RESOLUTION NO. 40-66
A RESOLUTION ALLOWING THE VARIATION AT
1024-32 EAST NORTHWEST HIGHWAY
WHEREAS,the Board of Appeals of the Village of Mount Prospect
held a public meeting on June 3, 1966, at the Mount Prospect Village Hall
pursuant to notice published in the Mount Prospect Herald on May 19, 1966; and
WHEREAS, the Board of Appeals heard t~stimony presented under
Case No. 66-11A pertaining to a request for variation for reduction of
rear yard requirements from 20 feet to 10 feet for said property which is
I under the B-3 zoning classification, located at 1024-32 East Northwest
Highway, Mount Prospect; and
WHEREAS, said Board of Appeals denied the request because of the
excessive built-up areas on the lot, with only a 10 foot rear yard, was a
bad precedent and not justifiable on a hardship basis; and
WHEREAS, the Judiciary Committee of the Board of Trustees of the
Village of Mount Prospect did review the matters at their regular meeting; and
WHEREAS, the Committee determined that the variation requested
will not, in itself, increase or decrease on-street parking as the property
owner has agreed to secure commonly owned property which is adjacent to the
abutting alley as a parking lot for said subject property to satisfy the
off-street parking needs, and therefore recommended the granting of the
request; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have reviewed the matter herein and have determined that
same is for the best interest of the Village of Mount Prospect;
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT:
SECTION ONE: That the building located at 1024-32 East Northwest
Highway, Mount Prospect, Illinois, may be extended to the rear of the lot
so that there is remaining only a 10 foot rear yard, provided that the lot
adjacent to the abutting alley owned by the subject property owner has a
convenant placed on it to secure parking facilities for said subject property.
SECTION TWO: That all requirements of the Village Code be
applicable except that requirement for minimum rear yard under B-3 zoning
classification.
SECTION THREE: That the Director of Building and Zoning of the
Village of Mount Prospect is hereby directed to issue a building permit in
accordance with the variation hereinabove mentioned after said covenant
on the lot for parking has been executed.
SECTION FOUR: That the variation granted by this Resolution
shall be null and void and of no force and effect whatsoever unless an
application for a building permit pursuant to such variation is made and
construction commenced one year from the date said Resolution becomes
effective.

SECTION FIVE: This Resolution shall be in full force and effect
from and after its passage and approval in the manner provided by law.
