MAYOR'S REPORT
Fire Chief Mike Figolah, assisted by Mayor Wilks, presented the 2009 Fire Prevention Poster
and Essay Contest winners from area schools. 950 students representing 12 schools
submitted a poster or essay depicting this year's theme of "Stay Fire Smart, Don't Get
Burned." This year the annual "Traveling Trophy" was awarded to Forest View School for
having the most entrants in the contest; 99% student participation.
The following employees are celebrating quinquennial anniversaries with the Village this
year. Mayor Wilks and Fire Chief Mike Figolah recognized those in attendance and
presented each with a plaque or certificate.

Mayor Wilks and Chief Figolah presented a "Special Recognition Award" to Mr. Dave
Fairburn, Mr. Tom Stahl and Mr. Jim Walsh; Mr. Stahl and Mr. Walsh were in attendance.
Mr. Fairburn, Mr. Stahl and Mr. Walsh are credited with saving the life of Mr. Greg Rose after
he suffered a heart attack at the Mount Prospect Golf Course, August 13, 2009.
Fire Lieutenant John Dolan, who along with his crew responded to the 9-1-1 call, provided
details about the event including the critical role Mr. Fairburn, Mr. Stahl and Mr. Walsh
played in saving Mr. Rose's life. He stated their actions not only saved Mr. Rose's life but
sent a message that people with CPR training can make a difference. Lieutenant Dolan
highlighted the importance of CPR and encouraged residents to learn the life-saving practice.
Mr. Rose also expressed his great appreciation to Mr. Fairburn, Mr. Stahl and Mr. Walsh and
the Mount Prospect Fire Department.

COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD
Mrs. Claus made an early, surprise visit to address the Village Board. Stating the Winter
Festival Parade is an important community tradition, she encouraged the Village Board to
reconsider their decision to cancel this year's parade.
In thanking Mrs. Claus for her comments, Mayor Wilks indicated the Village Board is hopeful
that with a stronger economy the parade will be brought back in 2010.

Mayor Wilks presented for a first (1st) reading an ordinance amending Chapter 18 (Traffic)
of the Village Code. This ordinance amends Section 18.2008, "Schedule VIII-Weekday
Parking" of Chapter 18.
Project Engineer Matt Lawrie presented background information stating this ordinance
amends the Village Code by repealing the parking restriction that prohibits parking Monday
- Friday 6:30 p.m. - 11 :00 p.m. along the east and west sides of Can Dota Avenue
between Council Trail and Shabonee Trail.
Mr. Lawrie, stated repealing the parking restriction would allow residents the benefit of on-
street parking during the evening hours. He noted no other local streets in the
neighborhood have similar parking restrictions or evening weekday parking problems.
A survey was sent to the properties along the block; seven (7) of the thirteen (13)
properties responded. Five (5) individuals support repealing the parking restriction, one (1)
is opposed and one (1) had no position.
The Safety Commission recommended the parking restriction be repealed by a vote of 7-0.

Mayor Wilks presented for a first (1st) reading an ordinance amending Chapter 18 (Traffic)
of the Village Code. This ordinance amends Section 18.2011 B, "Schedule XI - Two Hour
Parking" of Chapter 18.
Project Engineer Matt Lawrie presented background information stating this ordinance
amends the Village Code to provide a two (2) hour parking limit on the north side of
Prospect Avenue between William Street and Edward Street.
As part of the Prospect Avenue resurfacing project the Engineering staff evaluated on-
street parking near Timber Lane Apartments. Although designated as commuter parking,
staff determined that the north side of Prospect Avenue between William Street and
Edward Street was not being used by commuters. Through interdepartmental discussion it
was decided that short-term parking for the neighborhood would be more efficient use and
without impacting the demand for commuter parking. On a temporary basis over the last
few weeks, the north side of this block was converted to a 2-hour parking limit; there have
been no objections or issues during this time.
By a vote of 9-0 the Safety Commission recommended approval of the two (2) hour parking
limit on the north side of Prospect Avenue between William Street and Edward Street.
Villaqe Board Comments/Questions
· Economy may be affecting use of the on-street commuter parking spaces. Recommend
staff monitor commuter parking needs as economy improves; need to maintain adequate
number of available commuter parking spaces.
· Recommend staff review cash flow from commuter parking fees to determine if spaces
are filled/needed. [Assistant Village Manager Dave Strahl indicated staff will review cash
flow.]

