RESOLUTION NO. 2-67
A RESOLUTION BY THE VILLAGE OF MOUNT PROSPECT OBJECTING TO THE REZONING R-4 (SINGLE-
FAMILY RESIDENCE DISTRICT) TO R-6 (GENERAL RESIDENCE DISTRICT) OF PROPERTY LOCATED
ON THE NORTHEAST CORNER OF CHURCH ROAD AND DEMPSTER STREET IN ELK GROVE TOWNSHIP,
COOK COUNTY, ILLINOIS, DESIGNATED BY THE COOK COUNTY ZONING BOARD OF APPEALS AS
DOCKET #1124; AND OBJECTING TO THE REZONING R-4 (SINGLE-FAMILY RESIDENCE DISTRICT)
TO R-5 (GENERAL RESIDENCE DISTRICT) OF PROPERTY LOCATED ON THE NORTH SIDE OF DEMPSTER
STREET APPROXIMATELY 560 FEET EAST OF CHURCH ROAD IN ELK GROVE TOWNSHIP, COOK COUNTY,
ILLINOIS, DESIGNATED BY THE COOK COUNTY ZONING BOARD OF APPEALS AS DOCKET #1123.
WHEREAS, said Docket #1123 and Docket #1124 were heard together as one pre-
sentation before the Cook County Zoning Board of Appeals in the Elk Grove Village
Hall on December 12, 1966, and
WHEREAS, Robert E. Haskins, Attorney at Law, appeared in behalf of the owner
of the property, American National Bank, as Trustee under Trust #16912, and did then

and there present the request for the zoning change on these two parcels from its
current R-4 (Single-Family Residence District) to R-5 and R-6 (General Residence
Districts) respectively, and
WHEREAS, the subject property under Docket #1123 is located approximately
560 feet East of Church Road on the North side of Dempster Street in Elk Grove Town-
ship, County of Cook, and
WHEREAS, the subject property under Docket #1124 is located on the Northeast
corner of Church Road and Dempster Street in Elk Grove Township, Cook County; and
WHEREAS, the Village of Mount Prospect is contiguous on the North and East
of the subject property and therefore within one and one-half miles of the subject
properties sought to be rezoned, and
WHEREAS, the Village of Mount Prospect appeared at a public hearing on said
Dockets #1123 and #1124 on December 12, 1966, at the Village Hall of Elk Grove Village,
Illinois; and then and there stated objections to the proposed amendments and re-
classification; and
WHEREAS, the President and Board of Trustees of the Village of Hount Prospect
desire to exercise the authority to file a formal objection conferred upon them by
Section 3158 of Chapter 34 of the Illinois Revised Statutes of 1965;
NOW THEREFORE, BE IT RESOLVED BY THE PP~SIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the Village of Mount Prospect does hereby object to the
rezoning sought in Dockets #1123 and #1124, as described hereinabove, and requests
the County Board to vote its official objection and in support thereof does hereby state
the following reasons for the objection are as follows:
A. That the property immediately to the North of the subject property is
zoned R-l (Single-Family Residence District) in the corporate limits of the Village of
Mount Prospect currently owned and controlled by the Mount Prospect Park District;
the property immediately to the East of the subject property is zoned R-l (Single-
Family Residence District) in the corporate limits of the Village of Mount Prospect
currently owned by School District #59 and improved thereon with a school buLldlng;
the property to the West of the subject property is currently zoned and improved as
R-5 (General Residence District) in the County of Cook; the property to the immediate
south of the subject property is zoned R-4 (Single-Family Residence District) in the
County of Cook and has been partially developed as such.
B. That since the Comprehensive Zoning Ordinance of 1960 of Cook County no
zoning changes have been incurred in the immediate area and specifically no zoning
changes on any of the properties adjacent to the subject property.
C. That the intensified use of the United Air Lines pnop~rty which is in
close proximity to the subject property should not be a determining factor for inten-
sifying the subject property's use as proposed.
D. That no testimony was submitted as to the disposition of the storm water
run-off from the subject property if improved as proposed.
E. That, in fact, the subject property is not in the designated flood plain
but is immediately between two flood plains to the East and West, and that saicl run-
off from the subject property would travel East on Dempster Street into a flood plain
at an accelerated speed causing an increase in the flooding area at or near the
Dempster Junior High School located immediately East of the subject property.
F. That the proposed improvements on the subject property indicate some seven
means of ingress and egress into the property off Dempster Street within a space of
1,000 feet from the intersection of Church Road and Dempster Street, a public safety
hazard regarding to traffic as Dempster Street is a heavily traveled artery at and
near the subject property.
G. That the proposed improvements for the subject property make no adequate
provisions for ingress and egress of necessary fire equipment to certain structures
all of which will be heavily populated and thereby causing a serious threat to public
health and safety.
H. That the proposed improvements for the subject property indicate the in-
stallation of a private road some 300 feet long off Dempster Street adjacent to the

School propertys which will result in a private road which is neither controlled
nor maintained by a governmental body yet necessary for the ingress and egress of
emergency vehicles to the proposed buildings on the subject property.
I. That the petitioner stated during said public hearing that no arrangements
have been made for the financing of said proposed improvements, same being a critical
element for without financing or without proper financing the results of this rezoning
could be speculative or an uncompleted project both of which are det~iment& to the
County of Cook and nearby communities.
J. That the petitioner failed to show that said rezoning of subject property
will result in the highest and best use of said property, for no testimony was intro~
duced as to the development of this property under its present classification, R-4
(Single-Family Residence District).
SECTION TWO: That immediately upon the publication and approval of this Resolu-
tion, the Village Clerk of the Village of Mount Prospect be, and is hereby authorized
and directed to transmit certified copies of this Resolution to the County Clerk of
Cook COUhty, to the Secretary of the Zoning Board of Appeals of Cook County, and the
President of the Board of Commissioners of Cook County.
SECTION THREE: This Resolution shall be in fuil force and effect from and
after its passage and approval in the manner provided by law.
