RESOLUTION NO. 33-65
RESOLUTION AUTHORIZING THE FILING OF A PETITION
TO DETACH LANDS LOCATED WITHIN THE VILLAGE OF
MOUNT PROSPECT FROM THE WELLER CREEK DRAINAGE
DISTRICT
WHEREAS, the Village of Mount Prospect is exercising
storm drainage powers within its corporate boundaries; and
WHEREAS, the Weller Creek Drainage District is also,
and has been for many years, exercising such drainage powers
\,;i thin the corporate limits of the Village of 110unt Prospect,
and
WHEREAS, Section 8-15 of the Illinois Drainage Code
(Ill. Rev. Stat. ch. 42, Sec. 8-15 (1963)) provides that when a
drainage district contains lands which lie within the limits of
a municipal corporation which has constructed drains and which
is exercising storm drainage powers in the territory of the
drainage district of the aame nature as the drainage powers
being exercised by the drainage district, then such lands may
be detached by the filing of a petition in the County Division
of the Circuit Court in and for the County within which such
lands are located; and
WHEREAS, pursuant to Resolution No.1-57, passed and
approved February 19, 1957, the Village of Mount Prospect
authorized the filing of a petition in the County Court of Cook
County for the detachment of all lands located within the cor-
porate limits of the Village of Mount Prospect to secure the
detachment of all lands located within the said Village from the
Weller Creek Drainage District, and
WHEREAS, pursuant to such Resolution such petition
was filed and an order was entered pursuant to such petition on
April 17, 1957, in a case captioned, "In the Hatter of the
Weller Creek Drainage District and Sub-Districts Nos. 1 to 11,
inclusive, No. 57 Co 896," to detach form the ~leller Creek
I Drainage District all lands then located within the then
il corporate limits of the Village of Hount Prospect; and
l,wHEREAS, since the date of the aforesaid detachment
II order, additional lands lying within the Weller Creek Drainage
I District have been annexed by, and are now Hi thin the corporate
! limits of, the Village of Mount Prospect; and
WHEREAS, it is desirable and in the best interest
Iii of the citizens of the Village of 110unt Prospect that the
11 said Village eave sole and exclusive jurisdiction and authority
lover storm drainage wi thin its corporate limits;
Ii NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND

SECTION ONE: That Jack M. Siegel, R. Marlin Smith, and Ross,
Hardies, O'Keefe, Babcock, McDugald & Parsons, attorneys at law,
be, and they are hereby, authorized and directed to file the
necessary petitions and proceedings in the County Division
II
Iii of the Circuit Court of Cook County, Illinois, pursuant to the
I provisions of Section 8-15 of the Illinois Drainage Code to
I. detach from the Weller Creek Drainage District all lands now
d lying within the corporate limits of the Village of Hount
i Prospect and which have been annexed to the said Village since
I the entry of a detachment order on April 17, 1957, in a certain
: matter entitled , "In the Hatter of the Weller Creek Drainage
II District and Sub-Districts Nos. 1 to 11, inclusive," No. 57 CO
II 896.

SECTION TWO: This Resolution shall be in full force
and effect from and after its passage and approval in the
manner provided by law.
