MAYOR'S REPORT PROCLAMATION Mayor Krause proclaimed the week of April 6 12, 1986 LIBRARY WEEK as National Library Week in the Village of Mount Prospect. PRESENTATION: Mayor Krause presented plaques to David C. Jepson, DAVID JEPSON, Director of Finance for the Village. The Village has FINANCIAL recently been awarded the Certificate of Achievement REPORTING from the Financial Officers Association. It is through AWARD the efforts of Mr. Jepson that the Village qualified for this award for excellence in financial reporting, which is the second year in row the Village has received this award. Mayor Krause and members of the Board expressed their congratulations and appreciation to Mr. Jepson. PROCLAMATION: Mayor Krause then proclaimed the month of April, 1986 as CANCER CONTROL Cancer Control Month in the Village of Mount Prospect. MONTH An Ordinance was presented for second reading that would AMEND. CH.13 delete one Class "R" and increase the Class "W" liquor licenses by one. This change is due to the fact that PIZZA HUT Pizza Hut, located on Algonquin Road only serves beer CLASS "W" and wine and the Class "W" liquor license is appropriate for that type of sales. Trustee Farley, seconded by Trustee Wattenberg, moved to waive the rule requiring two readings of an Ordinance. OLD BUSINESS AMEND An Ordinance was presented for first reading that would COMPREHENSIVE amend the official comprehensive plan of 1981 to reflect PLAN: light industrial zoning rather than multi-family for ROSENOW PROPERTY property commonly known as the Rosenow Property, which is SOUTH BUSSE RD. located on the west side of Busse Road approximately 800 feet north of the Tollway. The Plan Commission has reviewed this request and recommends granting. This property was annexed to the Village on March 18th. This Ordinance will be presented April 15th for second reading. ZBA 3-Z-86 & The subject property is the subject of two zoning ZBA 4-V-86 cases, ZBA 3-Z-86 and ZBA 4-V-86. Page 2 April 1, 1986 BA 3-Z-86, South Busse Road An Ordinance was presented for first reading that would rezone the subject property from R-X to I-1. This Ordinance will be presented for 2nd reading on April 15th ZBA 4-V-86, South Busse Road An Ordinance was presented for first reading that would grant the following vafiations: reduce the number of parking spaces from one per 200 sq.ft, to one for 250 sq. ft. of gross floor area of office area; one space per 1~500 sq. ft. for warehouse and one space per 1,000 sq. ft. of assembly area; 20 ft. side yard on the north, instead of the required 40 ft.; and 10 ft. side yard on the south, instead of the required 30 ft. The Zoning Board of Appeals recommended approval of all requests 4-0. This Ordinance will also be presented April 15th for second. The petitioner was instructed to work with staff to assure adequate buffering is provided between the multi-family dwellings to the north and this proposed development. An Ordinance was presented for second reading that would T.I.F. authorize the purchase of property commonly known as ACQUISITIOI 206 East Evergreen as part of the Tax Increment Finance 206 EVERGRi District No. I project of the Village. Trustee Arthur, seconded by Trustee Wattenberg, moved for ORD.NO. 36~ passage of Ordinance No. 3628 AN ORDINANCE APPROVING REAL ESTATE PURCHASE AGREEMENT FOR PROPERTY COMMONLY KNOWN AS 206 EAST EVERGREEN, MOUNT PROSPECT, ILLINOIS Upon roll call: Ayes: Arthur,~Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. ZBA 53-Z-85, Mr. How Property (201 West Rand Road) ZBA 53-Z-I An Ordinance was presented for first reading that would 201W.RAN[ rezone the subject property from B-1 to B-3. The Zoning Board of Appeals recommended this rezoning by a voted of 6-0. This Ordinance will be presented April 15th for 2nd reading. ZBA 54-SU-85, Mr. How Property (201 W. Rand Road) ZBA 54-SU. An Ordinance was presented for first reading that 201W.RAN[ would grant a special use to permit 2 signs on one lot of record, instead of the one sign permitted. The Zoning Board of Appeals voted 1-4 to recommend denial of the special use for the signs due to the size of the proposed identification sign. At the March 18th Village Board meeting, Mr. Fink stated that he would like to amend the request for the sign by reducing the size of the identification from 130 sq. ft. to 90 sq. ft. The new sign would identify the shopping center and not have tenant panels on it. This Ordinance reflects the reduced area for the sign and will be presented April 15th for second reading. Page 3 - April 1, 1986 ZBA 71-V-85 ZBA 71-V-85, Acme Wiley (Montgomery Wards sign) MONTGOMERY WARDS An Ordinance was presented for first read that would SIGN grant this variation to alter the existing non-conforming Montgomery Wards Auto Center sign, located on Kensington Road. The Zoning Board of Appeals recommended approval of the request by a vote of §-1. Trustee Arthur, seconded by Trustee Wattenberg, moved to waive the rule requiring two readings of an Ordinance. Elmhurst Avenue An Ordinance was presented for first reading that would grant a variation to exceed the floor area ratio from the permitted .35 to .38. It is proposed that a single family home be constructed on this 50 foot lot. The Zoning Board of Appeals recommended 6-0 to grant this variation. Trustee Farley, seconded by Trustee Wattenberg, moved to waive the rule requiring two readings of an Ordinance. Trustee Farley, seconded by Trustee Wattenberg, moved ORD.NO.3630 for passage of Ordinance No. 3630 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS. 219 SOUTH ELMHURST AVENUE IN THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. Page 4 - April 1, 1986 BA 73-V-85, 606 South Busse Road ZBA 73-V-~ An Ordinance was presented for 2nd reading, having been 606 S.BUS~ continued from the March 4th meeting, that would grant a variation to permit a structure in the form of a covered canopy in the front yard. At the request of the petitioner, this matter was continued to the May 6th meeting. This is the final continuance to be granted this case. NEW BUSINESS A request to increase the taxi fares has been received from TAXI CAB American Taxi. FARE INCRE REQUEST Randall Moss, President of American Taxi, stated that fares have not been increased in 6 years and that the costs for operating this type of service have increased therefore the requested rate increase is requested. Mr. Moss noted that the surrounding communities have adopted the increases. The proposal is as follows: Current rates: $1.00 for first 3/10 of a mile or fraction thereof 10 cents for each additional 1/10 mile or fraction thereof 20 cents for each 1-1/2 minute of waiting time or traffic delay. Proposed rates: $2.00 for first mile or fraction ~hereof 12 cents for each 1/10 mile or fraction thereof 40 cents for each 1-1/1 minute of waiting time or traffic delay. Mayor Krause noted that many complaints are received from residents as to the type of service received from the cab companies, including excessive waits for the cab; over-charging; and rude drivers. The Mayor suggested that Mr. Moss meet with certain property managements companies, namely Centennial in an attempt to resolve some of the problems. Members of the Board stated that while they support the increase in fares, they would withhold a decision on the requested increase until such a meeting was held. This matter was continued to the April 15th meeting of the Village Board. ZBA 7-Z-86, ZBA 8-SU-86, and ZBA 9-V-86, Linnemann Road and ZBA 7-Z-8( Church (St. John's Property) ZBA 8-SU-( These cases deal with a request to rezone the subject ZBA 9-V-8( property from R-X to R-3, to grant a Planned Unit ST.JOHN'S Development to permit 36 townhouse units on one lot of PROPERTY: record and a variation to permit parking in a portion of the LINNEMANN required side yard. The Zoning Board of Appeals recommended denial of these requests by a vote of 2 in favor and 4 opposed. The reason the Zoning Board recommended denial was due to the high density proposed. Mr. Mitroff, petitioner, presented a revised plan which reduces the number of proposed units from 36 to 32 and a redesign of the development. The new plan shows two clusters of buildings with interior circular driveways, with a 50% increase in guest parking spaces which will be provided within the interior circle area. There was also a question as to the detention area in the original proposal, however, the modified plan indicates a Page 5 - April 1, 1986 detention basin on the property that will have a restrictor and in accordance with Village standards, will permit the storm water to flow to the Village's basin at Linnemann and Golf Roads. A letter was read from the Huntington Commons Master Association indicating that would not grant permission to this development to allow storm water to be directed into their private lake. It was also noted that all other requirements of the Village, including curbs, sidewalks, street lights, etc. will be met. The following residents spoke on