Building Code, relative to requiring automatic car washing facilities to have water recycling equipment, for first reading. __ COMMITTEE REPORTS BUILDING COMMITTEE Trustee Hendricks, Chairman of Building Committee, requested a waiver of the rules to consider a matter not on the agenda, relative to ZBA Case 13-V-77. Trustee Wattenberg, seconded by Trustee Richardson, moved to waive the rules to consider a matter not on th~ agenda. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Trustee Hendricks, seconded by Trustee Wattenberg, moved to waive the rule requiring two reading of an ordinance. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Trustee Hendricks, seconded by Trustee Wattenberg, moved -- to pass Ordinance No. 2715 AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR PROPERTY ~OMMONLY KNOWN AS 601 W. CARBOY ROAD Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Krause Motion carried. Trustee Wattenberg noted that it was his Opinion that it should not be necessary for a petitioner requesting an air conditioner variation to have an attorney represent him and that court reporters should not be necessary for this type of case. PUBLIC SAFETY COMMITTEE Trustee Richardson noted the streets that are scheduled to be resurfaced, also..~hat he would like to see curbs installed where there had been no curb in the past. Village Engineer, Ben Hemmeter, stated that no plans have been made to install curbs at this time. Trustee Richardson, seconded by Trustee Wattenberg, moved to approve t~s projects as submitted by the Village Engineer. Pq, 4 6-7-77 OTHER BUSINESS Trustee Richardson, seconded by Trustee Murauskis, moved for passage of Resolution No. 22-77 A RESOLUTION TO RENEW THE TRAFFIC CONTROL AGREEMENT WITH RANDHURST CORPORATION Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Trustee Murauskis, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 2716 AN ORDINANCE AUTHORIZING THE ACQUISITION OF CITIZENS UTILITIES COMPANY OF ILLINOIS SEWER & WATER SYSTEM LOCATED IN AND NEAR THE NORTHEAST SECTION OF THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Krause Motion carried. Trustee Wattenberg stated that the citizens of that area will be given an opportunity of vote on the issue at a later date. Trustee Richardson noted what was determined as an error in the Account 233, following interpretation of the transfer by the Finance Director, it was determined that the resolution was correct as submitted. Trustee Richardson, seconded by Trustee Hendricks, moved for passage of Resolution 23-77 A RESOLUTION MAKING CERTAIN APPROPRIATION TRANSFERS WITHIN THE ANNUAL BUDGET ADOPTED FOR FISCAL 1977-78 Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattsnberg Motion carried. Trustee Richardson, seconded by Trustee Minton, moved to authorize the Mayor to sign and Clerk to attest the Arthur Street Dedication (Illinois Bell property) Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Trustee Richardson, seconded by Trustee Wattenberg, moved to authorize the Mayor to sign and Clerk to attest the Richmond Subdivision Plat, subject to posting of necessary improvement bonds. Upon roll call: Ayes: Hendricks Minton Murauskis Motion carried. Richardson Wattenberg Trustee Richardson, seconded by Trustee Wattenberg, moved to authorize the Mayor to sign and Clerk to attest the Tree Farm Estate Subdivision Plat, subject to restrictive covenants and posting the necessary improvement bonds. Pg. 5 6-7-77 illage Attorney Zimmermann gave a presentation to the Board relative to Federalism of the unemployment compensation program. The National Institute of Municipal Law Officers is instutiting a law suit challenging the constitutionality of the Unemployment Compensation Act of 1976 and Mr. Z±mmerman~ through his presentation, encouraged the Village of Mount Prospect to involve itself in this law suit and contribute $2,500 towards the costs of this suit. Trustee Wattenberg, seconded by Trustee Minton, moved ~o authorize the Mayor and Village Attorney to sign the necessary documents involved with this pending litigation and authorize an expenditure of $~500 towards this litigation. COMMZTTEE ANNOUNCEMENTS Public Health and Safety Committee meeting scheduled for June 9th was cancelled by the Chairman, Trustee Murauskis. Trustee Minton cancelled the Fire & Police Committee meeting due to the fact he would be out of town. Trustee Wattenberg announced that the Judiciary Committee would meet June 13~h, as scheduled.
