Chapter 22, Section 22.504 (Water and Sewer Rates) outlines the costs and conditions under which
the Village may agree to provide water and sewer service to users outside the corporate limits of
Mount Prospect.
Paragraph H. of that Section provides that the Village may enter into Intergovernmental Agreements
to sell water to a government entity. The Village has received two such requests and staff is presenting
same for your consideration.
A. Elk Grove Rural Fire Protection District
Per the attached memorandum from Fire Chief Michael Figolah, the Elk Grove Rural Fire Protection
District is requesting consideration of a connection to the Mount Prospect water system to serve the
District's one and only Fire Station. It is located at the very southern end of Linneman Road. As you
know, this area is not within the corporate limits of the Village but is entirely surrounded. Given that the
total unincorporated area is greater than 60 acres, the Village cannot forcibly annex the Station and
other surrounding properties into the Village. Voluntary annexation appears unlikely in the foreseeable
future.
Since the Mount Prospect Fire Department and Elk Grove Rural Fire Protection District are dependent
on each other for mutual and automatic aid, it would appear to be in the best interest of the Village
work cooperatively with the District in enhancing the capabilities of their Fire Station. A Village water
main is located within close proximity to the Fire Station. Staff would recommend as part of any
Intergovernmental Agreement that the District agree to incur all costs associated with tapping into the
Village main as well as paying the standard rate for users outside the corporate limits of the Village.
Representatives from the Fire Protection District as well as appropriate Village staff will be in
attendance.

A. City of Prospect Heights
In August 1994, the Village entered into an Intergovernmental Agreement with the City of Prospect
Heights to provide water to its municipal facility and the then to be constructed Police Center. At that
time, the Agreement restricted the sale of water for municipal purposes only. In June 1997, the
Intergovernmental Agreement was amended to allow a commercial user, Walgreens, to also receive
Mount Prospect water. The Village has received a request from the City of Prospect Heights to
consider the addition of another commercial user, the Shell Gas Station located at the northwest
corner of Elmhurst and Camp McDonald Roads. If the Village were to consider the request favorably,
a second amendment of the Intergovernmental Agreement would be necessary.
Attached please find the Intergovernmental Agreement as amended along with pertinent
correspondence regarding the new user.
V. REQUEST BY CITY OF PROSPECT HEIGHTS FOR THE VILLAGE OF MOUNT PROSPECT TO
TAKE OVER JURISDICTION (LIMITED) OF A PORTION OF EUCLID AVENUE
Since 1996, the City of Prospect Heights and the Village have been discussing the feasibility of
effectuating certain jurisdictional transfers regarding two roadways, which form common boundaries
between the two municipalities. The two roads under consideration are a short stretch of Euclid
Avenue and the entire length of Old Willow/Seminole Road. Under the original concept, the Village
of Mount Prospect would accept jurisdiction over the short stretch of Euclid Avenue while the City of
Prospect Heights would accept jurisdiction of the entire length of Old Willow/Seminole Road. Euclid
Avenue is a County road, while Old Willow/Seminole is a local road.
Given uncertainties regarding the potential traffic impact of the proposed Prospect Heights Arena, the
Village has respectfully declined to move forward with the Old Willow/Seminole Road matter (see
attached correspondence). There is, however, no reason to further delay Mount Prospect's
acceptance of jurisdiction over the short stretch of Euclid Avenue. Mount Prospect's jurisdictional
responsibilities would be limited to enforcement of traffic regulations and emergency response. The
State would continue to be responsible for maintenance and upkeep of the roadway as well as
snowplowing and salting activities.
Staff has analyzed the request and feels it would not be overly burdensome. If the Board considers
the request favorably, appropriate Disannexation/Annexation Agreement(s) would be drafted along with
Plats for adoption by the respective municipalities.
VI. ELECTRIC DEREGULATION AND VILLAGE OPTIONS
In 1997, the Illinois General Assembly passed Public Act 90-561 (Electric Service Customer Choice
and Rate Relief Law of 1997). The law effectively provided for the deregulation of the electric utility
industry in Illinois. Last year, the Village adjusted its Utility Tax to conform with the requirements of the
Public Act. This year, another set of decisions must be considered by the Village as the deregulation
process continues.
A. Conversion from Free Electric Service to an Infrastructure Maintenance Fee
The Village currently receives free electric service from Commonwealth Edison as compensation for
the use of the public right-of-way. The Act provides the Village with the opportunity to exchange this
free electric service for a revenue stream in the form of an Infrastructure Maintenance Fee (the Village
would then have to pay for all electric service). The potential value of the conversion is that substantial
growth in electric usage could net the Village additional revenues above the "current cost" of free
electric service. The Village can also choose to continue to receive free electric service under the
current Franchise Agreement.
The Northwest Municipal Conference has been assisting member municipalities in determining which
option is the most feasible. The attached information supports staff's recommendation that the Village
maintain the status quo (free electric service).
B. Participation in Service Provider Lottery
The Act also provides for an accelerated form of deregulation through a lottery system that would allow
"winners" to shop around for alternate service providers as early as October 1999. Again, working
through the Northwest Municipal Conference, it is recommended that municipalities enter the lottery
in hopes of gaining access to the open market. The attached information outlines the benefits of
participating in the lottery.
VII. CONSIDERATION OF ILLINOIS STATE GIFT BAN ACT AND ITS APPLICABILITY TO THE VILLAGE
OF MOUNT PROSPECT
In 1998, the Illinois Legislature passed a law commonly known as the State Gift Act. The Act's primary
purpose is to Statutorily regulate the giving and receipt of gifts by individuals and entities to officials and
employees of all governmental entities in Illinois. While the legislation became effective January 1,
1999, it does not apply to units of local government until July 1999. During this past Legislative
Session, amendments to the Act were offered that either exempted local governments from its reach
or modified the impact on same. With the end of the Legislative Session scheduled for Friday, May 21,
it is still unclear whether any amendments will be adopted or if the Governor will sign them.
With an effective date of July 1, the Village Board will need to consider appropriate amendments to
the Village Code during June. The purpose of the Committee of the Whole discussion is to explain the
requirements of the Act and review the appropriate Amendatory Ordinance to bring the Village into
compliance. The attached memorandum from Village Attorney Buzz Hill along with background
information provided by the Illinois Municipal League will form the basis of the discussion.
