A RESOLUTION ACCEPTING AND AUTHORIZING THE EXECUTION
OF A GRANT AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT
AND THE ENVIRONMENTAL PROTECTION AGENCY.
WHEREAS, The State of Illinois enacted an Environmental Protec-
tion Act which provides in part for the control of water pollu-
tion in Illinois; and
WHEREAS, the Pollution Control Board pursuant to said Act has
adopted regulations establishing water quality standards and
effluent limitations which must be attained by the Village of
Mount Prospect in the operation of its sewage treatment plant
and associated works; and
WHEREAS, grant funds have been provided by the State of Illinois
to assist local governments in the construction of facilities
which will ensure compliance with the standards and limitations
established by the Environmental Protection Act and regulations
adopted pursuant thereto; and
WHEREAS, the Village of Mount Prospect has made application for
a grant from the State of Illinois for the design and construc-
tion of a sewage treatment improvement and/or modification
project which will satisfy the requirements of the Environmental
Protection Act and the regulations adopted pursuant thereto; and
WHEREAS, the Environmental Protection Agency of the State of
Illinois has made an offer of grant for said pro3ect designated
as C!7-3029, a copy of which is attached as Exhibit A hereto;
and
WHEREAS, the corporate authorities, after due investigation and
consideration, have determined that acceptance of said grant
offer and entering into a grant agreement with the State of
Illinois will serve the public good and is necessary to ensure
compliance with the Environmental Protection Act and regulations
adopted thereunder;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Board of
Trustees of the Village of Mount Prospect, Cook County, Illinois:
SECTION ONE: That the Mayor and Board of Trustees hereby find
as facts all of the recitals in the Preamble of this ReSolution
as well as the description of the project contained in the grant
offer (Exhibit A hereto).
SECTION TWO: That the Mayor and Board of Trustees hereby
accept said offer and agree to all terms and conditions thereof,
including all special conditions, general conditions and assur-
ances contained therein and made a part hereof by reference and
also agree that the grant f.unds awarded will be used solely for
the purposes of the project as approved by the Environmental
Protection Agency of the State of Illinois in accordance with
the terms and conditions of said grant offer.
SECTION THREE: That the Village Manager is authorized and
directed to execute the said grant offer on or before April 5,
1990, a copy of which is attached hereto as Exhibit A.
SECTION FOUR: That the clerk be and is hereby directed to
file a certified copy of this Resolution with the said executed
grant offer and transmit sufficient copies of the same to the
Environmental Protection Agency of the State of Illinois at
Springfield, Illinois on or before April 15, 1990.
ECTION FIVE: This Resolution shall be in full force and
effect from and after its passage and approval as provided by
law.

PART I~ PROJECT DESCRI~ION
The project consists of a design allowance and sanitary sewer rehabilitation to
eliminate excessive Infiltration/Inflow (I/I) in accordance with the Village of
Mount Prospect's ICAP Report. Specifically, the project consists of the
following:
° Insituform lining of 1,363 L.F. of 8 inch diameter sewer.
° Insituform lining of 671L.F. of 10 inch diameter sewer.
° Insituform lining of 662 L.F. of 12 inch diameter sewer.
° Clean, test and grout 6,100 L.F. of sewer.
o Rehabilitation of 7 manholes.
° Spot replacement of 150 L.F. of 8 inch diameter sewer.
° Spot replacement .of 205 L.F. of 10 inch diameter sewer.
o Spot replacement of 95 L.F. of 12 inch diameter sewer.

SPECIAL GRANT C0NOITIONS
1. This Grant Offer is based upon the estimated project cost as furnished to the Agency by the
Applicant. The Agencymay. at the Agency's sole option, Increase or decrease the amount of thts
Grant Offer by issuance of a Supplemental Grant Offer.
2. Schedule of Payments. Paxment requests for pro~ect ~ork will be processed in accordance wtth the
following schedule of payments, sub~ect to appropriation of funds by the Illinois General Assembly
and subsequent sale of bonds.
Prior to the Initiation of construction the applicant shall submit to the Agency a p~oposed payment
schedule for the constructton ~ork. The Applicant shal~ a~alt ~rttten approval of the paint
schedule by the Agency prior to initiating construction. The approved schedule ~tll beco~ a part
of thfs grant.
Requests for paint for construction ~ork ~y be su~tted tn accordance ~tth the approved
schedule for the construction ~ork. Paint requests shall ~e su~ttted ~n ~rlt~ng tn accordance
~tth the State General Conditions on Gr~nt Paint Schedules. Upon approval of the applicant's
request for paint by the Agency, a paint ~ill be processed.