this proposal: Nancy Barlasola Dave Tolsman, 834 Partridge Jerry Holtman Maureen Weiner, 802 Partridge Dave Stanger, 818 Partridge Resident, 1001 Willow Lane Some of the concerns expressed were: flooding, traffic congestion, density of the development, and guest parking. I.t was the feeling of the Board to approve the amended plan, reflecting increased parking and reduced density, from the original 36 units to the 32 units. Trustee Arthur, seconded by Trustee Floros, moved to grant the rezoning from R-X to R-3 as requested in ZBA 7-Z-86. Trustee Floros, seconded by Trustee Arthur, moved to grant the special use in the nature of a planned unit development in ZBA 8-SU-86, as amended to reflect 32 townhouse units. RECONVENE Present upon roll call: Mayor Krause Trustee Arthur Trustee Farley Trustee Floros Trustee Murauskis Trustee Van Geem Trustee Wattenberg ZBA 6-A-86, Text Amendment ZBA 6-A-8 Seven text amendments w'ere presented as follows: AMEND CH. ONE: Amend Section 14.2205.A.1 to provide for revised parking calculations in the Industrial District. Delete Section 14.2205.A.1 in its entirety and substitute as. follows: 1. In the I-1 Light Industrial District, there shall be provided a paved off-street parking area sufficient in size to provide a minimum of one (1) parking space for each two hundred and fifty (250) square feet of gross floor area of the building and shall be exclusive of parking of trucks or vehicles operated by any uses on the property, except that: a. One off-street parking space shall be provided by each 1,500 space feet of gross floor area or fraction thereof used for warehouse purposes; and b. For any portion of any building used for a laboratory, data processing center, assembly or product repair permitted in the I-1 District: 1) 0.8 spaces shall be provided for each person employed in the primary work shift operating in such portion of the building plus 0.5 spaces for each person employed in the work shift having the next largest number of employees or alternatively 2) one space for each one thousand (1,000) square feet of floor area or fraction thereof, whichever shall result in the calculation of the larger required number of spaces. The Zoning Board recommended 6-0 to approve this text amendment provided that vehicles used in conjunction with the operation of the business should not occupy parking spaces required under the Ordinance. Trustee Arthur, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Zoning Board of Appeals in text amendment ONE. TWO: Amend the I-1 Light Industrial District Section 14.2205.F of the Zoning Ordinance to provide for revised setback of parking when located in a required side yard or rear yard, by amending as follows: Page 7 - April 1, 1986 1. In all instances wherei~ industrial side yards and/or industrial rear yards, adjacent to interior lot lines, are utilized for parking; a minimum open space of ten feet (10') shall be required along such lot line. In no case shall parking be placed closer than thirty feet (30') to an exterior lot line. The Zoning Board of Appeals recommended approving .. this text amendment 6-0, provided that no parking should be permitted in any transitional yard. Trustee Arthur, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Zoning Board of Appeals in text amendment TWO. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis,. THREE: Amend the following Sections of the Zoning Ordinance to ensure compliance of the Ordinance with recent Federal Communications Commission ruling directing all antennas be addressed similarly. Delete in its entirety, Sections 14.1004.C.1, 14.1102.C.1, and 14.1204.C.1 to eliminate amateur radio operator ~ antennas as a permitted use. Add a new Section 14.1001.C.5, 14.1101.C.5, 14.12.01.D.5, and 14.1301.C.3 to put amateur radio operator antennas as a special use, to read as follows: Federally licensed amateur radio operators transmitting antenna towers with a maximum height of sixty feet (60') and such antenna towers, Including tower structures, having an overall height of not more than seventy feet (70'). By a vote of 6-0, the Zoning Board of Appeals recommended granting the text amendment THREE. Trustee Farley, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Zoning Board of Appeals and grant this text amendment. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. FOUR: Revise Sections 14.602.B.9, t4.702.B.7, and 14.802.B.2.f to provide for surveys to be prepared by a licensed surveyor and to be of adequate scale to read as follows: Page 8 April 1, 1986 A current plat,~of.