INVOCATION The invocation was given by Trustee Floros. ROLL CALL Present upon roll call: Mayor Krause Trustees Floros Richardson Wattenberg Absent: Trustees Hendricks Minton Murauskis (Hendricks & Minton arrived late) APPROVAL OF MINUTES Trustee Wattenberg, seconded by Trustee'Richardson, moved to approve the minutes of the regular meeting of the Village Board held January 2, 1979. Upon roll call: Ayes: Floros Richardson Wattenberg Krause Motion carried. Nays: None APPROVAL OF BILLS AND FINANCIAL REPORT Trustee Floros, seconded by Trustee Richardson, moved to approve the following list of bills: General 343,955.01 Parking System Revenue 1,067.76 Motor Fuel Tax 11,822.61 Corporate Purposes Const.19?3 13,569.43 Waterworks & Sewerage Fund 76~749.99 $447,164.80 Upon roll call: Ayes: Floros Richardson Wattenberg Krause Nays: None Motion carried. Trustee Floros, seconded by Trustee Richardson, moved to approve the financial report dated December 31, 1978, subject to audit. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE'HEARD None MANAGER'S REPORT Village Manager Burghard presented his report. Trustee Richardson, seconded by Trustee Wattenberg, moved for passage of Resolution No. 1-79 A RESOLUTION OF AGREEMENT WITH THE ILLINOIS DEPARTMENT OF TRANSPORTATION Upon roll call: Ayes: Floros Richardson Wattenberg Krause Nays: None Motion carried. PAGE 1 1-16-79 Mr. Burghard presented the annual resolution of agreement with the Mount Prospect Rural Fire Protection District for approval. Trustee Richardson, seconded by Trustee Floros, mbved for passage of Resolution No. 2-?9. Upon roll call: Ayes: Floros Richardson Wattenberg Krause Nays: None Motion carried. ThE Village Manager presented an insurance claim for settlement wherein the Village would pay $500 as full settlement.for an accident involving a leased refuse truck. Trustee Wattenberg, seconded by Trustee Richardson, moved to authorize the administration to settle~the subject insurance claim in the amount of $500. Upon roll call: Ayes: ~loros Richardson Wattgnberg Krause Nays: None Motion carried. Mr. Burghard stated that Ross, Hardies, O'Keefe, Babcock & Parsons would file an appearance on behalf of the Village of Mount Prospect in the recently filed Citizens Utilities Company rate increase request. Trustee Hendricks arrived at the meeting. MAYOR'S REPORT Mayor Krause announced those 'employees with 5 years or more service to the Village and presented ~ar~er Employee Certificates to those present.. Mayor Krause presented a resolution for Board approval, which resolution stated the Village's opposition to the zoning request before the Cook County Zoning Board of Appeals to permit an adult driving course at BusSe Road just south of the Tollway. Trustee Richardson, seconded by Trustee Wattenberg, moved for passage of ResolutiOn No. 3-?9. A RESOLUTION OPPOSING THE DEVELOPMENT OF AN "ADULT DRIVING COURSE" Upon roll call: Ayes: Floros Hendricks Richardson Wattenberg Nays: None Motion carried. COMMITTEE REPORTS BUILDING COMMITTEE Trustee Hendricks presented the Building Committee report of the January 10, 1979 meeting. ZBA 55-V-78, 203 East Rand Road An Ordinance Granting Certain Variations for Property Commonly Known as 203 E. Rand Road, and An Ordinance Granting a Special Use for Property Commonly Known as 203 E. Rand Road, will be presented for 2nd reading at the February 6, 1979, Village Board meeting. ZBA 63-SU-78, ZBA 64-V-78, 101 S. Maple Trustee Hendricks noted that this case requesting a special use for a parking lot had been withdrawn by the petitioner. PAGE 2 1-~6-79 ZBA 85-Z-78, ZBA 86-V-78, 100 W. Northwest Hwy. (ZBA 85-Z-78) AN ORDINANCE AMENDING MAP 7,S OF THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Floros Hendricks Richardson Wattenberg Nays: None Motion carried. ~ i Trustee Hendricks, s~conded by Trustee Wattenberg, moved for passage of Ordinance No. 2861. (ZBA 86-V-78) AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 100 W. NORTHWEST HIGHWAY Upon roll call: Ayes: Floros Hendricks' Richardson Wattenberg Krause Nays: None Motion carried. Trustee Hendricks, seconded by Trustee Wattenberg, moved to direct the Village Manager to authorize the occupancy of the rear portion of the department store building by Aldi's even ~hough the aforesaid plat of Subdivision has not been registered with the Cook County Registrar of Titles. Upon roll call: Ayes: Floros Hendricks Richardson