RESOLUTION NO. 12-65
A RESOLUTION OPPOSING REZONING OF CERTAIN PROPERTY
LOCATED IN COOK COUNTY AND DESIGNATED BY THE COOK
COUNTY BOARD OF APPEALS AS DOCKETS 869, 870, 871,
872 and 873
WHEREAS, the petitioner in Cook County Zoning Board of Appeals
Docket 869 has asked for the rezoning of 1.9 acres of land from R-4 to
B-3 for the purpose of using same as general offices and professional
offices, which property is located on the north side of Foundry Road,
approximately 300 feet west of Wolf Road in Wheeling Township; and
WHEREAS, said petitioner has requested the rezoning in Cook
County Zoning Board of Appeals Docket No. 870, of 7.35 acres from R-4
single family to R-5 multi-family residences for the purpose of construct-
ing a proposed nursing home, which property is adjoining the aforedes-
cribed property and 460 feet west of Wolf Road on the north side of
Foundry Road; and
WHEREAS, the petitioner has in Docket No. 871 requested the
rezoning of 1.16 acres from its present zoning of R-4 single family resi-
dence to B-5 business for the purpose of constructing thereon an office
and model apartment site, said property being located on the south side of
Euclid Road, approximately 225 feet west of Wolf Road, in Wheeling Town-
ship; and
WHEREAS, the same petitioner has in Docket No. 872 requested the
rezoning of 7.3 acres of land to be rezoned from R-4 single family resi-
dence to R-5 multi-family for the purpose of constructing multi-family
dwellings on said property, said property being located 475 feet west of
Wolf Road and on the south side of Euclid Avenue; and
WHEREAS, the same petitioner has requested the rezoning of Cook
County Zoning Docket 873 of 10.63 acres from R-4 single family to R-6
multi-family use, said property being located on Wolf Road 175 feet south
of Euclid Avenue; and
WHEREAS, the above described properties are within one and
one half mile of the Village of Mount Prospect's boundaries; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect, County of Cook, believe that the granting of the above
requests for rezoning would be against public interest and adverse to
public health, morals and general welfare;
NOW, THEREFORE, BE IT RESOLVED by the President and Board of
Trustees of the Village of Mount Prospect, County of Cook, Illinois:
Section 1. That the property involved in Docket 869 and 870
and aforementioned is and should remain single family residences because
this property was once platted with single family residences within the
last two years by the county; because this property can be so developed
suitably and because all of the property in the vicinity is zoned single
family residences and used as such except the property to the immediate
north which is being used for a school and which is compatible with the
development of this property described in these petitions of single
family use and that the zoning of said property would constitute spot
zoning with all of its attentive disadvantages.
Section 2. The property involved in Dockets 871. 872 and
873 are related in that they all call for the development of intense
multi-family use of the land in question. Docket 873 calling for a
R-6 classification which permits units of 1.000 sq. ft. of land to one
unit. Docket 872. a lesser but yet intense multi-family use of the
land. and Docket 871 which provides for a sales office for multi-family
units.
Section 3. The Village opposes these rezoning requests for
the following reasons:
(a) The area is predominately used and developed with
single family homes to the immediate west which
are in the $30.000 to $40.000 price class and the
development as proposed would constitute spot
zoning. all other zoning in the surrounding area
being zoned single family and would seriously
depreciate property not only in the immediate
vicinity abutting but in the whole general area.
(b) The showings indicate that there is sufficient multi-
family uses in the area and that what multi-family
uses there are have a poor occupancy rate and the
general area will not support the intense type of
development proposed.
(c) There is no good and valid reason for the rezoning
requested above. The area is predominately single
family both in zoning and in use. The rezoning of
the instant property can only start a chain of multi-
family requests which would essentially change the
basic character of the area which is and should remain
single family residence.
Section 4. The Village Clerk is hereby directed to submit a
copy of this resolution to the County Clerk. Cook County Zoning Board of
Appeals. Cook County Board of Commissioners and other interested persons.
Section 5. This resolution shall be in full force and effect
from and after its passage and approval according to law.