~su~vey of the subject property, prepared by an=Illinois Registered Land Surveyor, at a scale of 1" : 50', 1" : 40', 1" : 30', 1" = 20', or other scale approved by the Zoning Administrator for larger acreage projects, which plat shall show all structures, with dimensions, on the lot, drives and parking areas, all lot dimensions, and distances of structures from lot lines. Revise Section 14.'602.B.10, 14.702.B.8, and 14.802.B.2.g to require site plan to be of adequate scale, to read as follows: A site plan of the proposed improvements at a scale of 1" = 50', 1" = 40', 1" : 30', 1" : 20', or 1" : 10', or other scale approved by the Zoning Administrator for larger acreage projects, which plan shall show all structures, with dimensions,' on the lot, drives and parking areas, all lot dimensions, distances of structures from lot lines, and required setback lines. Members of the Zoning Board offered alternative scales which would be very similar to the existing requirements therefore this proposed amendment was withdrawn by the petitioner FIVE: Revise Sections 14.602.C.1, 14.702.C.1, and 14.803.C.1 to-clarify requirements for proof of ownership required to file for a variation, special use, or amendment; to read as follows: Proof of ownership and proof of authority on behalf of the owner shall be submitted and shall consist of the following: a. Torrens Certificate, Warranty, Trust or other deed, contract for purchase, or title policy issued on behalf of the applicant; b. Any property in trust shall include a copy of the Trust Agreement listing all beneficial interests in the Trust; c. Any property owned by a partnership or a · corporation shall list all individuals holding ten percent (10%) or more of the ownership; and d. Any application filed by an individual other an the legal owner or contract purchaser shall be accompanied by written authorization by the owner for the agent to represent the owner. The Zoning Board of Appeals recommended granting this text amendment FIVE .by a vote of 6-0. Trustee Arthur, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Zoning Board of Appeals and grant text amendment FIVE as proposed. Page 9 April 1, 1986 SIX: Amend Section 14.102.B.2 to allow a two foot (2') setback for detached stmuctures when located on a lot of fifty foot (50') in width or less. Revised Section 14.102.B.2 to read as follows: 2. Setback. A permitted detached accessory building shall have a minimum setback of five feet (5') from any interior lot line as measured to the closest edge of the structure; except that any detached accessory structure on a lot with a width of fifty feet (50') or less may be setback two feet from any interior lot line. The minimum setback from any exterior lot line shall be established for such yard in the particular zoning district. The Zoning Board of Appeals recommended approval of this text amendment SIX by a vote of 4-2. It was noted that the Fire Department expressed concerns about safety if structures are allowed to be closer that presently provided. It was the opinion of the Village Board that this amendment should be withdrawn, based on safety factors involved. SEVEN: Amend Sections 14.504 and 14.604.A of the Zoning Ordinance to make the Zoning Board of Appeals final in several variation requests in the Single Family and Duplex Districts. New Section 14.504.D.3 to read as foll'ows: 3. In all cases in the R-X, R-l, R-A, and R-2 Districts in which the variation will not increase the maximum width of driveway by more than twenty-five percent (25%). New Section 14.504.1 to read as follows: 1. To hear and decide all application for variations from the location setback regulations and restrictions contained in Article IX of Chapter 21 of this Village Code for property located in the R-X, R-l, R-A, or R-2 Zoning Districts with regard to private swimming pools in all cases in which the variation will not decrease the minimum location setback requirements contained therein by more than twenty-five percent (25%). Revise Section 14.604.A. to limit the percent of variation allowed in residential districts to read as follows: 10. to vary the location setback regulations contained in Article tX of Chapter 21 relating to private swimming pools provided that no such variation shall exceed twenty-five percent (25%) of the requirement. Page 10 - April 1, 1986 Add a new Section to provide for an appeal procedure of any variation decision where the Zoning Board