COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD George Gattas, representing the Mount Prospect Lions Club, M.P.LIONS CLUB requested the fees connected with their annual Village VILLAGE FAIR: Fair be waived. Waive fees Trustee Richardson, seconded by Trustee Murauskis,'~ moved to waive all the fees connected with conductih~ a carnival for the 1983 Mount Prospect Lions Club Village Fair. Upon roll call: Ayes: Arthur, Floros, Murauskis, Richardson, Wattenberg Nays: None Motion carried. Trustee Farley arrived at this point. CHA~ER OF Dolores Haugh, Executive Director of the Mount COMMERCE Prospect Chamber of Commerce, and Donald Hill, President of the Chamber, presented the Village Board with its annual membership in the Chamber. .DOWNTOWN Betty Edwards, 105 Hi Lusi, President of the newly MERCHANTS created Downtown Merchants Association, requested ASSOC. the Village to assist that group with promoting the parking of merchant employees in areas other than the immediate downtown area, in the hopes of providing additional parking for shoppers. Mayor Krause stated that the Village would do all it could to assist with that request. MAYOR'S REPORT PROCLAMATION: Mayor Krause proclaimed April 19, 1983, as Arbor Day. ARBOR DAY A Resolution was presented for consideration that M.P.PUBLIC would assign the responsibility of certain contracts LIBRARY relative to the construction of the Mount Prospect Public Library, entered into by the Village Board, to the Library Board. Trustee Richardson, seconded by Trustee Murauskis, RES.NO. 15-83 moved for passage of Resolution No. 15-83 A RESOLUTION ASSIGNING ALL RIGHTS UNDER A CERTAIN CONTRACT FOR CONSTRUCTION OF THE ! MOUNT PROSPECT PUBLIC LIBRARY Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg Nays: N~ne Motion carried. OLD BUSINESS ELECTION A Resolution was presented declaring the results of RESULTS the April 12, 1983 General Election, which Resolution contained the individual precinct count. RES.NO. 16-83 Trustee Farley, seconded by Trustee Wattenberg, moved for passage of Resolution No. 16-83 A RESOLUTION DECLARING THE RESULTS OF THE GENERAL ELECTION HELD APRIL 12, 1983. ~--~ Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg Nays: None Motion carried. A copy of Resolution No. 16-83, signed by the Local Canvassing Board, would be forwarded to the State Board of Elections and the County Clerk. ZBA 50-V-82 1701 W. ZBA 50-V-82, 1701 W. Algonquin Road ALGONQUIN RD. This case, continued from the March 1, 1983, Village Board meeting, was to consider a request for specified April 19, 1983 .... Page Two variations connected with the proposed shopping area for property immediately north of Crystal Towers '~ Condominiums. ~The developer and Crystal Towers Homeowners Association has reached an agreement as to the encroachment of ~he Condominiums fence onto the developers land. Said agreement would resolve some of the concerns connected with this proposed use relative to storm and/or sanitary sewers, the fence and various shrubs. Village Manager Burghard complimented both the homeowners and developer on working out such an agreement, however he stated that such an agreement would be a matter between the two properties and the Village could not be a party to it, especially where it dealt with sewers, since the sewers within the Crystal Towers property are private property. Trustee Richardson, seconded by Trustee Murau~skis, moved to grant the requested variations, subject to the agreement between the two par~ies to be reviewed by Village staff as to scope of involvement of the Village. ZBA 5-V-83, 107 South Main Street ZBA 5-V-83 An Ordinance granting the specified parking variations 107 S. MAIN ST was presented for 2nd reading. Trustee Arthur, seconded by Trustee Wattenberg, moved for ORD. NO. 3321 passage of Ordinance No. 3321 AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR PROPERTY LOCATED AT 107 SOUTH ~IN STREET (Sakura Restaurant) Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg Nays: None Motion carried. ZBA t-V-83, 1750 West Central Road ZBA 1-V-83 This case requested variations including: reduced size 1750 W.CENTRAL of front and side yards; reduced number of off-street ROAD parking spaces; and elimination of loading space.' These variations are requested to permit the expansion of an existing business, Hinz Lithographing Company. Trustee Floros, seconded by Trustee Arthur, moved to concur with the request of the petitioner and waive the rule requiring two readings of an ordinance. Page Three April 19, 1983 ~iNZ PLAT OF A plat of subdivision for the property at SUBDIVISION 1750 West Central Road was presented. This plat places the subject property into one lot of record. Trustee Farley, seconded by Trustee Floros, moved to authorize the Mayor to sign and Clerk to attest her signature on the Hinz Plat of Subdivision. NWSMJAWA An Ordinance was presented designating the Village's