RESOLUTION NO. 5-90'
A RESOLUTION AUTHORIZING EXECUTION OF A
LEASE AGREEMENT BETWEEN THE VILLAGE OF
MOUNT PROSPECT AND FRANCIS CADILLAC
WHEREAS, the Village of Mount Prospect ownsproperty commonly
known as 11 South Pine, Street, Mount Prospect, Illinois; and
WHEREAS, the Village of Mount Prospect is desirous of renewing a
Lease Agreement for the property commonly known as 11 South Pine
Street, Mount Prospect, Illinois with Francis Cadillac, being the
subject of'Resolution No. 23-89.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the corporate authorities of the Village of
Mount Prospect do hereby authorize the Mayor to sign and Village
Clerk to attest his signature on a Lease Agreement between the
Village'of Mount Prospect and Francis Cadillac for Village owned
property commonly known as 11 South Pine Street, Mount Prospect,
Illinois, a copy of said Lease Agreement is attached hereto and
hereby made a part hereof as Exhibit A.
SECTION TWO: That this Resolution shall be in full force and
effect from and after its passage and approval in the manner
provided by law.

Dear Mr. Mauro:
Attached please find an original of the fully executed Lease between the Village of
Mount Prospect and Francis Cadillac. Please note tha! in paragraph B., the final three
words, "to Francis Cadillac" have been deleted because of a drafting error. The intern
of the parties was that upon ninety (90) days' written notice to the other party, either
Francis Cadillac or the Village of Mount Prospect had the right to terminate the Lease.
I believe the intent of the parties was clear and do not see the need for retyping and
then re-executing the document nnless you feel otherwise. Please contact me immediately
if this causes you concern.
As per paragraph E., Francis Cadillac is required to pay for any gas bills incurred as part
of the use of the property. With the next billing cycle, I will make arrangemems to have
Francis substituted for the Village and, thereby, you will receive the bill directly.
Should you have any questions or comments regarding this matter, please do not hesitate
to contact me directly. Thank you for your cooperation.

RENTAL AGREEMENT
VILLAGE OF MOUNT PROSPECT
FRANCIS CADILLAC
The Village of Mount Prospect is willing to let you rent the old Public Works garage at
i1 South Pine Street, Mount Prospect, Illinois for $4,500 per month for storage of
automobiles. This rental is subject to the following basic conditions:
A. Monthly rental of $4,500 payable in advance and due the first day of every
month (may prorate for first and last months).
B. Monthly rental rate to remain firm for a period of twelve (12) months from
this date at which time a new rate may be negotiated; except that either
party reserves the right to cancel this Lease upon ninety (90) days' written
notice. ~ .
C. Twelve (12) month fixed lease beginning January 1, 1990 and ending
December 31, 1990. At the end of this period, an extension of new lease
period may be negotiated.
D. The Village of Mount Prospect will include use of electricity and water as
part of the rental agreement.
E. Francis Cadillac will pay all gas bills for heating. As this is a sprinkled
building, minimum heat setting should be 50 degrees.
F. The outside parking area on the south side of the building is included as
part of this Agreement.
G. The Village will maintain ail electrical and heating systems plus plumbing
systems. The Village will not repair the hydraulic hoists nor advocate the
use of them.
H. Francis Cadillac must provide a current certificate of insurance naming the
Village of Mount Prospect as additional insured regarding this rental (see
sample attached).
I. Francis Cadillac must provide the Village with a current "hold harmless
agreement as shown on the attached sheet.
J. Francis Cadillac will not display any signs on the exterior building or
grounds during this lease period.
K. Any sales of vehicles from the building is prohibited and any taxes that may
be due as a result of this Agreement are the responsibility of Francis
Cadillac.
The building is presently occupied by Francis Cadillac for the current Lease Agreement
dated June 22, 1989. Acceptance or rejection of this Rental Agreement must be
completed prior to the expiration of the current Rental Agreement. All rental paymenis
and insurance documents are to be directed to:
