AND BOARD OF TRUSTEES
March 20, 1979
CALL TO ORDER
Mayor Krause called the meeting to order at 8:06 P.M.
The Sing-A-Long Bluebirds posted the Colors and then presented cupcakes
to the elected officials.
INVOCATION
Thee invocation was given by Trustee Wattenberg.

Mayor Krause proclaimed the week of March 18 thru 24, 1979, as
Camp Fire Week.
APPROVAL OF MINUTES
Trustee Floros, seconded by Trustee Richardson, moved to approve
the minutes of the regular meeting of the Board held March 6, 1979.

APPROVAL OF BILLS AND FINANCIAL REPORT
Trustee Floros, seconded by Trustee Murauskis, moved to approve

COMMUNICATIONS AND PETITIONS ' CITIZENS TO BE HEARD
None.
MANAGER'S REPORT
Village Manager Burghard presented his report.
The first item was an amendment to the Mutual Cooperation Agreement to
allow Rolling Meadows to be included with Arlington Heights, Elk Grove
{fil. lage, and Mount Prospect in a reserve apparatus agreement.

Trustee Wattenberg, seconded by Trustee Richardson, moved to authorize
the Mayor to sign and Clerk to attest her signature on the addendum on
the Agreement Approving Mutual Cooperation Between the Fire Departments'
of Arlington Heights, Mount Prospect, 8_nd Elk Grove Village (Reserve
Fire Appartus) originally entered into May, 1978.

Trustee Minton arrived at the meeting.
An Ordinance Establishing the Office of Community Development had its
first reading, with the 2nd reading to take place April 4th.
MAYOR'S REPORT
Mayor Krause proclaimed the Week of April i - 7, 1979, as Mount
Prospect Library Week.
Mayor Krause gave a status report on the Braien Townhouse Association
Settlement stating that the developer had agreed not to construct the
building in question, being that it was within 5 feet of the swimming pool
belonging to the Bralen Association, and that Association had filed a
law suit opposing the construction. It was announced that the
developer would fill in the already poured foundation and sod would be
planted over that area.
Mr. George Van Geem, President of the Bralen Townhome Association
expressed appreciation to the Mayor and Board for their cooperation.
Mayor Krause requested Board discussion on the proposed contract
to retain John Zimmermann as counsel to the Village over the next
year in order to handle various continuing items, as discussed during
the March 6th meeting of the Board.
Following discussion, Trustee Hendricks, seconded by Trustee
Minton, moved to authorize the Mayor to sign and Clerk to attest her
signature on the letter of memorandum of agreement dated March 20, 1979,
a copy of which letter shall be attached to the minutes of this meeting.

Mayor Krause announced the resignation of Bob Teepe as the DAMP
Commissioner from Mount Prospect and requested Board concurrence
in the appointment of James Soyt~a, 1715 Carib Lane, to fill that
vacancy, with an indefinite term.
Trustee Wattenberg, seconded by Trustee Murauskis, moved to
appoint James Soyka as Commissioner to DAMP.

COMMITTEE REPORTS
With the concurrence of the Board, Mayor Krause moved up the
Fire and Police, and Public Worl<s Committee reports.

FIRE AND POLICE COMMITTEE
Trustee Minton, seconded by Trustee W~tienberg, moved to bring
to the floor the motion tabled at the March 6th meeting "to concur
with the recommendation of the Fire and Police Committee and keep
the drinking age at 19."

concurrence with the recommendation of the Fire and Police Committee
to keep the drinking age at 19 .

Ken Voss spoke in favor of allowing consumption on premises, but
restricting the purchase of package liquor to 21 year olds.
Trustee Floros, seconded by Trustee Murauskis, moved to raise the
age for purchasing packaged liquor, and consumption on premises,
to 21 years of age.

An Ordinance amending Chapter 13 to reflect the preceeding motion
would be presented for Board approval April 4th.
PUBLIC WORKS COMMITTEE
A Public Hearing was held on the proposed acquisition of the
Prospect Meadows Water Company.
Assistant Village Manager Geick gave a brief history of the subject
water company and subdivision it serves, noting that the purchase
price was negotiated to $75,000 with $120,000 for improvements to
the system. This cost would be assumed by the residents of the
Prospect Meadows Subdivision at $2.00 per $100.00 equalized assessed
evaluation over a 20 year period, if approved by the residents.

Following the questions and answer session, the public hearing was
declared closed.