Neighborhood Traffic Study; Final Report for Zones 11, 16, and 18
Mayor Wilks stated Project Engineer Matt Lawrie would provide the final report with staff
recommendations for Zones 11, 16, and 18.
Mr. Lawrie provided a summary of the results from the two (2) post studies conducted in
Zones 11, 16, and 18; 6 and 12 months following implementation of intersection control and
speed limit recommendations.
The post studies included review of accident records at all intersections in the neighborhood,
speed data as well as traffic and pedestrian data.
Zone 11 - bounded by Central Road to the north, Busse Road to the east, Golf Road to the
south and the western Village limits; 77 intersections and approximately 12 miles of street.
Holmes Junior High School and Forest View Elementary School are within the neighborhood.
The results of the post-studies indicate the operating characteristics within the neighborhood
have generally improved since implementation of the intersection traffic control and speed
limit modifications; traffic volumes and speeds are within acceptable ranges and the accident
rate has decreased. Staff continue to support the three (3) way stop at Lonnquist Blvd. and
Meier Road; as an alternative this intersection may also be a good candidate for traffic
calming controls.
Based on the post-studies, there are no recommended adjustments to the intersection
control or speed limit in the neighborhood.
Villaqe Board Comments/Questions
· Increased traffic volume on collector streets? [Mr. Lawrie - yes, but also streets with
previously low traffic volumes.]
· 70% decrease in accidents - validation that Village has taken the right approach;
consistency of neighborhood traffic regulations.
· Use of speed zone signs/flashing sign around schools? [Mr. Lawrie - only use school
zone signs; Village considering use of speed zone/flashing signs. Researching available
grants for future consideration.]
Zone 16 - bounded by Golf Road to the north, Busse Road to the east, Algonquin Road to
the south and the western Village limits; 22 intersections and approximately 4.3 miles of
street. John Jay Elementary School is within the neighborhood.
The results of the post-studies indicate the operating characteristics within the neighborhood
have generally improved since implementation of the intersection traffic control and speed
limit modifications. While some streets experienced an increase in traffic volume and/or
speed, the number of such locations has been very limited.
During the post-study the intersection at Pheasant Trail and Lavergne Drive was under
greater scrutiny. The T-intersection, approximately % mile from John Jay Elementary
School, experiences little pedestrian traffic during the day and is now controlled with one (1)
stop sign; prior to the comprehensive neighborhood traffic study the intersection was
controlled with three (3) stop signs. Residents were concerned change in signage would
increase traffic volumes and speed. Mr. Lawrie stated there have been no accidents at the
intersection over the past year and it operates more efficiently without stopping traffic on
Pheasant Trail; average travel speed has remained stable or decreased. Staff continue to
support a single stop sign on Lavergne Drive at its intersection with Pheasant Trail.

Based on the post-studies, there are no recommended adjustments to the intersection
control or speed limit in the neighborhood.
In response to questions from the Village Board, Mr. Lawrie provided the following
information.
· Pedestrian counts conducted at crosswalks; Tamarack Drive and Pheasant Trail and
Magnolia Drive and Pheasant Trail.
· No crosswalk at Pheasant Trail and Lavergne Drive.
· Plenty of opportunities for students to cross at crosswalks with crossing guards to get to
north side of Pheasant Trail.
Villaqe Board Comments/Discussion
· Residents have contacted Mayor Wilks directly to express concerns with student safety
and the build up of traffic as result of the removal of the stop signs at Pheasant Trail and
Lavergne Drive.
· Students should be crossing at Tamarack Drive and Pheasant Trail crosswalk.
· Pedestrian counts suggest more parents driving students to school.
· Weather should be factored in when doing pedestrian counts.
· Post-studies indicate the environment with the current traffic control/speed limits is safe.
Recommend staff continue to monitor Pheasant Trail and Lavergne Drive intersection to
ensure there are no changes impacting safety factor.
Zone 18 - bounded by Algonquin Road and Dempster Street to the north, Elmhurst Road to
the east, Interstate 90 and Oakton Street to the south, and the western Village limits; 6
intersections and approximately 2.8 miles of street. Lake Briarwood is within the
neighborhood.
The results of the post-studies indicate the operating characteristics within the neighborhood
have generally improved since implementation of the intersection traffic control and speed
limit modifications. Overall traffic volumes and speeds are within acceptable ranges and
there was not one (1) accident over the entire year. While some streets have experienced
an increase in traffic volume and/or speed, the number of such locations has been very
limited.
Based on the post-studies, there are no recommended adjustments to the intersection
control or speed limit in the neighborhood.
Mr. Lawrie closed his presentation with an overview of the public notification process for the
traffic zones; mailing to residents, public meeting and web page for each zone.
In response to questions from the Village Board Mr. Lawrie provided the following
information:
· Removal of stop by dam - no resident feedback regarding change.
· Only change in response to resident feedback was to keep residential neighborhood
speed limit to 20 miles per hour.
· Stop sign installed at shopping center. Safer to have stop sign at shopping center then
at Lake Briarwood Drive.
Mayor Wilks called for a motion for approval of the final report of the Neighborhood Traffic
Study - Zones 11, 16 and 18.

