",...., RESOLUTION NO. 31-68 A RESOLTJrIONBY THE VILLAGE OF MOUNT PROSPECT OBJECTING TO THE REZONIr-lJ OF R-4 "SINGLE FAMILY RESIDENCE DISTIRCT" TO R-6 "GENERAL RESIDENCE DISTRICT" OF CERl'AIN PROPERlY LOCATED ON THE NORTH SIDE OF ALGONQUIN ROAD, APPROXIMATELY 2250 FEET EAST OF GOEBERT ROAD: DESIGNATED BY THE COOK COUNrY ZONING OOARD OF APPEAlS AS OOCKE'r #1443. WHEREAS, the Petitioner in C.B. #65633 seeks a rezoning of certain properly located on the north side of Algonquin Road, approximately 2250 feet east of Goebert Road, from its R-4 (single family residence district) to R-6 (general residence district), which case was docketed by the Cook County Zoning Board of Appeals as Docket #1443; and WHEREAS, the Village of Mount Prospect is irmnediately adj acent and oontiguous to the subjeot property on the north side and therefore within one and one half miles of the property sought to be rezoned; and WHEREAS, the Village of Mount Prospeot appeared at a Public Hearing on said Dooket #1443 on October 14, 1968 and then and there requested time within which to file its formal objection to the said proposed rezoning; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect desire to exercise the authority to file a fonnal objection, whioh authority has been conferred upon them by Section 3158 of Chapter 34 of the Illinois Revised Statutes; NOW, THEREFDRE, BE IT RESOLVED BY THE PRE..SIDENr AND OOARD OF TRUSTEES OF THE VILLAGE OF MOUNr PROSPECT, COOK COUNrY, ILLINOIS: SECTION 1: That the Village of Mount Prospect does hereby obj ect to the rezoning described above and requests that the County Board vote in aooord with this offical objection, and does hereby state the reasons for the said objection as follows: (1) That the rezoning of the subject tract would amount to spot zoning in that; properties lying irmnediately to the east and west of the subjeot parcel are presently zoned single family residential and are improved as such; property to the north is within the oorporate limits of the Village of Mount Prospect and is developed as single family residential; and there are no properties currently zoned R-6 in the County for miles around the subj ect property. (2) That the primary use of the property as described by the Petitioner is for the erection of scme ninety-eight (98) one and two bedroom apartment un1 ts in four (4) separate buildings, which use is too dense for the tract it will be constructed upon. This is borne out by testimony of the builder that the number of un1 ts in this projeot necessitated this petition for R-6 zoning rather than R-5 zoning, along with testimony by the architect that fire fighting equipment entering the property would be unable to turn aound in order to leave the said property. (3) That water and sewer facilities have not been shown to be available. In fact, testimony indicated that there is no agreement made between the Petitioner and the Utility Sewer and Water Company for the said servioes, nor was there any testimony indicati _ that the said Utility Sewer and Water Company is an.ything more than a distribution oompany dependent upon a third party for its source of water. ",...'~ ~ .~ ...."J ( 4 ) That sole criteria for the highest and best use of the sUbject property is the financial gain to the Petitioner as indicated by the testimony, rather than competent land planning. SECTION 2: That the Village Clerk is hereby authorized to submit certified copies of this Resolution to the Clerk of Cook County for transmittal to the County Board and such other agencies as are deemed appropriate. SECTION 3: This Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law.