BUILDING COMMITTEE
Trustee Hendricks presented the Building Committee report of the
March 14, 1979 meeting.
ZBA 2-Z-79 and ZBA 3-V-79, 3015 Lynn Court
Trustee Hendricks, seconded by Trustee Wattenberg, moved to concur
with the recommendation of the Building Committee and Zoning Board
of Appeals and grant the rezoning and variations requested under ~-~
cases ZBA 2-Z-79 and ZBA 3-V-79.

An Ordinance Amending Map 37-S of the Zoning Ordinance and An
Ordinance Granting Certain Variations for Property Commonly Known
as 3015 Lynn Court had their first readings.
ZBA $3-Z-78 and ZBA 84-V-79, 2013 Euclid
Trustee Hendricks, seconded by Trustee Wattenberg, moved to
concur with the recommendation of the Building Committee and
grant the requested rezoning and variations.
Since the Zoning Board of Appeals had recommended denial of the
requested rezoning, the Board asked to be supplied a full transcript
of that hearing so all details were known on the subject cases.
Trustee Hendricks, seconded by Trustee Richardson, moved to
table the motion until the Board had a chance to review the facts
as presented in the Zoning Board of Appeals report.

concur with the recommendation of the Zoning Board of Appeals
and the Building Committee and grant the requested rezoning in
ZBA 5-Z-79.

Mr. Haas, attorney for the petitioner, requested a waiver of the
rules for two readings of an ordinance in the subject cases.

ZBA §-Z-79 and ZBA 6-V-79.

PROPERTY COMMONLY KNOWN AS 11 SOUTH EMERSON
STREET

Trustee Hendricks, seconded by Trustee Richardson, moved to
authorize the Mayor to sign and Clerk to attest her signature on
the Mount Prospect State Bank Plat of Resubdivision, Unit #3,
provided thai before any such signature, any and all bonds for,
public improvements are posted with the Village of Mount Prospect.

An Ordinance Adopting Amendments to the Building Code and
Deleting Portions of the Building Code had its first reading. Second
reading of this ordinance will take place April 4th.
FINANCE COMMITTEE
An Ordinance Limiting the Time Within Which the Salaries of
Elected Officials May Be Amended had its first reading, second reading
will take place at the April 4th meeting of the Village Board.
JUDICIARY COMMITTEE
No report.
PUBLIC HEALTH AND SAFETY COMMITTEE
In Trustee Murauskis' absence, Trustee Richardson presented
the Committee report of the February 22nd meeting.
Trustee Richardson, seconded by Trustee Hendrieks, moved to concur
with the recommendation of the Public Health and Safety Committee
to amend Sections 18. 1320 and 18. 1315 of the Traffic Code to reflect
parking restrictions on south Pine Street and Milburn Avenue.

Trustee Richardson, seconded by Trustee Hendricks, moved to
concur with the recommendation of the Public Health and Safety
Committee to remove the STOP signs at Connie and Audrey Lanes
and replace them with YIELD signs; and to remove the STOP signs
at Wheeling Road and Cedar Lane.

Committee to exclude Saturdays, Sundays, and legal holidays from
the 2-hour parking restriction in residential areas.

An ordinance reflecting the above amendments to the Traffic Code
· would be presented for first reading at the next regular meeting of

TRAFFIC CODE

An Ordinance Amending Article II of Chapter 19 of the Municipal
Code would be presented for approval, following changes, at the
April 4th meeting of the Village Board.
OTHER BUSINESS

accept the engineering plans for the Algonquin-Dempster Subdivision
(Davey ~ree Property).

Trustee Richardson, seconded by Trustee Wattenberg, moved to
authorize the Mayor to sign and Clerk to attest her si~_nature on ._
the Easement Agreement by and between the Villag~ of Mount Prospect
and Commonwealth Edison across the property which is owned by
Commonwealth Edison Company, south of Algonquin Road and adjacent
to the Davey Tree Property.

authorize the Mayor to sign and Clerk to attest her signature on the

Trustee Richardson, seconded by Trustee Floros, moved to authorize
the Village Manager to appoint a prosecutor to handle the prosecution
fo'.,' the Village, and to begin preparing an agreement with Ross, Hardies,
O'Keefe, Babcock and Parsons to be retained as Corporate counsel,
which agreement will be presented to the Board for approval by the
l~oard at a later date.

COMMITTEE ANNOUNCEMENTS

FOR INFORMATION ONLY
It was announced that the next meeting of the Mayor and Board of
Trustees would be April 4th, since the regular meeting date was that
of the Village Election.
EXECUTIVE SESSION
An executive session was called at 12:20 A.M.. for the purpose of
discussing land acquisition - Senior Citizen Housing Site.
The meeting was reconvened at 12:54 A.M.
