INVOCATION The invocation was given by Trustee Farley. ROLL CALL Present upon roll call: Mayor Krause Trustees Farley Floros Miller Murauskis Richardson Wattenberg APPROVAL OF MINUTES Trustee Murauskis, seconded by Trustee Wattenberg, moved to approve the minutes of the regular meeting of the Mayor and Board of Trustees held May 1, 1979. Trustee Murauskis, seconded by Trustee Wattenberg, moved to approve the minutes of the special meeting of the Mayor and Board of Trustees held May 8, 1979. Trustee Murauskis, seconded by Trustee Floros, moved to ratify the action taken at the special meeting May 8, 1979. Upon roll call: Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Nays: None Motion carried. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD ~--~ The four finalists in the Lowell J. Fell Scholarship, sponsored by the Mount Prospect Kiwanis Club, gave presentations on their experiences after having spent a day in a department of the Village. The four finalists were: John Blanford 105 W. Lonnquist BIvd. Roger Kruse 16 N. Edward Street Kathy Chumachenko 501 S. Louis Street Francis Troppe 1407 Ironwood Drive Mr. Merrill Cotten~ 2710 Briarwood Drive West, stated that the proposed Davey Tree development plans to connect to the sanitary sewer system presently utilized by the Lake Briarwood area, and requested the Board and administration look into the problem of a possible over-load on that system, prior to final approval of the engineering plans. Mr. Cotten requested STOP signs be replaced on the east side of Arlington Place that were knocked down during the winter. Also, Mr. Cotten requested that a study to be conducted as to the possibility of installing STOP signs at Briarwood Drive at the exit of Briarwood Plaza. At Mr. Cotten's request, a copy of these minutes will be forwarded to Mr. Cotten. MANAGER'S REPORT At the request of the Mayor, Village Manager Burghard brought up an item under his report, the balance of that report would be discussed later in the meeting. Mr. Burghard presented a request received from the Reorganized Church of Je~us Christ Of Latter Day Saints, 123 S. Busse Road, to waive the permit fees involved with the proposed expansion of that Church. Mr. Burghard noted that problems had been experienced in the past with such a policy since the Village would have no course of follow up on contractors completing the jobs satisfactorily or on a timely basis. Trustee Richardson, seconded by Trustee Wattenberg, moved to establish a policy to govern not-for-profit organizations, whereby the usual bonds and fees would be submitted to the Village to be held pending completion of the project, after which time the fees and bonds would be returned. ZBA 11-V-79, Ni-Gas Property The following residents spoke in 0PP~ositio~ to the Board passing an ordinance granting specified variatiOns for the proposed Kensington Center development located on !h~ ~e~i~lY..3.0 acres of the Ni-Gas Property: Mr. O'Shaunessy, 1204 Greenwood Kathleen Simons, 803 E. Ironwood Drive Joan Carol, 1116 Crabtree Lane Mary Stembridge, 600 Greenwood Don Rabb, 904 Westgate, and Miss Nipper, 1216 E. Meadow Lane, spoke in favor of the proposed project. Trustee Miller, seconded by Trustee Murauskis, moved for passage of Ordinance No. 2909 AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR PROPERTY COMMONLY KNOWN AS THE "NI-GAS PROPERTY" Upon roll call: Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Krause Nays: None Motion carried. Trustee Richardson, seconded by Trustee Murauskis, moved to authorize the Mayor to sign and Clerk to attest her signature on the Kensington Center plat of Subdivision. PAGE 3 5/15/79 COMMITTEE REPORTS BUILDING COMMITTEE Trustee Floros, seconded by Trustee Richardson, moved to waive the rules in order to discuss an item not listed on the agenda (ZBA 66-V-78) Upon roll call: Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Nays: None Motion carried. ZBA 66-V-78, 2024 Wintergreen Trustee Floros, seconded by Trustee Murauskis, moved to concur with the recommendation of the Building Committee and Zoning Board of Appeals and grant the requested variation to allow the construction of a detached garage on the subject property. Upon roll call: Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Nays: None Motion carried. An ordinance reflecting the subject variation for 2024 Wintergreen would appear on the June 5th agenda of the Village Board. Trustee Floros presented the Finance Committee's Report of the April 17, 1979 meeting. The matter of selecting auditors for fiscal 1977-78 had been discussed in Committee, however, the Board had authorized the firm of Lester Witte & Company, as recommended by the Finance Committee, at the May 1st meeting. Trustee Floros, seconded by Trustee Richardson, moved to create a Class "R" liquor license to be issued to the new owners of Heinz Cafe, 15 W. Prospect Avenue. Trustee Floros, seconded by Trustee Farley, moved to create a Class "W" liquor license to be issued to Olympus Gyros Restaurant, Northwest Highway & Central Road. Trustee Floros, seconded by Trustee Richardson, move~l to create a Class "R" liquor license for the restaurant located at 208 E. Rand Road, which will be re-opening under new ownership. The subject of commerical development bond financing support, requested by K-Mart for a proposed store to be located at the Mount Prospect Plaza, was continued in the Finance Committee. PAGE ~ 5/15/79 FIRE AND POLICE COMMITTEE NO Report. LEGISLATIVE/JUDICIARY COMMITTEE No report. PUBLIC HEALTH AND SAFETY COMMITTEE Trustee Murauskis, seconded by Trustee Richardson, moved for passage of Ordinance No. 2910 AN ORDINANCE AMENDING THE TRAFFIC CODE Upon roll call: Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Nays: None Motion carried. Trustee Murauskis presented the April 23, 1979 report of the Public Health and Safety Committee meeting. Trustee Murauskis, seconded by Trustee Richardson, moved to concur with the recommendation of the Public Health and Safety Committee to amend the Traffic Code as follows: a. Section 18.1320 A (2) to delete the northside of Henry between Main and Wille b. Section 18. 