Resolution No. 19-66
RESOLUTION OPPOSING PROPOSED REZONING
IN COOK COUNTY DOCKET NO. 1028
WHEREAS, there is presently pending before the Zoning Board of Appeals of
Cook County, Illinois, an application for reclassification of certain property
containing approximately 2.44 acres located in Wheeling Township on the north
side of Foundry Road 465 feet west of Wheeling Road from the R-5 General Resi-
dence District to the B-4 General Service District; and
WHEREAS, said proposal has been docketed and heard as Docket No. 1028 before
the Zoning Board of Appeals of Cook County, Illinois; and
WHEREAS, the Village of Mount Prospect appeared at a public hearing on the
said Docket No. 1028 on March 11, 1966, and then and there stated its opposi-
tion to the proposed amendment and reclassification; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have considered the said application for a rezoning and a report of the testi-
mony and exhibits adduced in support thereof, and have determined that the re-
zoning of the said property from the R-5 District to the B-4 District under
the Zoning Ordinance of Cook County would be highly detrimental to the Village
of Mount Prospect and the citizens of Cook County and would impede the normal
and orderly development of the portion of the unincorporated area of Cook
County in which the subject property of such application is located; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
are of the opinion that the proposed use of the subject property for a motel
and the proposed height of such structure would have a substantially adverse
affect upon the use and enjoyment and the value of residential propert7es in
the vicinity of the subject property; and
WHEREAS, the Village of Mount Prospect lies within one and one-half miles of
the subject property and is the municipality with its limits nearest adjacent
to the subject property; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
desire to exercise the authority to file a formal objection conferred upon
them by Section 3158 of Chapter 34 of the Illinois Revised Statutes.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, ILLINOIS:
SECTION ONE: That the Village of Mount Prospect does hereby oppose the grant-
ing of the application for rezoning from the R-5 General Residence District to
the B-4 General Service District under the Zoning Ordinance of Cook County
sought by J. M. Brickman Mid-West Corporation, as applicant, and Western
National Bank of Cicero, as Trustee under Trust No. 2168, as landowners of
certain property located in Wheeling Township, hereinabove described, docketed
as Docket No. 1028 before the Zoning Board of Appeals of Cook County, Illinois.
SECTION TWO: That immediately upon the publication and approval of this
Resolution, the Village Clerk of the Village of Mount Prospect be, and he is
hereby, authorized and directed to transmit certified copies of this Resolu-
tion to the County Clerk of Cook County, to the Secretary of the Zoning Board
of Appeals of Cook County, and the President of the Board of Commissioners of
Cook County.

SECTION THREE: This Resolution shall be in full force and effect from and after
its passage and approval in the manner provided by law.
