HomeMy WebLinkAboutRes 14-64 06/23/1964 RESOLUTION NO. 14-64 A RESOLUTION BY THE VILLAGE OF MOUNT PROSPECT OBJECTING TO THE RE- ZONING FROM R-4 SINGLE FAMILY RESIDENCE TO R-5 MULTI-FAMILY RESIDENCE OF A 50 ACRE TRACT IN ELK GROVE TOWNSHIP LOCATED AT THE NORTHEAST CORNER OF ALGONQUIN ROAD AND LINNEMAN ROAD, DESIGNATED BY THE COOK COUNTY ZONING BOARD OF APPEALS AS DOCKET NO. 738 WHEREAS, Max M. Fleisher and the Exchange National Bank of Chicago as Trustee seek the rezoning of the 50.4 acres of property located on the North- east corner of Algonquin Road and Linneman Road, Elk Grove Township, from its present R-4 Single Family Classification to the R-5 Multi-Family Classifica- tion, for the purpose of erecting thereon in excess of 800 apartment units, which case was docketed by the Cook County Zoning Board of Appeals as Docket No. 738; and WHEREAS, the Village of Mount Prospect is within one and one half miles I of the property sought to be rezoned; NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: Section 1. That the Village of Mount Prospect does hereby object to the rezoning described above and requests the County Board to note its official objections and does hereby state that the reasons for the objections are as follows: II I I I I I A - That the highest and best use of the subject property is R-4 Single Family Residence which fact is attested to in that said property was originally zoned R-4 by the Comprehensive Amendment to the Cook County Zoning Ordinance and that no significant change in zoning or land use in the immediate vicinity has occurred. That the property to the immediate north is largely vacant and what is developed consists of a school and single family residences. That the property to the east although zoned R-5 is not so used. That the property to the west and across Linneman Road is utilized by the United Airlines for offices which are compatible with the single family use of the instant property and the property to the south is vacant and unimproved. B - The plan proposed calls for 879 apartment units arranged in a "maze-like" layout which is alledged to be a single building but which is neither architecturally or structurally a single structure. That said plan seeks to evade the Subdivision Control Ordinances of neighboring villages, including the Village of Mount Prospect, seeks to evade requirements of public streets and cannot nor should not be built under existing Cook County zoning and building ordinances. C - The plan proposed concentrates a large population with no pro- vision for streets and roads except private streets, all of which makes the project a burdensome one for the County of Cook which is duty bound to provide adequate streets and limits what fire pro- tection is available from having proper ingress and egress to the development. D - The fire fighting facilities available are provided by a rural fire district having neither the equipment nor the man power to fight a serious fire in a project of this magnitude nor is it capable to so do by raising its tax levy. There is no showing that the State Fire Marshal is in a position to provide fire protection if same is not locally available. E - Water and sewer facilities in the area have been planned for single family residential development and would be over taxed by multi-family development. F - The police protection available is furnished by the sheriff of Cook County who because of staff limitations cannot afford the type of police service necessary. G - The rezoning of the property in question will have an adverse affect upon the State's Attorney's defense in a nearby case designated by Case No. 63 C 11471 which is now pending and undecided. Section 2. The Village Clerk is hereby authorized to submit certi- fied copies of this resolution to the County Clerk of Cook County for trans- mittal to the County Board and such other agencies as are deemed appropriate. Section 3. This resolution shall be in full force and effect from and after its passage and approval according to law.