of Appeals is final. Section 14.604.D. In any case whereby a variation is granted by final action of the Zoning Board of Appeals, there shall be specific findings of fact itemized, which are used to substantiate the decision of the Zoning Board of Appeals and which -.. address each and all of the standards as set forth in this Chapter. Any individual aggrieved by a decision of the Zoning Board of Appeals whether an applicant or objector, within two-hundred and fifty feet (250') of the subject property, may file an appeal of the decision with the Village Board. Such as appeal' shall be filed on such forms as may be necessary with the Zoning Administrator and shall pay such fees as deemed necessary to cover all municipal expenses on the appeal. Such appeal shall be filed within fifteen (15) calendar days of the date of decision to be contested. No decision of the Zoning Board of Appeals shall be effective until fifteen (15) calendar days has passed; after which permits may be issued by the Village for construction. The Zoning Board of Appeals recommended approving this text amendment SEVEN by a vote of 6-0. Trustee Floros, seconded by Trustee Van Geem, moved to concur with the recommendation of the Zoning Board of Appeals in text amendment SEVEN provided that no fee be charged to objectors and that the word "aggrieved" be deleted. SELL VILLAGE An Ordinance was presented for first reading that OWNED PROPERTY: would authorize the sale of an ambulance, which has AMBULANCE 522 been replaced. This vehicle is a 1977 Ford and known as Ambulance 522. It is proposed that this vehicle would be auctioned in conjunction with the Northwest Municipal Conference. A minimum bid of $500 has been established. Trustee Arthur, seconded by Trustee Murauskis, moved to waive the rule requiring two readings of an Ordinance. ANNUAL BUDGET The Village Manager presented a Resolution that 1986/87 provides for the filing of the annual budget and establishing a public hearing date of April 15th. RES.NO. 12-86 Trustee Van Geem, seconded by Trustee Wattenberg, Page 12 4/1/86 oved for passage of Resolution No. 12-86 A RESOLUTION PROVIDING FOR THE FILING OF THE TENTATIVE BUDGET OF THE VILLAGE OF MOUNT PROSPECT FOR THE FISCAL YEAR COMMENCING MAY 1, 1986 TO APRIL 30, 1987 AND FOR PUBLIC INSPECTION AND HEARING THEREON Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. Mr, Burghard presented the proposed budget for fiscal yea~ 1986/87 along with an Ordinance for first reading that would adopt the budget. The Village Manager noted that public hearings have been held on all the items listed in the budget and that the proposal is for a total of $28,448,040, which total includes the budget for the Mount Prospect Public Library. Trustee Arthur asked that the Village Board consider funding the Police Pension. At a recent public hearing it was determined that since that Fund is 112% funded that the Village did not need to make the annual contribution, however it was pointed out that in order to keep the fund in such good condition, the Village's contributions must be continue. Trustee Arthur, seconded by Trustee Farley, moved to budget the funds necessary for the Police Pension Fund. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. This Ordinance adopting the budget for fiscal 1986/87 will be presented April 15th for second reading. Trustee Floros asked the Board members to reconsider their position on approving the 9 additional employees requested in the proposed budget, stating that he did not feel services in the Village have been effected and does feel thes~ additional employees are warranted. There was discussion by members of the Board on this subject, stating that with the new Fair Labor Act, it will be more economical to hire additional employees than to pay the time and a half required by the Act. It was also noted that this isa major increase in personnel but a majority of the Board supported the additional 9 employees. WAIVE BIDS The Village Manager presented a request to waive the bidding EMERGENCY process in order to authorize emergency repairs on a Fire REPAIRS ON Department pumper. The repairs necessary are specialized PUMPER and are needed immediately. The estimated cost of repairs are $7,000. Page 13 - April 1, 1986 7O Trustee Arthur, seconded by Trustee Floros, moved to waive the bidding procedures in order to make the necessary emergency repairs on the pumper and authorized the administration to have such repairs done at a cost not to exceed $7,000.
