RESOLUTION NO. 44-90
A RESOLUTION REGARDING THE RELEASE
OF EXECUTIVE SESSION MINUTES
WHEREAS, the Mayor and Board of Trustees of the Village of Mount
Prospect have met from time to time in executive session for
purposes authorized by the Illinois Open Meetings Act; and
WHEREAS, as required by the Act, the Village Board has kept written
minutes of all such executive sessions; and
WHEREAS, pursuant to the requirements of Public Act 85-1355, the
Mayor and Board of Trustees have met in closed session to review
all closed session minutes; and
WHEREAS, the Mayor and Board of Trustees have determined that a
need for confidentiality still exists as to the executive session
minutes for the meetings as set forth on Schedule A attached
hereto; and
WHEREAS, the Mayor and Board of Trustees have further determined
that the minutes of the meetings as noted on Schedule A attached
hereto no longer require confidential treatment and should be made
available for public inspection.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the executive session minutes from those
meetings as set forth on Schedule A attached hereto are hereby
released.
SECTION TWO: That the Village Clerk is hereby authorized and
directed to make said minutes available for inspection and copying
in accordance with the standing procedures of the Clerk's office.
SECTION THREE: That this Resolution shall be in full force and
effect from and after its passage and approval in the manner
provided by law.

SE~MBER 4, 1990
The Executive Session was called to order at 10:10 p.m., in the second floor Conference
Room of the Senior Citizens Center, 50 South Emerson Street to discuss pending
litigation. Present at the Executive Session were: Mayor Gerald Farley; Trustees Ralph
Arthur, Mark Busse, Timothy Corcoran, George Van Geem and Theodore Wattenberg.
Absent from the Executive Session was Trustee Leo Floros. Also present were Village
Manager John Dixon, attorney Everette Hill and Assistant Village Manager John Burg.
Village Manager Dixon and attorney Hill brought the Board up to date on the Brickman
Manor Suit, also known as Wheeling Trust and Savings Bank, concerning Building
Permits not being issued by the Village in accordance with the 1980 Consent Decree.
The Board authorized the Manager to attempt to set up a meeting to discuss possible
settlement and then set a meeting with the homeowners/intervenors in the area.
The second item of discussion concerned a letter from the Illinois Environmental
Protection Agency threatening to sue the Village if we proceeded with construction of
Route 83 without a Permit. The Board asked this item to be discussed at the next
Committee of the Whole meeting on September 11.
At 10:57 p.m., the Board meeting was adjourned.

EXECUTIVE SESSION
JULY 24, 1990
The Executive Session was called to order at 9:50 p.m., in the second floor Conference
Room of the Senior Citizens Center, 50 South Emerson Street to discuss personnel and
land acquisition. Present at the Executive Session were: Mayor Gerald Farley; Trustees
Ralph Arthur, Timothy Corcoran, Leo Floros, George Van Geem and Theodore
Wattenberg. Absent from the Executive Session was Trustee Mark Busse. Also present
were Village Manager John Dixon and Assistant Village Manager John Burg.
The first item that was discussed was the purchase of the Mount Prospect Theater. The
Village Manager indicated that there had been discussions with the theater owner who
had indicated a desire to have his building acquired. The Village Board gave
authorization for the Village Manager to negotiate with the owner on the price of the
building.
The second item of discussion was that there was tentative agreement with the SEIU
Local #1 Public Works Union. The Village Manager brought the Board up to date
indicating that the staff has reached a tentative agreement with representatives of the
local union which are within the parameters originally established by the Village Board
for salary increases. There is a three year term on the contract with maximum salary
increase for top grade at 5% and the lower end of the scale receiving 4% and the
middle end of the scale receiving 4-1/2%. Tool allowance was increased from $20 per
month to $30 per month. The residency requirement was left in the agreement but
expanded to include areas north and west of Elgin. The hours of operation in Public
Works will be ftom 7:00 a.m. to 3:30 p.m., May 1 through October 1 and will be
7:30 a.m. to 4:00 p.m. the rest of the year. In addition, the Union agreed to pay 10%
up to $13.00 for single and $39.00 for family medical coverage to the Village which is
an increase over their present dollar amounts. There were no language or verbiage
changes.
At 10:22 p.m., the Board meeting was adjourned.

JUNE 19, 1990
The Executive session was called to order at 11:24 p.m., in the second floor Conference
Room of the Senior Citizens Center, 50 South Emerson Street to discuss
personnel and possible litigation. Present at the Executive Session were: Mayor Gerald
Farley; Trustees Ralph Arthur, Mark Busse, Timothy Corcorart, Leo Floros and George
Van Geem. Absent from the Executive Session was Trustee Theodore Wattenberg. Also
present was Village Manager John Dixon.
The first item that was discussed was the Labor Contract negotiations with the Public
Works' Union (SEIU). The Village Manager brought the Village Board up to date on
discussions that had taken place since the last time the SEIU Contract was discussed.
There also was discussion about a potential litigation matter and whether or not the
Village should pay legal fees for a resident who incurred costs associated with a matter
with the Village.
No action was taken.
At 11:34 p.m., the Board reconvened into regular session. Immediately thereafter,
Trustee Arthur moved and seconded by Trustee Corcoran to adjourn. Motion carried
unanimously.