REPRES~T~k- representatives to the Northwest Suburban Municipal TIVES Joint Action ~ater Agency's Board of Directors and Executive cOmmittee. MANAGER'S REPORT BUDGET Village Manager, Terrance Burghard presented a TRANSFER ' Resolution that would make budget transfers within 1982-83 the 1982-83 budget. Trustee Arthur, seconded by Trustee Murauskis, moved RES.NO 17-83 for passage of Resolution No. 17-83 A RESOLUTION ~%/<ING CERTAIN APPROPRIATION TRANSFERS WITHIN THE ANNUAL BUDGET ADOPTED FOR FISCAL 1982-83 Upon r611 call: Ayes: Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg Nays: None Motion carried. ANNUAL A Resolution was then presented by Mr. Burghard BUDGET that would adopt the budget for fiscal 1983-84. Mr. Burghard noted that the budget reflected a 1983-84 2% increase of last year's, however, the dollar amount included the large amount for acquisition of Lake Michigan water. RES.NO.18-83 Trustee Richardson, seconded by Trustee Wattenberg, moved for passage of Resolution No. 18-83 A RESOLUTION ADOPTING THE ANNUAL BUDGET FOR FISCAL YEAR 1983-84 Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, APril 19, 1983 Richardson, W~.~tenberg Nays: None SALE OF Mr. Burghard presented two ordinances that would '-~ MISC. _VILLAGE authorize the sale and/or disposal of various OWNED PROPERT Village owned items. The first ordinance would authorize the sale of specified equipment, to be sold by auction in conjunction with the Northwest Municipal Conference's auction, and the second ordinance authorized the sale of miscellaneous items to be sold at the annual P%~lic Works open house, May 21, 1983, 11 S. Pine Street, Mount Prospect. Trustee Wattenberg, seconded by Trustee Richardson, moved to waive the rule requiring two readings of an ordinance in order to take action on the ordinance authorizing specified property to be auctioned off. ORD.NO. 3325 Trustee Arthur, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 3325 AN ORDINANCE AUTHORIZING THE SALE OF PERSONAL PROPERTY OWNED BY THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg Nays: None Motion carried. NEW BUSINESS ZBA 7-SU-83, 199 W. Rand Road ZBA 7-SU-83 This case deals with a request for a special use to 199 W. RAND RD permit two amusement devices in an existing miniature golf range establishment. The Zoning Board of Appeals recommended to grant the special use. Page Five April 19, 1983 Trustee Wattenberg, seconded by Trustee Richardson, moved to concur with the recommendation of the Zoning Board of Appeals and grant the requested special use to permit 2 amusement devices to be located at property commonly known as Twin Links Miniature Golf, 199 West Rand Road. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg Nays: None Motion carried. an Ordinance will be prepared for first reading May 3rd. ZBA 8-Z-833 ZBA 8-Z-83, 9-A-83, 10-SU-83, 11-V-83, 350 N. Wolf Road 9-A; 10-SU; & These cases deal with requests for property formerly ll-V known as Bond Elementary School, specifically: re-zoning 350 N.WOLF RD. from R-X to B-2; a text amendment permitting a private school to operate as a special use in a B-2 District; . a request for special use to permit a private photography school in'the B-2 District; and a variation to reduce the number of required off-street parking spaces. The Zoning Board of Appeals recommended granting the requests. Trustee Floros, seconded by Trustee Richardson, moved to concur with the Zoning Board of Appeals recommendation in Case 8-Z-83, to re-zone the subject property from R-X to B-2. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg Nays: None Motion carried. Trustee Floros~ seconded by Trustee Farley, moved to concur with the recommendation of the Zoning Board of Appeals in Case No. 9-A-83, to amend Chapter 14 to provide for private schools to operate in a B-2 District~ as a special use permit. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg Nays: None Motion carried. Trustee Arthur, seconded by Trustee Richardson, moved to concur with the recommendation of the Zoning Board of Appeals and grant the request for special use in Case No. 10-SU-83, permitting the Winona School of Photography to operate in a B-2 District, as a special use. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg Nays: None Motion carried. Trustee Floros~ seconded by Trustee Richardson, moved to concur with the recommendation of the Zoning Board of Appeals in Case No. 11-V-83, and grant the reduced number of off-street parking spaces. Etmhurst Road ZBA 4-V-83 Although an application for a variation was submitted -.~080 S.ELMHURS and advertised for a Zoning Board of Appeals hearing, ROAD the petitioner failed to appear before that Board. The Zoning Board of Appeals therefore recommended the case be dismissed. Trustee Floros, seconded by Trustee Richardson, moved to concur with the Zoning Board of Appeals and dismiss ZBA Case No. 4-V-83. