RESOLUTION NO. j~ -6 3
A RESOLUTION ACCEPTING A LEGAL SERVICE CONTRACT
FOR MAKING OF LOCAL IMPROVEMENTS
NOW, THEREFORE BE IT RESOLVED by the President and
Board ot Trustees of the Village of Mount Prospect, Cook
County, Illinois:
Section 1 - That the President and Village Clerk are
hereby empowered to sign a Legal Service Contract for the
employment of attorneys to levy special assessments for the
Village of Mount Prospect, copy of which is attached to this
resolution.
Section 2 - This resolution shall be in full force and
effect from and after its passage and approval according to
law.

LEGAL SERVICE CONTRACT
FOR MAKING OF LOCAL IMPROVEMENTS
WHEREAS, the Village of Mount Prospect is contemplating
the making of various local improvements to be paid for by the
levy of special assessments against property benefited thereby,
and
WHEREAS, it is necessary for said Village to retain
competent legal counsel to act on its behalf in connection with
the special assessment and condemnation proceedings required to
carry out such local improvements;
NOW, THEREFORE, it is agreed by and between the Village
of Mount Prospect and Edward C. Hofert and Owen N. Price, attor-
neys at law, as follows:
1. Said Village does hereby agree to employ said Hofert
and Price as its attorneys to render all legal services required
in connection with any and all local improvements to be constructed
and paid for by special assessments and all condemnation proceedings
incident thereto, which are initiated by said Village from the date
hereof until May 1, 1965.
2. As compensation for legal services so to be rendered,
said Village agrees to pay to said attorneys five percent (5%) of
the total amount of the special assessments confirmed against
property owners and as public benefits in each such special assess-
ment proceeding filed and completed to final judgment on behalf of
said Village, plus compensation at the rate of Twenty-five ($25.00)
Dollars per hour for their time spent in connection with acquiring
property necessary for any such local improvement by purchase,
condemnation or otherwise.
3. In the event that any proceeding for the making of a
local improvement is abandoned by said Village after confirmation
proceedings have been filed in Court, said attorneys shall
be paid two percent (2%) of the total amount of the assessment
roll filed in such proceeding or the sum of Five hundred ($500)
Dollars, whichever is the greater.
4. Said attorneys may cancel this contract at any time
by written notice to said Village; provided, however, that they
shall complete any work in progress hereunder or any pending
proceedings in Court if requested by said Village to so do.
5. Said Village may cancel this contract at any time
by written notice to said attorneys, who shall thereupon be paid
for services in proceedings not yet completed at the rate of
Twenty-Five ($25.00) Dollars per hour for their time spent in
connection with such incomplete proceedings.
6. This contract shall become effective and be binding
