PROVIDING FOR AN AGREEMENT BETWEEN THE STATE OF ILLINOIS
ACTING THROUGH ITS DEPARTMENT OF PUBLIC WORKS AND BUILD-
INGS HEREINAFTER CALLED THE STATE, AND THE VILLAGE OF
MOUNT PROSPECT A MUNICIPAL CORPORATION, HEREINAFTER CAL-
LED THE VILLAGE FOR THE IMPROVEMENT ALONG NORTHWEST HIGH-
WAJ.. S.B.I. ROUTE 19 (FA ROUTE 20) STATE SECTION 1964-
15-RS, COOK COUNTY, ILLINOIS
WHEREAS, the STATE proposes to improve approximately 11,733 .
lineal feet of Northwest Highway between Waterman Avenue and
Village Court by. resurfacing the existing 40 foot and variable
widtlipavement with one (1) inch of Bituminous Concrete Sur-
face Course, Subclass 1-11, widening the pavement at the inter-
sections of Central Road, Elmhurst Road and Mount Prospect
Road with Portland Cement Concrete Base Course 9" and surfacing
the new base course with 2 1/2 inches of Bituminous Concrete,
Subclass 1-11, constructing Combination Concrete Curb and Gut-
ter adjacent to the proposed widening, reconstructing the grade
along Northwest Highway and Mount Prospect Road at the inter-
section, and performing all other work necessary to complete
the improvement according to the approved plans, and
WHEREAS, the cost of the improvement within the VILLAGE is
approximately $375,000.00.
NOW THEREFORE, in consideration of the premises, the STATE is
willing to participate in the improvement to the following
extent provided the VILLAGE will participate as provided in
this resolution.
1. The STATE will make the surveys, prepare plans and
specifications, receive bids and award the contract,
furnish engineering inspection during construction and
cause the improvement to be built in accordance with
the plans, specifications and contract, and
2. The STATE will pay all construction and engineering
costs, and
3. Upon completion of the improvement and so long as the
street is used as a State Highway, the STATE shall
maintain or cause to be maintained within the corpo-
rate limits of the VILLAGE, the pavement structure
of four (4) traffic lanes, each ten (10) feet and
variable in width, and the left-turn lanes at the
intersections of Central Road, Elmhurst Road and
Mount Prospect Road.
NOW THEREFORE BE IT RESOLVED, that if said improvement is con-
structed as heretofore state, the VILLAGE will participate on
the following basis.

1. The VILLAGE shall adopt before the award of the con-
tract and put into effect, or or before October 1,
1966, an ordinance prohibiting parking within the
Village Limits of the improvement, a copy of which
is attached hereto as Exhibit "A", and
2. The VILLAGE shall adopt and put into effect, before
the award of the contract, an ordinance prohibiting
parking within the limits of the proposed improve-
ment in areas where barrier curbs are existing, or
proposed with the following exceptions. Parallel
parking will be allowed in curbed areas along North-
west Highway between Wille Street and Maple Street
and on Main Street (Elmhurst Road) within the limits
of the proposed improvement, except between the hours
of 4:00 P.M. and 7:00 P.M., a copy of which is attach-
ed hereto as Exhibit "B", and
3. The VILLAGE will adopt arid put into effect, before
the award of the contract, an appropriate ordinance
prohibiting the discharge of sanitary sewage and in-
dustrial waste water into any storm sewers construc-
ted as a part of this improvement, a copy of which is
attached hereto as Exhibit "C", and
4. The VILLAGE will adopt, prior to advertising the work,
a resolution approving the plans and specifications
as completed, a copy of which is attached hereto as
Exhibit "D", and
5. The VILLAGE will not permit driveway or entrance
openings to be made in the curb, as constructed,
without the consent of the STATE, and
6. Upon completion of the improvement, the VILLAGE
will maintain, or cause to be maintained, within
the Village limits of the improvement, the road-
bed outside of that portion which is to be main-
tained by the STATE, together with all curbs, gut-
ter flags, manholes, catch basins, storm sewers,
utilities and appurtenances located within the
limits of the street.
BE IT FURTHER RESOLVED, that approval of this resolution by
the STATE shall be considered as its concurrence in and ac-
ceptance of the terms contained herein and shall constitute
an agreement between the VILLAGE and STATE for the construc-
tion and maintenance of the improvement described herein, and
BE IT FURTHER RESOLVED, that the VILLAGE Clerk is hereby di-
rected to transmit the executed, reproducible copy of this
resolution and copies of all ordinances and resolutions re-
quested by this resolution to the Division of Highways, through
its District Engineer's Office, at 300 North State Street,