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg Nays: None Motion carried. ZBA 12-S__SQmJ~ ZBA 12-SU-83, Ray Bar Harris Su~ercade (Randhurst Location RAY BAR This case'was submitted requesting a special use to operate SUPERCADE an amusement arcade within the Randhurst Shopping Center. The petitioner stated that they have 10 other locations mostly in the eastern states and that they have dealt with the Rouse Company (owners of Randhurst) for several years. The following people expressed concern over the possibility that school age children could play the games instead of going to school, as well other areas of concern: Sue Colucci, 400 S. Mount Prospect Road Linda Kolodziej, 212 N. Fairview Bill Blaine, 119 N. Emerson St. Mel Krumrey, 819 S. We Go spoke in favor of the business. Trustee Wattenberg, seconded by Trustee Richardson, moved to concur with the recommendation of the Zoning Board of Appeals and grant the requested special use to permit a game room arcade for Ray Bar at Rouse/Randhurst Shopping Center. Upon rclt call: Ayes: Farley, Floros, Richardson, Wattenberg Nays: Arthur, Murauskis, Krause Motion carried. An Ordinance will be presented for first reading at the May 3rd meeting. The Safety Commission submitted the following recommendations: AMEND CH.18 On a request for a 3-way STOP at Council Trail and Marina Dr., COUNCIL TR. the Safety Commission reCommended the Traffic Code be amended & MARINA to include a STOP sign for eastbound traffic on Council Traffic STOP SIGN at Marina Drive. Trustee Arthur, seconded by Trustee Farley, moved to concur with the recommendation of the Safety Commission to authorize a STOP sign for eastbound traffic on Council Trail at Marina Drive. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis Richardson Nays: Wattenberg Motion carried. MURA & A request for 3-way STOP at Mura Lane and Wintergreen Drive WINTERGREEN was considered by the Safety Commission, however, the- Commission did not feel the warrants were met sufficiently to warrant a STOP at that intersection. The Police Department was requested to monitor that area and. report back if the situation called for re-consideration. Trustee Murauskis, seconded by Trustee Arthur, moved to Page Seven Apr~il 19. 1983 concur with the recommendation of the Safety Commission and deny the request for a 3-way STOP at Mura Lane~ and Wintergreen Drive. CODA]TRY LN The Safety Commission also recommended that a request & EMERSON ST. for a 4-way STOP at Country Lane and Emerson Street be denied, since it did not meet the warrants. Trustee ~rthur, seconded by Trustee Wattenberg, moved to concur with the Safety Commission and deny the requested 4-way STOP at Country Lane and Emerson Street. A request to prohibit parking any time on the north and south side of Moehling Drive, entire jurisdiction, was considered by the Safety Commission with the recommendation to grant the request. Trustee Wattenberg, seconded by Trustee Richardson, moved to concur with the recommendation of the Safety Commission and authorize an amendment to Chapter 18 to reflect no parking any time on north and south sides of Moekling Drive, entire jurisdiction. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg Nays: None Motion carried. AMEND CH.22 An Ordinance was presented for first reading that ART. V would amend Article V, Chapter 22, relative to the procedures involved with placing liens against properties. Trustee Arthur, seconded by Trustee Wattenberg, moved to waive the rule requiring two readings of an ordinance in order to take action on the amendment to Chapter 22. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, RichardSon, Wattenberg Nays: None Motion carried. ORD.NO.3326 Trustee Arthur, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 332~6 .AN ORDINANCE TO AMEND ARTICLE V, ENTITLED "METERS AND RATES" OF CHAPTER 22 OF THE VILLAGE CODE OF MOUNT PROSPECT Upon roll Call: Ayes: Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg Nays: None Motion carried. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg Nays: None Motion carried. The Village Board went into Executive ~Session at 10:30 P.M. Mayor Krause reconvened the meeting at 11:05 P.M. RECONVENE Present upon roll call: Mayor Krause, Trustees Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg It was noted that discussing took place in Executive Session on the proposed settlement for the Fire Department, granting an increase of 3.96%, and increase in the clothing allowance from $275.00 to $300.00 per year, and deferral of federal income tax on monies paid into the Mount Prospect Firemen's Pension Fund. Trustee Murauskis, seconded by Trustee Richardson, moved RES.NO. 19-83 for passage of Resolution No. 19-83, effective May 1, 1983. A RESOLUTION PERTAINING TO FEDERAL INCOME TAX WITHHOLDING FOR MEMBERS OF THE MOUNT PROSPECT FIREMEN'S PENSION FUND Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Richardson, Wattenberg Nays: None Motion carried.