4. Engineering Contracts. Notwithstanding the task ~n~ttation dates ~denttfted in the Pro~ect
Schedule. contained here~n, the Applicant sha~l not ~nitiate ~ork unttl recetpt of ~r~tten Agency
approval of the consulting engineering agre~nts and ~r~tten authorization to ~ni[~ate the work.
The Applicant shall su~tt proposed consulting engineering agre~nts, prepared in accordance ~tth
. the requ~r~nts as contained tn the State General Conditions, sufficiently tn advance of the d~te

6, 81d Advertising and Contract A~ard. Notwithstanding state Genera~ C0ndittons on project initiation
and not~ithstand!ng the Pro~ect Schedule dates, contained heretn, for adverttse~nt and
construction bids and e~ard on construction contract, the applicant shall not advertise for bids or
a~ard construction contracts ~tthout prior ~rttten authorization to tntttate the Step 3 ~ork.
7. 0peratton end Hatnten~nce. The Agency shall not pay:
~, ~re than S0 percent of the State share of any Step 3 project unless the applicant has
furnished a draft of the operation and maintenance ~nual (reference the State General
conditions for requtr~nts concerning the operations and ~tntenance manuel) for review, or
adequate evidence of t~ly deve~o~nt of such a draft;
b. ~re than 90 percent of the State share of any pro~ect unless the applicant has furnished a
satisfactory f~nal operation and maintenance ~nual for the project.
8. C~pltance ~tth ACt and Regulations. The Agency shall not make any paints under this Grant Offer
~f the construction (Step 3) project has been c~pleted and ~s being operated in violation of an7
of the provisions of the Envtron~ntal Protection Agency (~11. ~ev. Stat. 1985, Ch. 111 1/2, par.
1001 et seq.) or ~ater Pollution Regulations of [11tno~s (Tttle 35: Chapter 1: Pollution Control
Board) adoptedthe~eunaer.

1: PROJECT SCHEDULE
For the purposes of this agreement the start date will be the date the
agreement is executed by the governmental entity and the complete date will be
the date of final pa~vment. Any obligation of the State of Illinois and the
Agency to make any payment of Grant funds shall terminate unless this project
work is initiated and completed in accordance with the following schedule:

2. FACILITY PLANNING
The Agency's acceptance of the ICAP Report constitutes a determination that
the applicable facility planning requirements set forth in the State General
Conditions have been met for the project~
3. FINAL EFFLUENT LIMITATIONS
There are no effluent limitations assigned to'this project inasmuch as it
consists of only the rehabilitation of the sanitary sewer system. The MWRDGC
O'Hare Water Reclamation Plant has the appropriate effluent limitations.
4. WAIVER OF CERTAIN GENERAL CONDITIONS
In accordance with the State General Conditions on Waiver of Conditions,
waiver is hereby granted to the following General Conditions for this grant
project:

5. SCHEDULE OF PAYMENTS
Payment requests for project work will be processed in accordance with the

6. DESIGN ALLOWANCE
The design allowance is based upon the eligible construction costs calculated
in accordance with Appendix B of the February 17, 198¢ Federal Register.
7. BUILD ILLINOIS GRANT
This Build Illinois grant may not exceed 70% of the eligible project costs
including the design allowance.
8. COMPLIANCE WITH ACT AND REGULATIONS
The Agency shall not make any payments under this Grant Offer if the
construction (Step 3) project has been completed and the facility is being
operated in violation of any of the provisions of the Environmental Protection
Agency (Ill. Rev. Stat. 1985, Ch. lll 1/2; par. lOO1 et seq.) or Water
Pollution Regulations of Illino)s {Title 35: Chapter l: Pollution Control
Board) adopted thereunder;