1317 Schedule VIII to include "No Parking 7 a.m. to 6 p.m., Monday thru Friday for the northside. of Henry between Main and Wille. Trustee Murauskis, seconded by Trustee Richardson, moved to concur with the recommendation of the Public Health and Safety Committee to amend the Traffic Code to include "No Left Turn from Northwest Highway onto Forest Avenue 7 a.m. to 9 a.m. 7 days a week". Ordinances reflecting the above Traf~c Code amendments would be presented for 1st reading at the June 5th meeting of the Board. At the request of the residents in the area of the Citgo Station, Northwest Highway and Henry between Fairview and Forest Avenue, the Public Health and Safety Committee directed the administration ,'-' to contact the owners of the subject station relative to the fence and ~ creating better visibility. ' The following subjects were continued in the Public Health and Safety Committee: a. Amendments to the taxicab ordinance; b. Towing and Snow Removal ordinance; e. Bicycle Safety PUBLIC wORKs COMMITTEE No report. PAGE 5 5/15/79 OTHER BUSINESS Trustee Richardson, seconded by Trustee Murauskis, moved to authorize the Mayor to sign and Clerk to attest her signature on the Boesche's Plat of Resubdivision. Upon roll call: Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Nays: None Motion carried. MANAGER'S REPORT Village Manager Burghard continued with the Manager's Report. Mr. Burghard presented the following bids received for the 50/50 sidewalk replacement program: D'Addosio Construction Co. $44,890.00 Schiller Park, Illinois M & A Cement Work, Inc. $41,230.-00 Itasca, Illinois Mr. Burghard announced that since the bids received exceeded the budgeted amount for the replacement program, it was his recommendation that the Board accept the low bid submitted by the square foot, which was $2.45 sq. ft. Trustee F~rley, seconded by Trustee Richardson, moved to accept the low bid submitted by M & A Cement at $2.45 sq. ft. for the 50/50 sidewalk replacement program. Mr. Burghard introduced Ken Fritz, the new Director of Community Development, noting that Mr. Fritz would begin employment with the Village on May 21, 1979. The Village Manager requested direction from the Board relative to a letter received from the Mount Prospect Park District wherein they stated that if the Village of Mount Prospect would grant a permit for fireworks, the Mount Prospect Park District would grant permission for the July 4th fireworks display to be conducted by the Lions Club. Discussion took plac~ as to the safety factors involved with such a fireworks display, such as access to the homes in the area by emergency vehicles., liability insurance in favor of the Village and Park District. Trustee Floros, seconded_by Trustee Farley, moved to authorize the issuance of a firework display permit for the July 4th celebrations to be conducted by the Mount Prospect Lions Club, subject to liability insurance being secured in favor of the Village of Mount Prospect and the Mount Prospect Park District; that additional safety measures be taken by the administration to seal off the immediate area from parked cars; and that 1979 would be the last year that such a display would be allowed, at that location. PAGE ~ 5/15/79 Mr Burghard then requested direc~t.!on frpm the Board as to a request received from School D~str~ct 214 MUslC Department requesting permission to hold a Musical Program around the Gazebo during the summer months. This matter was referred to the Public Health and Safety Committee for further review. ITEMS TO BE REFERRED The following items were referred to the Building Committee: ZBA 17-Z-79 and ZBA 18-V-79, Southwest corner of Grove & Golf ZBA 19-V-79, 709 Chris Lane ZBA 20-V-79, 205 S. Louis ZBA 21-V-79, 1000 W. Central Road These cases would be reported out at the June 5th Board meeting. COMMITTEE ANNOUNCEMENTS The following Committee meetings dates were announced: Building Committee June 11, 1979 Finance Committee June 13 Fire and Police Committee June 25 Legislative May 17 Public Health & Safety Committee May 24 Public Works Committee June 7 The Village Board went into Executive Session at 11:18 for the purpose of discussing litigation. Mayor Krause reconvened the meeting at 11:29 P.M. Present upon roll call: Mayor Krause Trustees Farley Floros ~-~ Miller Murauskis Richardson Wattenberg Trustee Wattenberg, seconded by Trustee Farley, moved to authorize the law firm of Burke and Burke to file a Notice of Appeal in the law suit Village of Mount Prospect et al vs. M.S .D., following the ruling by Judge Sullivan's Order, for attorneys fees not to exceed $$,000 and court costs $500. . Upon roll call: Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Nays: None Motion carried. Trustee Farley, seconded by Trustee Murauskis, moved to adjourn the meeting.
