INVOCATION INVOCATION The invocation was given by Trustee Floros. COIV~IUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD Cy Thomas, 508 See Gwun, expressed appreciation to the Mayor for participating in the beginning of the 'Green Up - NORTHWESTERN Clean Up' campaign. He also requested the Board take what TI~AIN STATION ever aetion necessary to have the Northwestern Railroad maintain cleanliness within the station. Mayor Krause stated that the Village wss exploring the possibility of entering into an agreement for the Village to maintain the inside and outside of that building. MANAGER'S REPORT APPROPRIATION TRANSFER Village Manager Burghard presented for second reading An Ordinance Making Certain Appropriation Transfers Within the Annual Fiscal Budget - 1979-80. Trustee Floros, seconded by Trustee Miller, moved for .ORD. 2995 - passage of Ordinance No. 2995 AN ORDINANCE MAKING CERTAIN APPROPRIATION TRANSFERS WITHIN THE ANNUAL FISCAL BUDGET - 1979-80 Upon roll call: Ayes: Farley Floros Miller Murauskis Richardson Nays: Wattenberg Motion carried. SENIOR CITIZEN Mr. Burghard requested consideration of a resolution HOUSING - expressing the intent to acquire a certain parcel of land ACQUISITION OF for senior c~tizen housing. SITE Trustee Floros, seconded by Trustee Richardson, moved RES. 15-80 for passage of Resolution No. 15~80 A RESOLUTION AUTHORIZING THE ACQUISITION OF SITE FOR SENIOR CITIZEN HOUSING Upon roll call: Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Nays: None ~otion carried. Village Manager Burghard gave a brief history of a piece of property approximately 19' x 20' located along the south and NOTICE OF west boundaries of the subdivision known as the Mack Cadillac SALE OF VILLAGE Subdivision (203 E. Rand Road), being the subject of OWNED PROPERTY- Ordinance Nos. 2870 and 2871. Mr. Burghard stated that the · Mack Cadillac development was approved by the Village Board subject to the ~ubdivision condition that the developer provide a buffer strip between the residential area surrounding the development and the actual land to be used as a Wendy's Restaurant and Pearle Vision Optical store. Due to the difficulties involved with deeding the 19' x 20' buffer strip to the numerous homeowners involved, that strip was deeded to the Village for disposition. Mr. Burghard stated that in order for the Village to convey the subject buffer strip to the surrounding homeowners, the statutes require that any Village owned property be offered by bid and therefore the Manager was requesting Board authorization to offer the buffer strip for sale by bid. Trustee Richardson, seconded by Trustee Floros, moved to authorize the Manager to proceed with a Notice of Sale for the 19' x 20' buffer strip located on the south and west side of the Mack Cadillac Subdivision. It was stated that if the adjacent proper~y owners intended to use the strip as additional off-street parking, it would require that a petition would have to be filed for re-zoning with a hearing before the Zoning Board of Appeals. Such a petition could be filed when the present moratorium is lifted in January, 1981. PAGE 2 4/15/80 An Ordinance Amending the Traffic Code, placing a 5-ton load AMEND TRAFFIC limit on Westgate Road and on Wheeling Road between Kensington CODE - Westgate & and Euclid, was presented for first reading. Second reading will Wheeling Roads take place May 6th. Miss Nipper, 1216 Cardinal Lane, requested the appropriate Westgate Road - Committee review the possibility of restricting parking within Parking 200 feet of Central Road on Westgate Road. That matter was referred to the Public Health and Safety Committee for review· The Manager presented his recommendation to retain David JacobsonVILLAGE~ NEWSLETTER to write the Village Newsletter, explaining that since Dolores Haugh had resigned as Public Information Officer and the fact that that position would not be filled, the function of writing the Newsletter would have to be undertaken by an outside source, The Board authorized the Manager to retain Mr. Jacobson to write the Village Newsletter at a cost not to exceed $500 per 1ssue. Mr. Burghard presented the results of a bid opening held SALE OF 1953 April 15, -1980 ~-as authorized by 'Ordinance No. 2976, FIRE DEPT. authorizing the sale of a 1953 tanker. The legal notices TANKER were published and one bid was submitted by Jim ~cCarly Fire Equipment Company in the amount of $1,800. Trustee Richardson, seconded by Trustee Floros, moved to concur with the recommendation of Fire Chief Pairitz and the Village-Manager to accept the bid of $1,800 submitted by Jim McCarty Fire Equipment Company for the 1953 Fire Dept. tanker. MAYOR'S REPORT PROCLA~IATIONS Mayor Krause made the following proclamations: May 1, 1980 - LAW DAY, U.S.A.; May 5- 10, 1980- FIREFIGHTERS' RECOGNITION WEEK; and May, 1980 as SENIOR CITIZEN MONTH. COMMITTEE REPORTS BUILDING COMMITTEE Trustee Floros presented an ordinance pertaining to ZBA 5-V-$0 ZBA 5-V-80 for 2nd reading. Rauenhorst Corp.