(' - , /// RESOLUTION NO. <V->I,<J T A RESOLUTION AUTHORIZING THE PRESIDENT AND VILLAGE CLERK TO EXECUTE: A PRE-ANNEXATION AGREEMENT BETWEEN THE OVlNEHS OF THE OLD ORCHARD COUNTRY CIJUB WHEREAS, the Chicago Title and Trust Company, as Trustee under Trust No. 37533 is the sole Record Owner of the property described in Exhibit itl It attached hereto and made a part hereof; and WHEREAS, said Chicago Title and Trust Company, as Trustee has petit ioned for the Village of' Mount Prospect to annex the territoI'Y described in Exhibit Itl" attached, in accordance with the provisions of' a Pre-Annexation Agreement, a copy of' which is marked Exhibit "211 and attached hereto and incorporated by reference herein as if fully set forth; and WHEREAS, all necessary legal conditions precedent to the execution of the attached Pre-Annexation Agreement have been fully complied with; NOW, THEREJ:i'OHE, BE IT RESOLVED by the President and Board of' Trustees of the Village of :Mount Prospect, Cook County, Illinois: Section 1. That the Presiclenl; and Village Clerk be and are hereby authorized to execute the Pre-Annexation Agreement between the Village of Mount Prospect and the Chicago Title and Trust Company, as Trustee under Trust No. 37533, dateu 1964, a copy of which agreement is marked Exhibit 1t2" and attached hereto, the pro vis ions of which are incorporat ed herein by reference. NOV 1 B HlG4 ~ " t, _, ANNEXATION AGREEME}IT THIS AGREEMENT made and entered into this Uk day of f2,~t!'ff<t0 ' 1964, by and between the VILLAGE OF MOUNT PROSPECT, COOK COUNTY,' ILLINOIS (hereinafter referred to as "Village"), by , the PRESIDENT AND BOARD OF TRUSTEES, as the corporate authorities thereof (hereInafter referred to as "Corporate Authorities"), and CHICAGO TITLE AND TRUST COMPANY, as Trustee under Trust No. 37533 (hereinafter referred to as "Developer"), WIT N E SSE T H: WHEREAS, the Developer owns and controls all of the real estate shown on a map marlted Exhibit "A", and attached her0l;o end made a part hereofj and WHEREAS, the said real estate shown on Exhibit "A" is the subject of a Petition for Annexation to the Village, a copy of which Petition, setting forth the legal description of the property to be annexed, marked Exhibit "B", is attached hereto and made E2 part hereof; and WHEREAS, the Developer desires and proposes to develop as n planned recreational open space development, in accordance with the terms and conditions of Village Ordinance No. 992, that portion of the subject property specified in the Developer's Land Use B.nd Zoning Plat, attached hereto as Exhibit "e", and made a part; hereof; NOW, THEREFORE, in consideration of the premises and of the mutual covenants and agreements herein contained, it is hereby agreed as follows: 1. The Corporate Authorities shall enact an ordinance annexing the real estate shown on Exhibit "A" to the Village, pursuant to Section 7-1...8 of the Illinois Municipal Code (Chaptor 24, Ill. Rev. Stats.. 1963), and shall forthwith cause said ~tJJ2i &:Jol1tATru __.j. I' t: V , . ordinance) together with Exhibit IIA", to be :tecorded. 2. The Corporate Authorities~ upon the passage of the ordinance annexing the real estate described in Exhibit I~II, will approve the aforementioned Land Use and Zoning Plat, and will cause to be enacted t~/O ordinances, copies of vlhich are attached hereto as Exhibits "DII and J IIEII and incorporated'by reference herein, zoning and classifying said real estate to the Planned Open Space District and to the B-3 District. Petitions for such rezonings were considered at public hearings held by the Zoning Board of Appeals of the Village of Mount.. Prospect on June 8J 11 and 12, 1964. 3. The Corporate Authorities shall, within siA~y (60) days after submittal, approve final site development plats, provided same conform to the Developer's Land Use and Zoning Plat, Exhibit IIC" attached, and all applicable Village Ordinances, rules and regulations. Each final plat shall also ShOll proposed building sites for all buildings as vlell as sites for those buildings for which building permits are being requested and shall designate thereon those portions of utilities and roadways which the Developer is proposing to construct contemporaneously with such buildings. 