BINDING
REFERENDUM
PUBLIC QUESTION
ON THE BALLOT
FOR THE
FEBRUARY 2,2010
ELECTION
Mayor Wilks stated the next item under New Business was Item D. - an ordinance to
establish a binding referendum for the submission of a public question on the ballot for the
February 2, 2010 election. At the October 13, 2009 Committee of the Whole meeting the
Village Board continued their discussion of a tailored election process for the Village of
Mount Prospect; non-partisan, no primary election. As Trustee Zadel was absent from the
October 13th meeting and their had been no decision on whether the Village Board wanted to
move forward with the proposed binding referendum, Mayor's stated (1) before moving to
Item D. there should first be a vote as to whether the Village Board wanted to place the
binding referendum on the ballot [Mayor Wilks provided verbiage for the motion] and (2) as
Trustee Zadel was not part of the October 13th discussion, the discussion would be opened
with remarks from Trustee Zade!.
If the vote on the motion to place the referendum on the ballot is favorable, Item D will be
presented for a first (15t) reading; discussion to include referendum verbiage. The item will
be held for a second (2nd) reading; November 3, 2009 Village Board meeting.
As a point of order, Trustee Polit stated if there is a request to reconsider this matter at the
November 3rd meeting, the motion must be made by a Trustee who was on the prevailing
side of the vote.
Trustee Zadel stated he would like to pursue having the referendum on the February 2, 2010
ballot. He expressed a number of concerns regarding the state's interpretation of election
laws and the impact on local elections. Trustee Zadel indicated the inconsistent interpretation
of state election laws and the untimely amendments to the candidates guide created
significant uncertainty of procedural requirements for candidates seeking office in the 2009
election.
Although it is unclear whether an increase in the required number of signatures on a petition
will have a significant impact, Trustee Zadel believes having a consistent method of
conducting an election will serve in the best interest of the Village. Election process that
serves in the best interest of residents mirrors process the Village used successfully prior to
the 2009 election.
Following Trustee Zadel's comments the Village Board discussed the merits of a "tailored"
election system as well as the merits of the State Election Code election system.

untimely publication of candidate's guide
· State law allows the Village to adopt an election process for local elections
· Increase in signature requirements doesn't change quality of candidate but may
quality of commitment.
· Village has capability to provide candidate information/petitions to public.

· Consistency of candidate forms/information on state's web site.
· Signature requirements - potential impact regardless of number

Additional comments included:
· Voters may be confused by referendum.
· Issue to voters - no primary and number of signatures.
· Approach taken by other municipalities in situation similar to the Village of Mount
Prospect - wait for the State Board of Election to tell them they were doing something
wrong.

Signature requirements - (1) potential to create candidate slates and (2) influence
commitment/motivation of potential candidates.
Allowing the process to go through another election cycle as is will only create more
confusion.
Trustees on both sides have fully researched matter and Village has obtained legal
opinion - Village Board able to make informed decision.

specifically for the Village of Mount Prospect.

Mayor Wilks, presented for a first (1st) reading an ordinance establishing a binding
referendum for the submission of a public question on the ballot of the February 2, 2010
election. This ordinance establishes a referendum question as to whether the Village of
Mount Prospect shall, by binding referendum, continue its non-partisan system of electing its
mayor and trustees, but use a nominating signature requirement that is equal to 1 % of the
number of registered voters in the Village of Mount Prospect and no primary election being
required.
Trustee Juracek stated, as the decision to move forward with the referendum had been
made, it was imperative to make sure the referendum question was well-stated; the first (151)
version is clearly stated. Noted that the word of needed to be inserted between the words
number and voters.
Trustee Hoefert, suggested the wording be revised as follows: ... no primary election being
required ~ and insert... require no primary election?
There was general support to revise the language as suggested by Trustee Hoefert,
however, the Village Clerk was asked to have revision approved by the Village Attorney Mr.
Hill before making the revision.
Mayor Wilks stated the second reading of the ordinance would be held at the November 3,
2009 Village Board meeting.

REPORT
VILLAGE MANAGER'S REPORT
A. Request Village Board approval to waive bid requirements and accept proposal for the
purchase and installation of a new spray paint booth in an amount not to exceed
$128,500.

BOOTH
Public Works Vehicle Maintenance Superintendent James Breitzman presented background
information and staff recommendations for the purchase and installation of the spray paint
booth.
The new spray paint booth will replace the Public Works' original spray paint booth installed
in 1988. As part of the vehicle maintenance expansion project, the original booth was
removed to provide a service bay for fire department vehicles; the new spray paint booth will
be installed in a newly constructed bay.
Due to the nature of the work and available vendors, the Village solicited proposals for the
purchase and installation of the spray paint booth. Three (3) proposals were received; staff
recommend the contract be awarded to Jones Equipment Company - lowest proposal
submitted.

Trustee Korn stated Sunday, October 24th was the last Farmers' Market for 2009.
Trustee Juracek stated the Mount Prospect Historical Society was having a fundraiser,
Sunday, October 25th; Fashion Show and Luncheon at the Wellington.
Mayor Wilks complimented the Mount Prospect Downtown Merchants Association and all
participants on the success of the Fall Festival and Oktoberfest held Saturday, October 1 tho
