COMMUNICATIONS AND PETITIONS CITIZENS TO BE HEARD
The Mount Prospect Kiwanis Club presented the three
LOWELL J. FELL
finalists for the Lowell J. Fell Scholarship, they
were: Vicki Luempert, 605 Ironwood; Jennifer Mallery,~ FINA¥.IS~S
1854 Phillip Dirve; and Richard Reese, 503 N. Fairview.
MAYOR' S REPORT
I~PPOINTMENTS: Mayor KrauSe presented announced that Tom Grissom
HANK FRIEDRICHS had submitted his resignation from the Fire
~IRR & POLICE COM. and Police Commission and recommended Henry
Friedrichs fill the vacancy, term to expire
May 1, 1983.
Trustee Floros, seconded by Trustee Murauskis,
moved to concur with the recommendation to
appoint Hank Friedrichs to the Fire and
Police Commission, term to expire May 1; 1983.

OLD BUSINESS

201 E. KENSINGTON RD. This case was presented at the time the Village
declared a moratorium on amusement devices
and a motion to table action ~til the
moratorium was over was passed. This matter
was continued to the June 1, t9~2 Village
Board meeting in Order to give the petitioner
an opportunity to decide whether to pursue
the request or not.
MANAGER'S REPORT
Village Manager Terrance L. Burghard presented
bids received for tree trimming, a full
~ tabulation is attached to these minutes.

moved to accept the low bid submitted by
AYD_A_~E~Y_~_~_~ Davey Tree Expert Company for the 1982 tree
EXPERT CO. trimming at a cost not to exceed $39,358.00.

TREE REPLACEMENT Mr. Burg~ard then presented the bid results
for the parkway tree replacement program. The
specifications required the bidders to bid on
a 'per diameter inch' basis for different size
trees:

to accept the low bid for parkway tree replacement
submitted by Nels Johnson Tree Expert Company at
a cost not to exceed $24,000.00.

Mr. Burghard presented a proposal received from R.~.NORENE
R. V. Norene, financial consultants. This I~AKE MICHIGAN
proposal would suggest the alternate methods of WATER
allocating funds for the acquisition of Lake ACQUISITIOn..
Michigan water. The proposal states that the
cost would be between $4~000 and $6,000, a copy
of the proposal is attached to these minutes.
Trustee Arthur, seconded by Trustee Murauskis,
moved to approve the proposal submitted by
Ro V. Norene as financial consultants on the
acquisition of Lake Michigan water.

The Village Manager stated that the Weller Creek .WELLER CREEK
improvement would need additional fill along the IMPROVEMENT
banks which would require an increase in the
total amount by an additional $35,640.00.
Trustee Wattenberg, seconded by Trustee Arthur,
moved to authorize the expenditure of an NAGEL EXCAVATI~
additional $35,640 to Nagel Excavating Company
for additional fill for the Weller Creek
improvement.

Mr. Burghard stated that the request for annexation .LINCOLN CIRCLE
for property commonly known as "Lincoln Circle ANNEXATION
Estates" had been withdrawn by the petitioner.
NEW BUSINESS
An Ordinance ~ending the Traffic Code was presented AMEND CH. 18
to include the two Municipal Lots at Busse Avenue
and Main Street and to amend the legal description
of the Maple Street Lot.
Trustee Arthur, seconded by Trustee Murauskis, moved
to waive the rule requiring two readings of an
ordinance in order to take action on the subject
ordinahce.

AN ORDINANCE AMENDING CHAPTER 18,
TRAFFIC CODE, OF THE VILLAGE CODE

1310 River Road This case is a request for a variation from
the lot width requirement. The subject
parcel on River Road is a long narrow parcel
with several buildings presently in disrepair.
The petitioner proposes to divide the lot into
three lots, 2 of which would meet the 65 foot
wide requirement and the 3rd lot would be
42 feet wide.
Trustee Floros, seconded by Trustee Farley,
moved to concur with the recommendation of
the Zoning Board of Appeals and grant the.
requested variation.

An ordinance will be dr~fted for first reading
at the June 1st Board meeting and a plat of
subdivision will be presented to the Planning
Commission before coming before the Village
Board.
The Safety Commission report was presented.
A request had been received for a street
STREET LIGHT: light at Glendale and Blackhawk, and the
BLACKHAWK & Safety Commission referred the matter to
~LENDALE Commonwealtk Edison for recommendation as to
placement of such a street light.
Trustee Farley, seconded by Trustee Wattenberg,
moved to concur with the recommendation of the
Safety Commission to ~eny the requested street
light. ~'

~ at Robert Drive and Palm.

moved to concur with the recommendation of the
Safety Commission to deny the requested STOP
sign.

~AMEND CH. 22 An Ordinance was presented that would amend
~wE~ ~HAR~RS Chapter 22 to provide for a separate sewer charge.
The present billing procedure combine the sewer
and water usage charges.