4. Upon annexation of the subject property to the Village, the Developer agrees to grant to the Village, by Trustee's Deed, a copy of which is attached hereto as Exhibit IIFII, and a survey which is attached hereto as llidlibit IIGII) a certain parcel of real estate described in said Deed and Survey for the sole purpose of enabling the Village to enforce the Protective Covenant described in Paragraph 5 herein. 5. Upon anneJcation of the subject property to the Village, the Village will record with the Cook County Recorder of Deeds said Harranty Deed, after first having recorded the Protective Covenants relating to the subject property, a copy of which is -2- : attached hereto as Exhibit "H" and incorporated by reference herein. 6. The Corporate Authorities acknowledge and agree that the Developer shall have" the right to continue to provide water from its own well$ on the subject property for use within the subject property, provided, however, that there shall be no inter- connection with the aforementioned water system and the Village water system. 7. The Corporate Authorities agree that the Developer may connect with the Village water syste.m by installing water mains in accordance with the plans shown in Exhibits I and I-lor in accordance with Exhibits J and J-l, which exhibits are att~ched hereto and incorporated by reference herein. Such installations shall be made as needed by the Developer and as it proceeds with its Plan of Development. Such installations shall be made at the Developer's own expense, subject to the following: The Developer is to recover ~:'i""ee Hundred Dollars (C300. 00) per lot from the owners of lots 4 thru 10, both inclusive, of Block ~and from the owners of lots 1 thru 4,both inclusive, of Block 6,in Wedgewood Terrace,and from the owners of the unsubdivided property south thereof, fronting on the west side of Elmhurst Avenue, between Rand Road and Euclid Avenue, at the rate of Three Dollars ($3.00) per front foot for residential property and Three Dollars and Seventy- Five Cents ($3.75) per front foot for commercial property, and from the owners of the propm-ty fronting on the north side of Camp McDonald Road, between Elmhurst Road and Schoenbeck Road,at the rate of Three Dollars (~~3.00) per front foot for residential property and Three Dollars and Seventy-Five Cents ($3.75) per front foot for commercial property, who shall desire to connect to and to utilize such mains as may abut their property. Said areas are shown on Exhibits uK_lIt and "K_2" attached hereto and incorporated by ...3- . -",'~:- ~eference herein. The Corporate Authorities agree not to voluntarily permit water service to the lots designated herein unless the charges specified are first paid. No property other than that specified shal~ pay a tap-on charge for the use of said mains. It is understood~ howeverl that the Villagels obligation to the Developer to secure Developer1s re1mbur~ement shall terminate on October 31, 1969. The Developer agrees that upon completion of the aforementioned water mains, it shall convey same to the Village free and clear of a:ny and all encumbrances, at which time the Village agrees to assume operation, maintenanoe and control over said mains. The Developer agrees to pay the Village the sum of ~wenty Thousand Dollars ($20,000) plus one-half of the amount necessary to construct the water main shown as a solid line on Exhibit "L" attached hereto, or Twenty-Six Thousand Seveh Hundred Fifty Dollars ($26,750), whichever sum be the lesse~: said sum to be paid as follows~ (a) The amount necessary to construct the water main shown on Exhibit n L" attached.. So;!.:::' amount to be paid at such time as the Developer shall commence construction on its first zoning trac'~ or one year from date, whichever occurs sooner. (b) One-half of the balance due under this paragraph at such time as the Developer shall commence construction on the second zoning tract. (c) The remaining balance under this contract shall be made at such time as the Developer shall commence construction on the third or last zoning tracto The foregoing sum of Twenty-Six Thousand Seven Hundred Fifty ($26,750) Dollars shall I upon payment thereof, be accepted by tho Village as the Developer's full contribution under Section 234110 ot the Municipal Code ot the Village of Mount Prospect.
