HomeMy WebLinkAboutRes 17-66 04/05/1966 ".,,,,,,"~ /"^'> 1 RESOLUTION NO. 17-66 A RESOLUTION BY TIlE VILLAGE OF MOUNT PROSPECT OBJECTING TO THE REZONING FROM R-4 (SINGLE FAMILY RESIDENCE) TO R-5 (GENERAL RESIDENCE) OF A 5.42 ACRE TRACT IN ELK GROVE TOWNSHIP LOCATED ON THE SOUTH SIDE OF GOLF ROAD AND 1080 FEET m:ST OF ELMHURST ROAD, DESIGNATED BY THE COOK COUNTY ZONING BOARD OF APPEALS AS DOCKET NO. 1015 WHEREAS I Burton Sherre and Francis J. Weiland seek the re- zoning of the 5.42 acres of property located on the South side of Golf Road and located approximately 1080 feet West of Elmhurst Road, Elk Grove Township, from its present R-4 Single Family Classification to the R-5 General Residence Classification, for t:1e purpose of erecting thereon 80 apartment units in 5 two story buildings, which case was dock- eted by the Cook County Zoning Board of Appeals as Docket No. 1015; and WHEREAS, the Village of Mount Prospect is within one and one half miles of the property sought to be rezoned; and WHEREAS, the Village of Mount Prospect is contiguous on the North, East and partically on the West of the property sought be be rezoned; NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOl< COUNTY t ILLINOIS: SECTION ONE: That the Village of Mount Prospect does hereby object to the rezoning described above and requests the County Board to vote its official objections and does hereby state that the reasons for the objections are as follows: A. That the highest and best use of the subject property was not established to be R-5 General Residence in so far as the testimony indicated that no attempt was made to es- tablish the value of the property under its present zoning status of R-4 Single Family Residence as a comparision to the Zoning change sought in the petition. ."'''.......,,~,, "'." . ~ B. That the subject pI'Operty is R-4 Single Family Residence which part is attested to in that said p~perty was originally zoned R-4 by the Comprehensive Amendment to the r ~c County Zoning Ordinance and that no significant change in zoning or land use in the immediate vicinity has occured. That the property to the immediate North is within the Corporate limits of the Village of Mount Prospect and is zoned R-l Single Family Residence. That the property to the immediate East is within the Corporate limits of the Village of Mount Prospect and is zoned R-l Single Family Residence and has been developed for Church use. That the property to the immediate West is par- tially within the Corporate limits of the Village of Mount Prospect zoned as R-l Single Family Residence and has been developed for church use. Thnt the remaining property im- mediately West is developed in the County as R-4 Single Family Residence. That the property immediately South is vacant and zoned R-4 Single Family Residence in the County. C. That the proposed plan calls for 80 apartment units arranged within five separate principal buildings on one lot, which is not consistant with County regulations contained in Section 4.7 of the General Provisions of the Cook County Zoning Ord- inance. adopted March 8, 1960. which reads as follows: "Except in the case of planned developments, not more than one principal detached residential building shall be located on a zoning lot, nor shall a principal detacl1ed residential building be located on the same zoning lot with any other principal building". D. That said proposed plan seeks to evade the Subdivision Control Ordinances of the neighboring Village, i.e. Village of Mount Prospect and seek to evade requirements of public streets. The plan concentrates a large population with no provision for streets and roads except a private street, all of which makes the project a burdensome one for the County of Cook which is duty bound to provide adequate streets and limits what fire protection is available from having proper ingress and egress to the development. E. That the fire fighting facilities available are provided by the Village of Mount Prospect render a yearly contractual ar- rangement with the Elk Grove Rural Fire District and there was no showing by the petitioner that Mount Prospect Fire Department is in a position to adequately provide fire pro- tection to this development under the proposed plan of ingress and egress. F. That the nearest water lines are on the North side of Golf Road and are the property of the Village of Mount Prospect and not available to properties outside its corporate limits of the Village of Mount Prospect. The petitioner did not clearly establish where they would obtain their water supply. G. That the sanitary sewer lines are North of Golf Road, but are sized for Single Family residence and would be over taxed by multi-family development. H. That there was no evidence brought forth as to how the sur- face drainage would be handled in this development. -".. -"-, .~,.~^".,.,..,..-,--"~,~..."...,,... ,....,_...,,~"'.,..__._.~- \ -, I. That the proposed zoning change would substantially diminish or impair property value p:.thin the immediate neighborhood. SECTION TWO: The Village Clerk is hereby authorized to submit certified copies of this resolution to the Clerk of Cook County for trans- mittal to the Board of Commissioners of Cook County and such other agencies as are deemed appropriate. SECTION THREE: This resolution shall be in full force and effect from and after its passage and approval as provided by law.
