HomeMy WebLinkAboutRes 11-64 04/21/1964 RESOLUTION NO. 11-64 A RESOLUTION DIRECTED TO THE COUNTY CLERK OF COOK COUNTY FOR TRANSMITTAL TO THE COOK COUNTY BOARD OF COMMISSIONERS IN A CASE DOCKETED BY THE COOK COUNTY ZONING BOARD OF APPEALS AS DOCKET NO. 713. NOW. THEREFORE BE IT RESOLVED by the President and Board of Trustees of the Village of Mount Prospect. Cook County. Illinois: Section 1. That the Village of Mount Prospect pursuant to the statutes made and provided. does hereby file objections to the request for rezoning from R-4 Single Family Residence District to B-2 Restricted Service District in a case docketed by the Cook County Zoning Board of Appeals as Docket No. 713; it being understood that the proposed use is that of a GaDline Service Station and that said property is legally described as follows: The South 208.00 feet of the ~ast 275.00 feet of the East Half of the Southeast Quarter of Section 26. Township 42 North. Range 11. East of the Third Prin- cipal Meridian. in Cook County. Illinois. Section 2. That the President and Board of Trustees of the Village of Mount Prospect object to the foregoing rezoning and especially the use of the property for a gasoline service station for the reasons: A - That the zoning of the property as requested. namely B-2. will in effect constitute spot zoning and that said spot zoning will have a detrimental effect on the future development of the remaining three corners of the intersection of Wolf and Foundry Roads as well as the value of any and all surrounding property values. B - That there is no need. present or in the immediate future. for gasoline filling stations either at the place indicated or in the vicinity and that there is evidence that many g~line filling stations are not being utilized and have in fact been abandoned and there is an over supply of gasoline service station facilities. C - That the rezoning of the property in question will have a corrosive effect on not only real estate values. both present and future. but will merely further glut the area. D - The Village of Mount Prospect feels that just because the property is located at the corner of an intersec- tion of two roads this does not make it ideally suited for a gasoline filling station and that the mere allegation of an increment in value to the owner should not and cannot be used as the justification for rezoning corners. E - It is further felt that the highest and best use of the property in question is that of R-4 Single Family Residence and that such use is compatible with the I I II Ii I, II Ii ,I I I i I zoning and the use of property in the immediate vicinity. Section 3. This ordinance shall be in full force and effect from and after its passage and approval according to law and that the Village Clerk of the Village of Mount Prospect is hereby authorized to submit certified copies of this resolution to all appropriate parties.