JUNE 5, 1990
The Executive Session was called to order at 11:00 p.m., in the second floor Conference
Room of the Senior Citizens Center, 50 South Emerson Street to discuss personnel and
possible litigation. Present at the Executive Session were: Mayor Gerald Farley;
Trustees Ralph Arthur, Mark Busse, Leo Floros and George Van Geem. Absent from
the Executive Session were Trustees Timothy Corcoran and Theodore Wattenberg. Also
present were Village Manager John Dixon and Assistant Village Manager John Burg.
Manager Dixon outlined the Public Works' Union demands and then made
recommendations which were reviewed by the Board.
The Board then discussed the complaint by the owners of Two North Pine Street.
At 11:45 p.m., the Board reconvened into regular session. Immediately thereafter,
Trustee Arthur moved and seconded by Trustee Busse to adjourn. Motion carried
unanimously.

MAY 15, 1990
The Executive Session was called to order at 11:20 p.m., in the second floor Conference
Room of the Senior Citizens Center, 50 South Emerson Street, Present at the Executive
Session were: Mayor Gerald Farley; Trustees Ralph Arthur, Mark Busse, Timothy
Corcoran, Leo Floros and Theodore Wattenberg. Absent from the Executive Session was
Trustee George Van Geem. Also present were Village Manager John Dixon and
attorney Everette Hill.
The first item of discussion was the Elk Grove Township Rural Fire Protection District.
The decision was made by the Board in Executive Session to go back into full session
and retain the services of Jack Siegel to assist in the Appeal of this Suit.
The second item that was discussed was the Village of Mount Prospect's representation
on the Solid Waste Agency of Northern Cook County Executive Committee. Options
were discussed that would allow Ralph Arthur, who is our representative, to be a voting
representative on the SWANCC Board. Everette Hill will explore the options.
The third item that was discussed was the subject of the threat of litigation concerning
a 1980 Consent Decree. Artfield Builders would like to develop the Brickman Manor
parcel on River, north of Camp McDonald and need our consent to build as declared
in 1980. No official action was taken at this time.
The Executive Session was adjourned at 11:40 p.m.

APRIL 17, 1990
The Executive Session was called to order at 11:08 p.m., in the second floor conference
room of the Senior Citizens Center, to discuss potential litigation. Present at the
Executive Session were: Mayor Gerald Farley; Trustees Ralph Arthur, Mark Busse,
Timothy Corcoran, Leo Floros, George Van Geem and Theodore Wattenberg. Also
present was Village Manager John Dixon.
The first item to be discussed was consideration of appeal of the Elk Grove Township
Rural Fire Protection District lawsuit. The Board decided to appeal this lawsuit.
The second item discussed was the Disconnect Suit. There was discussion as to whether
or not to appeal the decision of the Appellate Court. The Village Board decided to
appeal this decision as well.
The third item of discussion concerned a decision by the Solid Waste Agency of
Northern Cook County concerning elected representation on the Executive Board and
whether or not the Village of Mount Prospect should file suit either against SWANCC
or the Village of Inverness concerning their action which does not allow a representative
of the Village of Mount Prospect to serve on the Executive Board. It was agreed that
there would be deferral on this item until after May 1, 1990.
The Executive Session was adjourned at 11:30 p.m. and went back into full session.

APRIL 10, 1990
The Executive Session was called to order at 7:04 p.m., in the second floor conference
room of the Senior Citizens Center, to discuss litigation. Present at the Executive
Session were: Mayor Gerald Farley; Trustees Ralph Arthur, Mark Busse, Timothy
Corcoran, George Van Geem and Theodore Wattenberg. Absent from the Executive
Session was Trustee Leo Floros. Also present was Village Manager John Dixon.
The first item to be discussed was the Disconnect Case. The Village Board agreed that
there should be an Appeal to the Appellate decision which was just handed down.
The second item discussed was the an opinion of the Judge in the Elk Grove Township
Rural Fire Protection Suit and the Board decided to appeal this as well.
The Board then went to a regular Committee of the Whole meeting at 7:40 p.m.

The Executive Session was called to order at 11:08 p.m., in the second floor Conference
Room of the Senior Citizens Center, 50 South Emerson Street. Present at the Executive
Session were: Mayor Gerald Farley; Trustees Ralph Arthur, Mark Busse, Timothy
Corcoran, Leo Floros, George Van Geem and Theodore Wattenberg. Also present was
Village Manager John Dixon.
The first item of discussion was the review of the Executive Session Minutes from the
last six months. The Board unanimously declared that the following Minutes should be
released in their entirety:
October 17, 1989
November 8, 1989
January 9, 1990
February 6, 1990
The Board also declared that the entire Minutes of January 30, 1990 should be held in
the Executive Session file.
The second item of discussion was the Elk Grove Township Rural Fire Protection
District Case. The Board discussed whether there may be future actions that may be
taken by the Board. No decision was made at this time.
The third item that was discussed was the matter of personnel concerning the status of
Firefighters because of the outcome of the Elk Grove Townshp Rural Fire Protection
District Case. No action was taken on this item.
The fourth item was discussion of the recent Disconnect Lawsuit. Appellate Court
remanded this matter back to the lower Courts because the Judge did not permit
testimony of Steve Park. It was declared that we should move forward with the
Disconnect Suit.
The fifth item was discussion of possible sale of Village properties. No action was taken
on this item.
The Executive Session was adjourned at 12:05 a.m. on April 4.