- : Kensington Center Trustee Floros, seconded by Trustee Miller, moved for passage of Ordinance No. 2996 ORD. 2996 AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR THE RAUENHORST PROPERTY Upon roll call: Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Nays: None Motion carried. PUBLIC HEARING - Mayor Krause declared the Public Hearing on the proposed RAUENHORST Annexation Agreement with Rauenhorst Corporation (Kensington ANIN-EXATION Center - NJ-Gas property), which was continued from April 1, 1980 AGREEMENT open. Village Attorney Barbara Baran gave a brief outline of the most recent changes to the Annexation Agreement with Rauenhorst. The following people spoke relative to various points of the Agreement: Daniel Sumancka, Lowden Lane Bernadine Rechner, President of the River Trails Park District George Meyer, Trustee of the River Trails Park District ' Idle Nipper, 1216 Cardinal Lane Peter Jarvis, representing Rauenhorst Corporation, gave a slide presentation of the locations proposed for the entrance signs to the Kensington Center (Rauenhorst Development), which signs were being requested to be located at the Rand Road entrance, on the west side of Business Center Drive and at the southeast corner of Kensingto~i Road and Wheeling Road, in the parkway. It was also noted that the proposed jogging path through the complex, originally intended to be dedicated to the River Trails Park District, had been rejected by that Park District, with final decision to be made On that dedication by May 1, 1980. Trustee Wattenberg, seconded by Trustee Murauskis, moved CLOSE PUBLIC to close the PubIic Hearing reIative to the proposed Annexation HEARING Agreement with Rauenhorst Corporation governing that property commonly known as the NJ-Gas Property - Kensington Center. Upon roll eail: Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Nays: None Motion carried. _RAUENHORST Trustee Miller, seconded by Trustee Floros, moved for ANNEXATION passage of Resolution No. 16-80 AGREEMENT -A RESOLUTION AUTHORIZING EXECUTION OF AN RES. 16-80 ANNEXATION AGREEMENT WITH RAUENHORST ' Upon roll call: Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Krause Nays: None Motion carried. PAGE 4 4/1_5~80 It was noted that Northern Illinois Gas had not executed all the necessary documents and therefore the Ordinances annexing, zoning and granting specified variations were continued to the May 6, 1980 meeting of the Village Board. Trustee Floros, seconded by Trustee Wattenberg, moved to BROWING FERRIS - waive the rules to bring up an item not listed on the agenda .SCAVENGER being the proposal to amend the contract with Browning Ferris to allow for garbage pick-up on two days each week instead of the 4 days presently required by the contract. Trustee Floros, seconded by Trustee Wattenberg, moved to waive the rule governing reconsideration of a motion. By consent of the Board the pending motion was carried over to the May 6, 1980 Village Board meeting. . FINANCE COMMITTEE No report. FIRE AND POLICE COMMITTEE No report. LEGISLATIVE/JUDICIARY COMMITTEE No report. PUBLIC HEALTH AND SAFETY COMMITTEE No report. PUBLIC WORKS CO1V[MITTEE Trustee Farley gave a status report on the following items: Acquisition of Lake Michigan water Central/Busse Roads Retention Basin We Go Trail Widening Lake Briarwood Drainage Problem Trustee Farley, seconded by Trustee Floros, moved to adopt 1980 MFT the 1980 MFT resurfacing program as submitted by the RESURFACING Village Engineer. PROGRAM Upon roll call: Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Nays: None Motion carried. Trustee Farley announced that the Public Works Committee LAKE BRIARWOOD would meet with the Lake Briarwood Homeowners Association DRAINAGE on Wednesday, April 16, relative to the drainage problem in pROBLEM that area. A Special Meeting of the Village Board was called for Tuesday, SPECIAL BOARD April 29, 1980, at 7:30 P.M. for the purpose of discussing MEETING CALLED acquisition of Lake Miehigall water. ACQUISITION OF LAKE MICHIGAN WATER OTHER BUSINESS Trustee Wettenberg, seconded by Trustee Richardson, moved BLOOD~.pRoGRA]~ to amend the budget by increasing the salary for the Blood ~ Program Co-ordinator by $30.00 per month. ' PAGE 5 4/15/80 Trustee Farley, seconded by Trustee Miller, moved to amend VOLUNTEERS the motion to refer that matter to the Public Health and Safety Committee, along with the subject of volunteerism in general. Village Attorney Barbara Baran noted that the Hold Harmless TREES. IN_COOK Agreement between the Village a~d Cook County, allowing COUNTY RIGHT- the trees presently existing in the County right-of-way at OF-WAY Camp McDonald and Elmhurst Road, has not yet been returned by Cook County.