Code had its first reading and will be presented
June 1st for second reading.
OTHER BUSINESS
DUNKIN DONUTS
Dunkin Donuts Plats of Subdivision, indicating the
entire parcel with the vacation and dedication PLAT OF
previously approved, was presented. SUBDIVISION
Trustee Farley, seconded by Trustee Arthur, moved
to authorize the Mayor to sign and Clerk to attest
her signature on the Dunkin Donuts Plat of ~
Subdivision.

Ladies and Gentle, eh:
We understand that you contemPlate creating a Special Service
District to provide a property tax funding vehicle for that portion
of the Village that will be provided Lake Michigan water by the North-
west Suburban Municipal Joint Action'Water Agency (the Agency). It is
also contemplated that the Special Service ~istrict wilt levy a property
t~x for the payment of water delivered to the District. We are pleased
to offer our financial advisory services to establish a financing pro-
gram and successfully market and deliver the necessary bonds for the
project as it is now proposed, or as it may be modified.
(1) We will ~mmediately familiarize ourselves with the project
through meetings with your staff, your attorneys and engineers
and based thereon establish a tentative financing timetable
so that close coordination will be ensured in the legal and
financial aspects of the creation of the District and the fi-
nancing.
(2) We will submit estimates to you of the annual debt service
cost and will make recommendations regarding the financial
plan. These will be based upon our review of the informatio~
concerning the District, the Village's responsibilities to the
Agency, the Village's present bonding needs, future bonding
needs (if applicable) and the municipal bond market.
(3) We will prepare financing data concerning the tax impact on
your residents for the information of yourselves and civic
groups and for presentation at the public hearings regarding
the creation of the District and the issuance of the bonds.
(4) We will specify financial provisions to be included in the
legal proceedings for a most attractive and successful fi-
nancing.

(5) We will research the financial information and economic data
bearing upon the District as a taxing entity, you as an issuer
and the successful marketing of the bonds and will assemble
same, together with the details of the bonds, into an attrac-
tive Official Statement which will allow you to satisfy the
.. current market requirements for full disclosure. The Official
Statement will be submitted to you prior to its distribution.
(6) We will advise you of the marketing procedures and specifical-
ly recomm~end the time, place and method of conducting the bid
opening and sale of the bonds.
(7) When a bond bid opening date has been established, we will:
(a) arrange for the publication (if applicable) of the
notice(s) of sale in the national financial press.
(b) make a recommendation relative to the advisability
of obtaining an investment rating and, if you elect
to request one, we shall make application on your
behalf including preparation of the necessary
information.
(c) recommend whether you should make application for
municipal bond insurance and if it is decided to
make such application, we shall submit the neces-
sary infor~ation.
(d) distribute the Official Statement to a broad list
of prospective bidders, investment advisors and
investing institutions.
(8) We will attend the bid opening where we will conduct the sale,
¼ check the bids for accuracy and advise you of the acceptability
of the best bid received.
(9) We will assist in and coordinate all details leading up to
the delivery of the bonds, including the printing of the bonds
and calculating the amount due at delivery.
(10) Upon completion of the delivery of your bonds we shall com-
pute a record of payments of principal and interest and pro-
vide you with a convenient reference s,rmmary of the financ-
ing.
We shall have no interest in the p~rchase or resale of your obli-
gations nor shall we engage in any other activity which may constitute
a conflict of interest with performance of our services for you, We
will not obligate you for any expenses except with your approval.
~¥ou will be responsible for the fees of your attorneys, bond coun-
sel, engineers/architects and are to pay all of your ordinary expenses
including advertising, printing and distribution of Official Statements,
the purchase (if applicable) of a rating for the bonds, the purchase
(if applicable) of municipal bond insurance, and printing and delivery
of the bonds. We will assist you by arranging for the advertisement of
the sale in the national financial press and where applicable, will
obtain competitive bids on the necessary printing.

For our services we are to be paid a fee which shall include our
own ordinary expenses, our necessary travel expenses and our services ~--~
in full which, in addition to those outlined in this Agreement, shall ~
include all necessary and usual functions to complete the financing.
If bonds are sold our fee is to be calculated as follows: A base
fee of $6,000 plus $3.00 per $1,000 par amount for all bonds issued in
excess of $1,000,000 which fee shall be due at the bond bid opening and
payable upon receipt of bond proceeds. If for whatever reason, no bonds
are sold, we are to be compensated for our time at a rate of $85 per hour
plus our actual out-of-pocket expenses provided that in no event shall
those charges exceed $4,000. If the concept of issuing Special Service
District bonds for this project is abandoned, or if no bonds have been
sold within six months of the acceptance of this Agreement by the Vil-
lage, we will submit an invoice for our time and out-of-pocket expenses
which shai1 be payable by the Village within 30 days thereof. If at a
later date bonds are sold for the project, we shall credit the amount
paid for our time and out-of-pocket expenses asainst the bond sale fee.
