RESOLurION NO. 8-69
A Resolution by the Village of Mount Prospect objecting to the rezoning of
R-4 "Single-Family Residence District" to R-6 "General Residence District" of
certain property located on the north side of Algonquin Road, approximately
682 feet east of Cedar Glen Drive (if extended), desiP.11a.ted by the Cook County
Zoning Board of Appeals as Docket #1471.
WHEREAS, the Petitioner in Z. A. #A-68-84 seeks a rezoning of certain property
located on the north side of Algonquin Road approximately 682 feet east of
Cedar Glen Drive (if extended), from its R-4 (Single-family Residence District)
to R-6 (General Residence District). which case was docketed by the Cook
County Zoning Board of Appeals as Docket #1471; and
WHEREAS. the Village of r10unt Prospect is irr1rrediately adj acent and contiguous
to the subject property on the north side and therefore within one and one-
half miles of the property sought to be rezoned; and
WHEREAS, the Village of Mount Prospect appeared at a Public Hearing on said
Docket #1471, March 7, 1969, and then and there requested tirm within which
to file its formal objection to the said proposed rezoning; and
WHEREAS. the President and Board of Trustees of the Village of Mount Prospect
desire to exercise the authority to file a formal objection, which authority
has been conferred upon them by Section 3158 of Chapter 34 of the Illinois
Revised Statutes,
NOW. THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT. COOK COUNTY. ILLD'-JOIS:
SEGrION ONE: That the Village of Mount Prospect does hereby obj ect to the
rezoning described above and requests that the County Board vote in accord
with this official obj ection, and does hereby state the reasons for the said
objection as follows:
(1) That the rezoning of the subj ect tTact would amount to spot
zoning in that: properties lying imnediately to the east of the
subj ect parcel are presently zoned single-family residential and
are improved as such; property to the north is within the corpor-
ate limits of the Village of Mount Prospect and is developed as
single-family residential.
(2) That the primary use of the property as described by the
Petitioner is for the erection of sorm ninety (90) efficiency and
one and two bedroom apartrmnt units in two (2) separate buildings,
which use is too dense for the tract it will be constructed upon.
This is borne out by testimony of the builder that the number of
units in this project necessitated this petition for R-6 zoning
rather than R-5 zoning.
(3) That water and sewer facilities have not been shown to be
available. In fact, testimony indicated that there is no formal
agreement made between the Petitioner and the Village of Mount
Prospect who is acquiring utility Sewer and Water Conpany or the
Utility Sewer and vlater Conpany for the said services, nor was
there any testimony indicating that the said Utility Sewer and
Water Conpany is anything more than a distribution canpany depend-
ent upon a third party for its source of water.
(4) That the sole criterion for the highest and best use of the
subject property is the financial gain to the Petitioner as in-
dicated by the testimony, rather than competent land planning.
SECTION TWO: That the Village Clerk is hereby authorized to submit certified
copies of this Resolution to the Clerk of Cook County for transmittal to the
County Board and such other agencies as are deemed appropriate.
