DO CKET 804 tiHEREAS, the petitioner in the above case seeks the ~ezon1ng of 9 1/2 acres on the west side of Elmhurst Road, approx1matel,. 541 teet North ot Dempster Street, in Elk Grove Township, legall,. described as tollows: That part of' the Southeast Quarter of the Southeast Quarter ot Section 14. Township 41 North, Range 11, East ot the Third Principal Meridian trom R-4 to B-4 tor the ostensible purpose ot develop!ns said property with a theater, 1'8"t.aurant and office build1ne, (without a cocktail lounge because of the Pl'ox1m1ty of' the sohool, although one was first proposed)} and WIOs.1UU.S, the Village of Mount Prospeot is w1thin one and one-halt miles of the property in question and 1s legall,. entitled to tile objections herein: NOW, mEREFORE, BE IT n}l~SOLVED by the President and Board of Trustees of the Village ot Mount Prospeot, Count,. ot Cook, Illinois: Seotion 1, That the Village ot Mount Prospeot does here- by objeot to the r..oning ot said property as petitioned tor the following reasons: A - The development of the pl'opert'y in question, as proposed, would have a harmful affeot on the use and ocoupancy ot the Dempster Junior High Sohool immedIately to the west ot the property_ B - It would oonsti tute spot zoning since the property immedIately to the south, west and north 1s zoned single fallil.,. residenoe either in the County of' Cook or the Village of' Mount Prospect. C - The rezoning of the property would constitute strip zoning and introduce traffio problems along and upon ElJIhurst Road by introduoing oongestion of automobiles at such times as theater traff'io left and entered the property in question. D - There is an abundance ot commercially zoned property in the area available tor the purpose proposed which has not been heretotore used. E - The evidence submitted as to the Developer's proceeding with the project was sketchy and uncertain. F - The highest and best use of the property is and should remain as zoned, namely, single family residonce. c ~ G - The x-ezoning of the property in qaestion woald constitute both spot and strip zoning. Section 2. This resolution shall be in tull force and effect from and after its passage and approval according to law.