Wattenberg Nays: None Motion carried. Trustee Minton arrived at the meeting. ZBA 69-Z-78, ZBA 70-V-78, ZBA 71-Z-78, ZBA 74-V-78, Davey Tree Property Trustee Hendricks, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Building Committee and grant the requested re-zoning in ZBA 69-Z-78 and ~ ZBA 71-Z-78. Trustee Hendricks, seconded by Trustee Wattenberg, moved to concur with the reco~endatiOn of the Building Committee 'to grant the requested variation in ZBA ?0-V-?8. Trustee Hendricks, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 2863. AN ORDINANCE PROVIDING FOR THE PLANNED UNIT DEVELOPMENT OF PROPERTIES COMMONLY KNOWN AS THE DAVEY TREE PROPERTY Upon roll call: Ayes: Floros Hendricks Minton Wattenberg Krause Nays: Richardson Motion carried. ZBA 87-Z-78 and ZBA 88-V-78, Northeast corner of Kensington Road and Elmhurst Avenue Trustee Hendricks, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Zoning Board of Appeals and Building Committee to grant the re-zoning requested under ZBA 87-Z-78. An Ordinance Amending Map 2B-N~of the Zoning Ordinance and An Ordinance Granting Certain Variations for Property Located at the Northeast Corner of Kensington Road and Elmhurst Avenue would be presented for 2nd reading at the February 6, 1979, meeting of the Village Board. A plat of subdivision indicating the l? foot dedication for the north half of Kensington and indicating the 50 foot setback line must be presented for approval to the Board. ZBA 89-Z-78 and ZBA 90-V-78, Southwest corne~ of Golf and Elmhurst Roads Trustee Hendricks, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Zoning Board of Appeals and the Building Committee and gran~ the re-zoning requested in ZBA 89-Z-78. Trustee Hendricks, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Zoning Board of Appeals and the Building Committee to grant the requested variations under ZBA 90-V-78, with the exception 0r the ~ waiver of the sidewalk requirement granted by the Zoning Board of Appeals and including additions relative to the extension of easements and the 50 foot building setback be noted on the plat and the dedication of the water mains upon completion of the shopping center. PAGE 5 1-16-79 Trustee Hendricks, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 2865 (ZBA 90'V-78) AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR PROPERTY GENERALLY LOCATED AT THE SOUTHWEST CORNER OF THE INTERSECTION OF ELMHURST ROAD AND GOLF ROAD Upon roll call: Ayes: Floros Hendricks Minton Wattenberg Nays: Richardson Motion carried. Trustee Hendricks, seconded by Trustee Wattenberg, moved to authorize the Mayor to sign and Clerk to attest her signature on the Di Mucci's Plat of Subdivision providing that land shown as Elmhurst and Golf Roads is indicated as "heretofore dedicated". Community Development Block Grant Program Trustee Hendricks, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Building Committee on the Community Development Block Grant Program. Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. The Laich's Plat of Subdivision was brought forward fr~m OTHER BUSINESS. Trustee Richardson, seconded by Trustee Minton, moved to authorize the Mayor to sign and Clerk to attest her signature on the Laich's Plat of Subdivision, being within l~ miles of the corporate limits of the Village. FIRE AND POLICE COMMITTEE Trustee Minton requested the Board review material to be distributed relative-to a Consent Agenda, which subject will be discussed ~t the next Board meeting, February 6, 1979. JUDICIARY COMMITTEE Noreport. PUBLIC HEALTH AND SAFETY COMMITTEE Trustee Richardson, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 2866 AN ORDINANCE AMENDING ARTICLE II OF CHAPTER 19 OF THE MUNICIPAL CODE Upon roll c~ll: Ayes: Floros Hendricks Minton Richardson Wattenberg N~ys: None Motion carried. - PUBLIC WORKS COMMITTEE No report. Trustee Richardson, seconded by Trustee Hendricks, moved to authorize the Mayor to sign and Clerk to attest her signature on the Plat of Annexation being the subject of Ordinance No. 2868. Trustee Hendricks, seconded by Trustee Richardson, moved to authorize the Mayor to sign and Clerk to attest her signature on the Hess' Plat of Subdivision (on Meadow Lane at Catino), provided that any and all public improvement bonds have been posted with the Village of Mount Prospect. The meeting went into Executive Session at 10:25 P.M. Mayor Krause reconvened the meeting at 11:02 P.M.
