OLD BUSINESS Trustee Wattenberg, seconded by Trustee Arthur, moved AMEND CH.13 for passage of Ordinance No. 3122, increasing the Class W liquor Hcenses for Moloneys, 1904 S. Elmhurst Road. MOLONEYS AN ORDINANCE AMENDING CHAPTER 13 OF THE ORD.NO. 3122 MUNICIPAL CODE Upon roll call: Ayes: Arthur Farley Floros Miller Wattenberg Nays: None Motion carried. Trustee Farley, seconded by Trustee Arthur, moved to TABLED table An Ordinance Amending Chapter 13 of the Municipal ORDINANCE Code, providing that if a specific liquor license is not AMENDING utilized by the licensee for a period of six months that CH. 13 license would be terminated. Upon roll call: Ayes: Arthur Farley Floros Miller · Wattenberg Nays: None Motion carried. ]SI_JdL~_U_~ An Ordinance Designating An Alternate Representative for WATER AGENCY the Village of Mount Prospect to the Board of Directors of the Northwest Suburban Municipal Joint Action Water Agency , designating Trustee Farley as the Alternate Representative, was presented for first reading and will be presented July 21 for second reading. ZBA 6-V-81, 218 South Louis Street ZBA 6-V-81 This case was remanded back to the Zoning Board of Appeals 218 S. LOUIS at the June 16th Village Board meeting. Having reheard the case, it was the recommendation of the Zoning Board to grant the request to allow an existing driveway to be enlarged. Inasmuch as the enlarged driveway Gould cause a drainage problem for the neighbor at 216 S. Louis, it was also the recommendation of the Zoning Board that the neighbor have input as to the design of a retaining wall between 216 & 218 South Louis. Trustee Floros, seconded by Trustee Miller, moved to concur with the recommendation of the Zoning Board of Appeals in ZBA 6-V-81 to grant the requested variation, subject to the petitioner submitting plans for a retaining wall, which plans would be reviewed by the neighbor at 216 S. An Ordinance will be drafted for first reading at the July 21st Village Board meeting. An Ordinance Amending Chapter 13 of the Municipal Code, AME~.D CH.I_~3 creating a Class B liquor license for Scotland Yard Restaurant, _SCOTLAND YARD253 E. Rand Road and deleting one Class W for Sizzlers' Steak 252 F.~RAND RD. July 7, 1981 Page Two House, inasmuch as that restaurant has closed, was presente~ 'SIZZLERS' for first reading and will be placed on the July 21st Village 110 E. RAND RD. Board agenda for second reading. A Resolution Authorizing the Execution of a CATV Franchls~ CATV FRANCHISE Agreement ~vith Cablenet was presented for consideration. AGREEMENT - Clarification of ~everal &teas of the agreement were requested,-CABLENET anal following considerable discussion, it was decided that this matter would be discussed further at the July 14th Committee . of the Whole meeting. This Resolution will be presented at the July 21st Village Board meeting for action. NEW BUSINESS An Ordinance Determining Certain Prevailing Wages to be Paid PREVAILING WAGE for Certain Public Works Projects was presented for first P.W. PROJECTS reading and will be presented July 21st for second reading. An Ordinance Adopting the Municipal Code of the Village of MUNICIPAL CODE OF Mount Prospect of 1981 was also presented for first reading 1981 with the second reading to ts_kc place July 21st. Trustee Wattenberg, seconded by Trustee Miller, moved FRIVOLOUS LAW SUI for passage of Resolution No. 26-81 RES. NO. 26-81 A RESOLUTION SETTING FORTH THE POLICY OF THE VILLAGE OF MOUNT PROSPECT IN REGARDS TO FRIVOLOUS LAW SUITS Upon roll call: Ayes: Arthur Farley Floros Miller Wattenberg Nays: None Motion carried. Trustee Arthur, seconded .by Trustee Miller, moved to ELMHURST ROAD SU accept dedication of the easements for water & sewer mains ]~%SEMENTS - on the Elmhurst Road Plaza Subdivision (south Elmhurst Road) ~ and to authorize the Mayor to sign and Clerk to attest any documents necessary for acceptance. Burghard presented a request PAVING BiD INCREA~ to increase the recently approved paving contract with ARROW ROAD CONS~ Arrow Road Construction in order to include Emerson Street between Busse Avenue and Central Road. Trustee Miller, seconded by Trustee Arthur, moved to authorize the paving contract with Arrow Road Construction to be increased to allow for the paving of Emerson Street, between Central Road and Busse Avenue,'w~ich increase would not exceed $11,000. Mr. Burghard presented a staff report on the recently Page Three July 7, 1981 CCPA & AIME completed negotiations with the Police Department union CONTRACTS '(CCPA) and the Public Works union (AIME) and requested the Board to authorize acceptance of the contracts. Trustee Farley, seconded by Trustee Wattenberg, moved to authorize the Mayor to sign and Clerk to attes} her signature on the contracts with CCPA and AIME. Mr. Burghard presented the following bid results for painting BID: ELEVATED the elevated water tank at Northwest Highway & Maple Street: WATER STORAGE I TANK PAINTING Craftsmen Painting Service, Inc. $185.000 Neumann Company Contractors, Inc. $195,000 Jetco Ltd. $171,895 Steel Maintenance Corp. $ 58,390 Mr. Burghard explained that the low bid submitted by Steel Maintenance Corp did not include all the required specifications. The company was contacted and a revised bid was submitted to include all requirements for $112,300. The staff contacted all bidders informing them of the revised bid and all bidders held firm in their respective bids. It was the recommendation of the staff that the Board accept the low bid submitted by July 7, 1981 Page Five Steel M~intenance Cord in the amount of $122,300.00 and to authorize retaining an engineering firm to oversee the project at a cost not to exceed $8,000. Trustee Farley, seconded by Trustee Wattenber~, moved to reject all bids due to the fact that most of the bids exceeded the budgeted amount and did not meet specifications. STEEL Trustee Parley, seconded by Trustee Wattenberg, moved MAINTENANCE to waive the bidding procedure for painting the elevated CORP. water tank and to authorize the Village Manager and. Director of Public Works to negotiate a contract with Steel Maintenance'Corporation for an amount not to exceed $112,300.00 and to authorize the Village Manager to enter into a contract with an engineer to oversee the project for an amount not to exceed $8,000. The Manager presented a request from the Police Department WAIVE BIDS POLICE RADIOS to waive the bidding process in order to purchase 9 radios and one ISPERN mobile unit. The Manager explained that this action was requested to create uniformity in the equipment used by that Department. Trustee Floros, seconded by Trustee-Miller, moved to MOTOROLA CORP. waive the bidding process relative to purchasing 9 radios and one ISPERN mobile unit and to authorize the purchase of the equipment from Motorola at a cost not to exceed $16,453. WELL 17 - Mr. Burghard explained that start-up procedures on EXPENDITURE Well 17 (north Elmhurst Road at Camp McDonald) has indicated a high level of chloride in the water. In order to attempt correcting this problem, the Village Manager requested additional funds. Trustee Floros, seconded by Trustee Farley, moved to authorize an expenditure not to exceed $75,000 in an effort to correct the chloride problem at Well 17. LEAGUE Trustee Wattenberg noted that the Illinois MuniCipal League CONFERENCE will be holding their annual conference in September and July 7, 1981 Page Six nquired as to the Village's policy on paying expenses for attending the conference and lodging fees. It was stated that the policy is for the Village to pay registration ~ fees however anyone representing the Village would have to assume any lod~ing fees.
